Authorize the City Manager to enter into negotiations and execute a Development Agreement with Robison Home Builders to assist in the construction of site built homes in the Highcrest Addition of the city; and 2. Authorize the City Manager to amend the agreement, if necessary, to achieve project goals provided that the amendment is within the scope of the project and in compliance with applicable laws and regulations. DISCUSSION: Robison Home Builders proposes to construct affordable housing in the Highcrest Addition of the City. The neighborhood is located just north of 28th Street, East off of Interstate 35, North. According to 2000 census data the total population is 185 persons with a median household income of $35,759. There are sixty-two housing units with an owner occupancy rate of 73%. Additionally there are at least 60 vacant lots in the neighborhood. Cliff Robison, the owner of Robison Home Builders, initially planned to construct modular homes in the neighborhood and has completed two modular homes. However recently, Mr. Robison has consented to consider constructing site-built homes in accordance with mutually agreed upon design guidelines in exchange for waiver of all building permit fees, water and sewer tap fees. Impact fee waivers are restricted by state statue to Neighborhood Empowerment Zones and will not be considered for this project. The developer currently owns 15 lots and is also seeking retroactive waivers on two houses completed. All homes must be three bedrooms with two baths and a minimum of 1,250 square ft. of living space. 2. One car garage with concrete driveways. 3. Composition roof with a minimum 7/12 pitch. 4. Engineered concrete slab foundation. 5. Steel or wood framing. 6. Covered front porch on all homes with a minimum of 100 sq. ft. 7. 75% brick exterior with the remaining siding to be Hardie Board. 8. All front facing windows to have window length shutters. 9. Four feet wide concrete sidewalks across the front of each house with the standard city setback for green space. 10. Foundation/porch to be elevated a maximum of 24 inches. 11. No contract for deed sales. LEGALITY: The Department of Law finds that this proposal is legal and within the authority of the City.
