PROPOSAL:
It is proposed that the City Council initiate zoning changes for 16 legal nonconforming pawn shops from
"E"Neighborhood Commercial to "PD/E" Planned Development for E uses plus pawn shop, with a site
plan waiver.
DISCUSSION:
On August 21, 2006 (Ord. No. 17093), the City Council approved a Zoning Ordinance text amendment
that removed various uses, including pawn shops, from the "E"Neighborhood Commercial and "MU-1"
Low Intensity Mixed-Use districts as permitted uses. As a result, 16 existing pawn shops were made
legal nonconforming. This status allows the use to continue indefinitely but prohibits expansion and
resumption of the use if the structure is destroyed more than 75 percent of its value.
State law regulates pawn shops through Chapter 371 of the Finance Code,known as the Texas Pawnshop
Act. A pawnbroker may only have a license issued for a new facility if it is greater than two miles from
an existing pawn shop, or for the relocation of a licensed pawnshop if it is greater than one mile from
either another pawn shop and,as applicable,within one mile from the shop's existing location.
At the February 9, 2010 pre-Council meeting, the majority of Councilmembers expressed their desire to
rezone the 16 legal nonconforming pawnshops to be in conforming status.

This Council Proposal authorizes staff to initiate the rezoning process. If directed, staff will prepare a
zoning case which will require a recommendation from the Zoning Commission and approval by the City
Council.
LEGALITY:
The Law Department finds that this proposal is legal and within the authority of the City Council.
FISCAL NOTE:
The Finance Director certifies that this action will have no material effect on City funds.
CITY MANAGER'S COMMENT:
The City Manager has no objection to this proposal.
