It is proposed that the City Council: i
Consider exemption of the requirement that Loyd Henley enter into a Community Facilities Agreement
(CFA) with the City, as would normally be required in conjunction with his application to plat one lot on
Randol Mill Road for the development of a single family residence. A CFA would require the developer
to provide 100% of the costs associated with the construction of curb, gutter, sidewalks, and other
infrastructure improvements adjacent to the subject lot.
DISCUSSION:
Mr. Henley submitted-a final plat for review by the Plan Commission for one lot on Randol Mill Road
for a single-family residence. Staff comments included the requirement that Mr. Henley enter into a
CFA for infrastructure improvements adjacent to the subject lot. Execution of the CFA is required
before the final plat can be filed with the County and before any building permits are issued.
Randol Mill Road is currently unimproved. No curb, gutter, or sidewalks are currently in place along
the block in question. Current policy will require a CFA for any future platting and development that
occurs along the block.

The Law Department finds that this proposal is legal and within the authority of the City Council.
FISCAL NOTE:
The Finance Director certifies that approval of this proposal will not require the appropriation of
additional funds. However, the City will be responsible for the cost of the infrastructure improvements
when they are constructed.

CITY MANAGER'S COMMENT:
The City's policy for Installation.of Community Facilities was adopted by the City Council on March
20, 2001. The policy requires that when property is platted, the owner either constructs adjacent
infrastructure necessary to serve the development to City standards, or provides escrow funds for future
construction. In this case, the City would require concrete sidewalks, curb, and gutter, and an asphalt
tie-in to existing pavement. This arterial street is not included in the 2004 bond program. Therefore,
Randol Mill Road is not scheduled for reconstruction by the City in the next six years. If the requested
waiver were approved, the City would bear 100% of the cost of these improvements in the future.
Should it be the desire of City Council to approve this request, our recommendation would be to
consider this an exception to the policy, not a policy change.
