WHEREAS, the City of Fort Worth (City) and M J Thomas
Engineering, LLC, (Engineer) made and entered into City Secretary
Contract No. 38580, (the Contract) which was authorized by the
City Council by M&C C-23479 on the 28th day of April 2009; and
WHEREAS, the Contract involves engineering services for the
following project:
2008 CIP Arterial Street Project - Silver Creek Road, Project No.
01293; DOE No. 6196
WHEREAS, it has become necessary to execute Amendment No. 1
to said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:
1.
Article I of the Contract is amended to include the
additional engineering services specified in a proposal letter
dated March 2, 2010, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional design
services to be performed by Engineer total $33,416. 62 .
2.
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $194,809.62 .

All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Silver Creek Road Improvements
Dear Mr.Wilson:
This letter is written in response to your request for Ml Thomas Engineering to prepare a contract
amendment for additional engineering and surveying services for the design of the Silver Creek Road
Improvements.
M1T will complete the following scope:
Proiect Scope
Task NO. 1—Suryeyinp
1) Establish horizontal and vertical control for the ottsite drainage project from existing project
control. Cstablish at least one benchmark for the iww pooject. Thm hud/untdl r,unuul alldll be
NAD83, north central zone with a detailed description being given for each control point.
2) Locate property corners and establish property lines north of Silver Creek Road for offsite
drainage project. Update existing prupCrty 111dp to lm ludo new property information.
Deliverables include an updates property map to overlay onto the topographic survey prepared
in a MicroStation V8 file format or AutoCad file format, along with copies of deeds, subdivision
Platt.and tax ownership information.
3) Provide a topographic survey of the proposed open channel from the north right-of-way of
Silver Creek Road north to the south curb of Brewer High School entrance road with the limits
depicted on Exhibit A. The topographic survey shall Include SO ft.cross-sections,and at all grade
breaks. The topographic survey shall include, but not limited to, locations in all existing features
such as water valves,curb and gutter,asphalt,sidewalks,medians,fences,driveways,storm and
sewer manholes, trees 6 in. and larger, tops and toes of slope, power poles, buildings,
mailboxes,signs,telephone risers and other visible features.
4) Provide a topographic survey of the existing drainage structures located north of Brewer High
School entrance road with the limits being as defined in an e-mail from MJ Thomas dated
2/22/2010. The topographic survey shall include 50 ft. cross-sections, and at all grade breaks
around the existing culverts.The topographic survey shall include, but not limited to,locating all

existing features such as water valves, curb and gutter, asphalt, sidewalks, medians fences,
driveways, storm and sewer manholes,trees 6" and larger,tops and toes of slope, power poles,
mailboxes,signs,telephone risers and other visible features.
5) Provide a topographic survey of an area south of silver Creek Road for the proposed force main
re-route and provide a topographic survey of a proposed new driveway and gate fencing with
the fencing depicted on Exhibit A.The topographic survey shall include cross-sections, and at all
grade breaks. The topographic survey shall include, but not limited to, locating all existing
features such as water valves, curb and gutter, asphalt, sidewalks, medians, fences, driveways,
storm and sewer manholes, trees 6" and larger,tops and toes of slope, power poles, mailboxes,
signs,trees 6" and larger,telephone risers and other visible features.
6) Deliverables shall include a MicroStation V8 drawing file or an AutoCAD file showing all of the
features located, ground elevations, a TIN and TIN file, along with one-foot interval contours.
Provide copies of the survey field notes, a hardcopy of the coordinates and an ASCII file of the
coordinates for the points located.
Task No.2—Easements
1) Prepare two permanent easement to the City of Fort Worth Standards. The permanent
easement shall include a legal description with exhibit of the proposed easement. The fee for
the permanent easement shall be$800.00.
2) Prepare three temporary construction easement to the City of Fort Worth Standards. The
temporary construction easement shall include a legal description with exhibit of the proposed
easement.The fee for the temporary construction easement shall be$600.00.
Task No. 3—Civil Design
1) MJT will provide civil engineering design and coordination of the off-site channel improvements
from Silver Creek Road north to the existing culvert at the Brewer High School entrance road.
Compensation
MJT proposes to provide the above mentioned services for the lump sum fees listed below:
