Proposal:
It is proposed the City Council repeal all requirements of the Neighborhood and
Community Park Dedication Policy for areas within the City's extraterritorial jurisdiction
(ETJ).
Discussion:
On December 19, 2000 (M&C G-13114) the City Council approved revisions to the
Neighborhood and Community Park Dedication Policy and adopted the policy as an
amendment to the Subdivision Ordinance. This action authorized the requirement of
community park dedication, or fee in-lieu-of, in the ETJ at a rate of 3.75 acres per
thousand populations generated by residential development. As the City has continued to
pursue it's application for the Certificate of Convenience and Necessity for the ETJ; the
requirement for this park dedication has become a point of discussion. Proponents and
developers of large lot rural subdivisions have raised questions regarding the necessity
for such a policy given the low density development occurring in most of the ETJ area.
Additionally, it is believed that acquisition of community park properties in the ETJ
without funding for capital improvements or maintenance could become a burden and/or
liability to Fort Worth taxpayers.
For these stated reasons, it is proposed to remove all requirements of the park policy in
the ETJ from the Subdivision Ordinance.
Legality:
The Department of Law finds that this proposal is legal and within the authority of the
City Council.
Fiscal Note:
The Finance Director certifies that the adoption of this proposal will not require
additional fund to be appropriated to the general fund budget.

Change language in proposal to read:
It is proposed the City Council adopt a moratorium on all requirements of the
Neighborhood and Community Park Dedication Policy for areas within the City's
extraterritorial jurisdiction (ETJ). The moratorium is to be in place upon adoption of
this policy and terminate on July 1, 2001.
AND Insert the following as paragraph 2 in the Discussion.
