PROPOSAL:
It is proposed that the City Council authorize a waiver of the zoning change application fee and the double notice€ee,in the
amount of$1,848,for property located at 3401,3405,3409,3413,3417,and 3421Lawnawood Street,subject to an application
being made by Septeimber 11,2007.
DISCUSSION:
On July 17,2007,the City Council approved the rezoning of the south side of the 3400 block of Galvez Avenue from"J"
Medium Industrial to"A-5"One Family Residential(ZC-07-028). The property includes Lots 1.6,Block 44,of the
Riverside Addition in the Northeast Sector.
The property owners loci on the south side of Block 44 of the Riverside Addition wqxessed.concerns about the impact on
their adjacent industrial property.The newly approved"A-5"One Family zoning would impose additional development
restrictions on their property,including a 50-foot setback,bufferyard,and fencing requirements.
The property owners of Lots 7-12,Block 44,of the Riverside Addition intend to request a"PD/J"Planned Development for
all uses in-Jr Medium Industrial,with waivers for the development restrictions and the site plan rapiremat This zoning
request would protect the owners'development rights.
LEGALITY:
The Law Department finds that this proposal is legal and within the authority of the City Council.
FISCAL NOTE:
The Finance Director certifies that this action will have no material effect on City funds. APPROVER
