Subject: 01-04-00 211 Council Policy Regulating the Zoning and Sale of Surplus Property Proposed By: City Manager's Review: Page: Councilmember Haskin � Q,R,( PAGE 1 OF 2 PROPOSAL: It is proposed that the City Council adopt the following policy conceming the Zoning and Sale of Surplus Property: 1. The Planning Department, in conjunction with the Development Department and Real Property Management, is directed to review all surplus property in the City of Fort Worth in order to determine whether the property is zoned in conformance with current use and the proposed 2000 Comprehensive Plan and the zoning is compatible with surrounding land uses. Upon adoption of the 2000 Comprehensive Plan and subsequent amendments to the plan, surplus property shall be reviewed for compliance with the comprehensive plan then in effect. 2. Upon completion of zoning reviews the Planning Department is authorized and directed to file a rezoning application in order to submit the properties to the Zoning Commission and City Council for appropriate zoning change. No application fees will be charged. 3. Upon completion of the zoning process,the properties shall be offered for sale. DISCUSSION: On November 9, 1999, staff presented three policy options to the City Council pertaining to the future sale of surplus property. Following the presentation City Council directed staff to implement a policy prior to future surplus property sales. All surplus property will be reviewed with respect to the following criteria: 1. Whether the property is zoned in conformance with current land use; and 2. Whether the zoning designation is compatible with surrounding land uses; and 3. Whether the property is zoned in conformance with the proposed 2000 Comprehensive Plan. It is recognized that the 2000 Comprehensive Plan has not been adopted by the City Council. However, the land uses proposed in the plan may be consulted to provide guidance for determining the appropriate zoning designation for surplus property. It is anticipated that the 2000 Comprehensive Plan will be adopted in 2000 and amended annually thereafter. All currently owned and future properties received by the City of Fort Worth will be reviewed for compliance with this policy prior to being offered for sale. LEGALITY: The Department of Law finds that this proposal is legal and within the authority of the City Council. FISCAL NOTE: The Finance Director certifies that this policy will have no material impact on City funds. CITY MANAGER'S COMMENT: The City Manager concurs with the policy for the rezoning of surplus property as proposed.
