AN ORDINANCE AM ENDING CERTAIN PORTIONS OF ORDINANCE
NO 8316 THE ELECTRICAL CODE OF THE CITY OF FORT
WORTH TO REQUIRE MAINTENANCE ELECTRICIANS TO BE
LICENSED IN THE CITY OF FORT WORTH AND TO ALLOW
ARMORED CABLE (BX) AS A WIRING METHOD IN CERTAIN BUILD-
ING CONSTRUCTIONS PROVIDING FOR A SEVERABILITY CLAUSE
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES
AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND
PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH TEXAS
SECTION 1
That Ordinance No 8316 Sec 2 Exhibit B is hereby
amended by adding the following provisions to-Wit
'Maintenance Licenses
Sec 1015 Electricians regularly employed on a per-
manent basis by any person and who perform work only in
the confines of the building in or on the premises
where they are regularly employed on a permanent basis
and who do Electrical M aintenance work as defined in
Section 1016 shall be known as 'Maintenance Electri-
cians
Sec 1016 Electrical Maintenance Work shall mean
the keeping in safe repair of any and all electrical
installations apparatus and equipment and the keeping
in safe repair or moving and relocating of electrical
equipment within a building or in or on the premises
where the Maintenance Electrician as defined in Sec-
tion 1015 above, is regularly employed on a permanent
basis for which work a permit is required under the
terms and provisions of this code but does not include
the installation of new and additional electrical work
electrical equipment or electrical apparatus
Sec 1017 It shall be unlawful for any person to do
any electrical work as defined in Section 1016 above
within the City of Fort Worth unless such person. is a
Maintenance Electrician licensed under the provisions
of this Chapter provided however that this Chapter
shall not prohibit a Journeyman Electrician provided
for in Section 1015 such as electrical maintenance
work under the supervision direction and control of a
Maintenance Electrician licensed under the provisions
of this Chapter without said Journeyman Electrician
having to obtain a license as a Maintenance Electri-
cian provided further that should the holder of a
Journeyman Electrician s Certificate at any time bring
himself within the definition of a Maintenance Electri-
cian by becoming employed on a permanent basis and in
general as provided for in Section 1015 such Journey-
man Electrician shall be required to obtain a license
as a Maintenance Electrician in addition to his Jour-
neyman Electrician s Certificate

Nothing in this Chapter shall be construed to
limit the right of a Master Electrician to perform such
electrical maintenance work or to limit such work
being performed by a Journeyman Electrician under the
supervision direction or control of a Master Electri-
cian or to prohibit a Helper and/or Apprentice from
working under the direct personal and constant supervi-
sion of a Maintenance Electrician Chapter 9 shall
comply with Section 901 of this cod e
Sec 1018 1 An application for a Maintenance
Electrician s license shall be made in writing to the
Secretary of the Board stating the name and address of
the applicant and a statement as to the active and
practical experience of the applicant
2 Those applying for such licenses shall be
given a written examination as to their qualifications
only to perform maintenance work as defined in Section
1016
3 The Electrical Board shall grant licenses ap-
plied for and shall issue certificates therefor to each
applicant who shall make a grade of 70 percent or bet-
ter on the examination given him provided that in no
case shall a license. be granted until after payment by
the applicant of the fee provided for in this section
4 Every holder of a Maintenance Electrician s
license shall notify the Secretary of the Board immedi-
ately when such holder makes any change in his employ-
ment giving in such notice the name of his new
employer and the location of the premises in or on
which he is to be employed to perform maintenance elec-
trical work
5 Every holder of such Maintenance Electri-
cian s license shall carry his certificate upon or
about his person while performing the acts which such
license entitles him to perform
6 Each applicant shall have four years experi-
ence in the Electrical Maintenance industry to qualify
to take the Maintenance Electrician Examination
7 Each applicant for the maintenance examina-
tion shall pay an examination fee of $2 00 to the
Secretary of the Board
8 (A) The first annual fee of $10 00 shall be
paid in advance
(B) The annual renewal fee of $5 00 shall be
payable in full on the first day of January of each
year
9 For the first year the Electrical Maintenance
License is in effect any applicant with four years
proper experience in the Electrical Maintenance Indus-
try can obtain a Maintenance Electrician License by the
grandfather clause

SECTION 2
That Ordinance No 8316 Sec 2 Exhibit B is hereby
amended by adding the following provision to wit
Sec 1601
(E) Armored Cable (BX)
SECTION 3
That this ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth Texas
(1964) as amended except where the provisions of this ordinance
are in direct conflict with the provisions of such ordinances and
such Code in which event conflicting provisions of such ordfi-
nances and such Code are hereby repealed
SECTION 4
It is hereby declared to be the intention of the City
Council that these sections paragraphs sentences clauses and
phrases of this ordinance are severable and if any phrase
clause sentence paragraph or section of this ordinance shall be
declared unconstitutional by the val id judgment or decree of any
court of competent jurisdiction such unconstitutionality shall
not affect any of the remaining phrases clauses sentences
paragraphs and sections of this ordinance since the same would
have been enacted by the City Council without the incorporation
by this ordinance of any such unconstitutional phrase clause
sentence paragraph or section
SECT ION 5
That any person firm or corporation who violates disobeys
omits neglects or refused to comply with or who resists the en-

forcement of any of the provisions of this ordinance shall be
fined not more than Two Hundred and Noj100 Dollars ($200 00) for
each offense Each day that a violation is permitted to exist
shall constitute a separate offense
SECTION 6
The City Secretary of the City of Fort Worth Texas is
hereby directed to publish the caption and penalty clause and
effective date of this ordinance for five (5) days in the
official newspaper of the City of Fort Worth Texas as
authorized by the Tex Rev Civ Stats Art 1176b-1
SECTION 7
This ordinance shall be in full force and effect from and
after the date of passage and publication as above specified

City Council approval is requested on two amendments to the City of Fort Worth's
Electrical Code
Background of Amendment 1

Amendment 1 would allow the City to license journeyman maintenance electricians
The reason for this request is that both the State Board for Hospitals as well as
some insurance companies are now requiring the employment of licensed journeyman
maintenance electricians
As currently stated, the Electrical Code only allows for the licensing of jour-
neyman craftsmen In order to license maintenance electricians, an amendment
to the Electrical Ordinance is needed
Background of Amendment 2

Amendment 2 would permit armored cable (BX} to be used as a wiring me~;hod with
limitations for all construction
American Flexible Conduit Company the largest manufacturer of A-C Cable appeared
before the Electrical Board and requested that A-C Cable be permitted as a new
wiring method in the City of Fort Worth
A survey was taken of cities that allow A-C Gable as a wiring method The survey
includes Houston Dallas, San Antonio and Austin The Electrical B®ard after
careful review voted to recommend a change in the E~,ectrical Ordinance to permit
the new method of wiring The amendment will provide for an alternate method
of construction that will be advantageous to the citizens
