Subject: 03/27/01 220 RESTRUCTURE REPRESENTATION ON THE BOARD OF THE CITY'S EMPLOYEES'RETIREMENT FUND Proposed By: City Manager's Review: Page: COUNCILMEMBER WENDY PAGE 1 OF 3 DAVIS • PROPOSAL: It is proposed that the City Council amend the City's Retirement Ordinance to restructure the Board of Directors and make the related changes as described below: 1 BOARD COMPOSITION No. Representing Selected 2 Police Department(1,578) Elected 1 Fire Department(782) Elected 1 Water Department(753) Elected 1 Library, PACS,Golf,Culture and Tourism,Public Events and Public Elected Health(795) 1 City Services, Solid Waste,Equipment Services,TPW,Aviation, and Elected Environmental Management(763) 1 All Other Departments(869) Elected 1 Police and Fire Retirees(1,092) Elected 1 General Retirees(1,775) Elected 1 Council(All/Citizens) Appointed 1 Citizen(All/Citizens) Appointed Finance Director(Non-voting) Ex-Officio 11 TOTAL RELATED CHANGES ■ Name the Finance Director as the permanent,non-voting chair of the Board. ■ Limit terms for all voting Board members to six consecutive years(3 terms). ■ Provide that an ethics code for all Board members be incorporated into the Retirement Ordinance. ■ Citizen member should have experience in pension, investments, or human resources matters. BACKGROUND: There have been a number of proposals presented to restructure the composition of the Retirement Board to ensure that all active employees and retirees,as well as citizens,are fairly represented.The proposed changes described above seek to accommodate the desires of the employee groups and the Council's responsibility to ensure that citizen interests are also represented. COUNCILMEMBER WENDY PAGE 2 OF 3 DAVIS CA4&,�� a. &UAA.0 It is hoped that these changes will reinforce the Council's role as the ultimate policy maker for this Retirement System, encourage all employee groups to give up their efforts to divide the Fund,and perhaps to support legislative action which would preclude an extended and contentious debate over splitting the System. DISCUSSION: This proposed Board structure incorporates most of the changes which seem to have been generally agreed upon by the employee groups: ■ Adding a retiree slot to ensure that a Public Safety retiree and a General retiree are always represented on the Board. ■ Adding a second slot for the Police Department and another slot for General employees to keep the representation by each active Board member in the 800 employees range. ■ Increasing the number of elected Board members from 6 to 9. It further addresses Council concerns for citizen input by continuing the Council's appointment of Council member and a citizen to the Board. As a non-voting member,the Finance Director will serve as a"neutral" chairperson to facilitate discussion and ensure that everyone is heard.All voting Board members, including both elected and appointed Board members,will be limited to serving three two-year terms. An ethics code,which is presently a Board policy,will be strengthened by incorporating it into the Retirement Ordinance. Under this structure,Public Safety representatives will comprise 44%of the elected members and 36%of all voting members.Representatives of the General employees will comprise 56%of the elected members 45%of all voting members. As you recall,37%of the total number of active employees and retirees are characterized as Public Safety and 63%are General. This proposal recognizes that a majority of the participants of the Retirement System are General employees, but neither the Public Safety group nor the General employee group will have a guaranteed majority of the voting Board members.
