Instruct City Staff to prepare a text amendment to the Zoning Ordinance eliminating the requirement of hotels,motels and inns from having to obtain a Planned Development Specific Use designation and Site Plan for these facilities in High Intensity Mixed-Use(MU-2)and Central Business(H)zoning districts: 2. Instruct City Staff to notice the proposed text amendment to insure the Zoning Commission can consider the amendment at its regularly scheduled meeting on July 9,2003; and 3. Instruct City Staff to notice the proposed text amendment to insure the City Council can consider the proposed text amendment on its regularly scheduled meeting on July 15,2003,if the Zoning Commission issues a recommendation. DISCUSSION: On December 9, 1986 the City Council adopted Ordinance Number 9781 amending the Comprehensive Zoning Ordinance by prohibiting the location of hotels and motels within 500 feet of any residentially zoned property and providing for Planned Development Specific Use(PDSU)and Site Plan approval for any hotel or motel within 1000 feet of any residentially zoned property. It is the understanding of City Staff that the ordinance was adopted to better manage the impacts hotels and motels were having on adjoining residential properties. After the adoption of this ordinance it became common practice to go to the Board of Adjustment to receive a variance on the requirement of not allowing any hotels or motels within 500 feet of residentially zoned property. The Board commonly granted the variances and hotel/motel developers would then process the required PDSU and Site Plan through the Zoning Commission and City Council. With the re-codification of the Zoning Ordinance on August 23, 1999(Ordinance Number 13896)the restriction of not allowing hotels or motels within 500 feet of residentially zoned property was removed from the Zoning Ordinance,but the requirement for PDSU and City Plan approval remained intact for those within 1000 feet of residential properties. On August 14,2001 the City Council approved a zoning change request for 25.05 acres on West Seventh Street. The prior zoning was"J"Industrial and the change designated the entire tract as High Intensity Mixed-Use(MU- 2). This project area, South of Seventh,is proposed to be a mixed-use development of residential,commercial V and industrial uses allowed by right under the MU-2 designation. P On June 5,2003,a pre-development conference was held with the South of Seventh development team to discuss the placement of a hotel within the boundaries of the project. The creation of the Mixed Used zoning classification in 2001 envisioned a variety of higher density housing types among commercial,institutional and selected light industrial uses. Much like the Central Business H zoning classification, MU-2 is viewed as a flexible zoning classification that grants a number of uses by right rather than requiring PDSU designations. This MU-2 classification allows the developer more latitude in uses while conforming to the development standards identified in the zoning classification. It is proposed to eliminate the requirement of hotels,motels or inns located in either MU-2 or H zoning districts from having to obtain a PDSU and Site Plan approval when located within 1000 feet of residentially zoned property. The requirement for PDSU and Site Plan would continue for facilities in FR,F and G Commercial districts as well as I,J and K Industrial districts. LEGALITY: The Department of Law finds that this proposal is legal and that it is within the authority of the City Council. FISCAL NOTE: The Finance Director certifies that the approval will not require the appropriation of additional funds at this time. CITY MANAGER'S COMMENT: If approved,the staff will schedule the proposed text amendment for consideration by the Zoning Commission on July 9d and if the Zoning Commission issues a recommendation,notice the case to allow the Council to act upon the recommendation on July 15te.
