PROPOSAL:
It is proposed that the City Council revise the petition-based rezoning procedure described in M&C G-13003 by adding
the following text to the end of paragraph 3,"If the non-consistent districts to be rezoned are contiguous to consistent
districts with the proposed zoning classification,and if the pertinent community organization so requests,then the City
shall include the contiguous consistent districts in the calculation of parcels and land area pursuant to the Fifty Percent
Rule."
DISCUSSION:
On August 29,2000,the City Council adopted M&C G-13003,which describes certain procedures for rezoning districts
through a petition process so as to make them more consistent with the Comprehensive Plan. The petition must contain
the signatures of property owners representing 50 percent or more of the parcels to be rezoned,and 50 percent or more of
the land area to be rezoned within any non-consistent zoning district. The proposed amendment would allow contiguous
property that is already zoned in the proposed zoning classification to be counted toward the petition requirements. In
two designated urban villages,for example,large property owners have individually rezoned their property to mixed-use
classifications. Under the current petition procedures,the remaining property owners in these urban villages are unable
to count the rezoned areas toward the land area and parcel requirements,making it unnecessarily difficult to produce
valid petitions for mixed-use zoning.
LEGALITY:
The Law Department finds that this proposal is legal and within the authority of the City Council.
FISCAL NOTE: APPROVED
