PROPOSAL:
It is proposed that the City Council authorize a waiver of the right-0f--way vacation and plat application fees, in the amount of
$1017,for a portion of Carlock Street between College Avenue and the north-south alley in Block 1 of Carlock's South Side
Addition.
DISCUSSION:
Mr.Paul Holt,acting on behalf of the property owner at 2250 College Avenue,has requested the waiver of application fees
for the vacation and replat of a portion of Carlock Street adjacent to his property.
The City Council should make two findings prior to approval of a fee waiver:
1.That the waiver carries out a public purpose;and
2.That there are sufficient controls to ensure the public purpose is carried out.
In this case,the public purpose involved is one of public safety.This portion of Carlock Street is narrow,dark,overgrown
and used as an area for groups to congregate;resulting in petty theft.It is near Daggett Middle School and many people speed
through this segment of Carlock to avoid the one way street configuration.The vacation of Carlock would improve the safety
of residents and reduce criminal activity in the Fairmount Addition.The Fairmount Neighborhood Association supports this
request. Should the fee waiver request be granted,the right of way will be vacated and platted into Mr.Holt's property,
allowing him to fence and maintain the area.
LEGALITY:
The Law Department finds that this proposal is legal and within the authority of the City Council.
FISCAL NOTE: APPROVED
The Finance Director certifies that this action will have no material effect on City fun�iTY COUNCIL
