City Attorney's Review: PAGE I OF 1 PROPOSAL: It is proposed that the City Council authorize a waiver of the zoning change application fee,in the amount of$924,for property located at 3705 Crestline Road,subject to an application being made by September 30,2007. DISCUSSION: On January 18,2007,the City Council approved the rezoning of the subject property from"C"Medium Density Multifamily Residential to"A-5"One Family Residential(ZC-06-299),as part of a petition-based zoning change. The property is Lot 2, Block 2,of the Queensborough Heights Addition in the Arlington Heights neighborhood. The property owner,Mr.Harold Matthews,states he did not receive written public notice when the property was advertised for public hearing by the Zoning Commission. Mr.Matthews'reason for non-receipt was that he had moved from the property to another address,and Tarrant Appraisal District(TAD)records had not been updated to enable his timely receipt of the hearing notice. The zoning change to be requested by Mr.Matthews is not currently known. However,Mr.Matthews states he intends to seek a zoning change that is compatible with existing duplex or multifamily uses in the immediate vicinity. The January 18 rezoning of this and surrounding properties to"A-5"brought the zoning into compliance with the Comprehensive Plan and the existing use. LEGALITY: The Law Department finds that this proposal is legal and within the authority of the City Council.
