WHEREAS, the CONTRACT involves engineering services for the following project: Village Creek Parallel Interceptor, M-503/M-244 Improvements on Quail Road, Ramey Avenue, Pioneer Parkway and Handley Drive; and WHEREAS, it has become necessary to execute Amendment No. 2 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated August 26, 2016, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $365, 000 . 00 2 . This amendment request addresses the revised design concept for Location 1. For Location 1, this amendment seeks funds to design a new sewer interceptor alignment of(M- 503), including the trenchless crossing of the Exclon Power Plant discharge channel and a new aerial lake crossing of Lake Arlington so that the existing pipeline and aerial crossing can be decommissioned and its existing pipeline removed, respectively. Effectively, the original design footage for Location 1 has more than doubled with the new scope of work to a total footage of nearly 4,600 linear feet(LF). For the design of these improvements, a large amount of special subcontracting services will be required to address USACE permitting of the new pipeline; geotechnical and structural engineering design services for the new aerial structure design; and possible air quality permitting associated with the asbestos abatement and disposal of the existing M-503 main. Additional surveying and right of way services are also needed. Jakan Engineering, Inc. will provide specialized structural design services on this project to produce the aerial crossing structure and three (3) associated junction structures, plus provide technical assistance with the production of the existing aerial pipeline removal design plan. Symonds Ecology, Ltd. will provide design guidance for the asbestos abatement and disposal of the existing Lake Arlington sewer aerial crossing as well as provide additional environmental field assessment services of the new alignment. Symonds will also provide USACE NWP permitting assistance on the project. Fugro will perform supplemental geotechnical bores for the project including up to three(3)for the lake crossing and up to three(3)for the proposed junction structures. Spooner & Associates, Inc. will perform the supplemental survey for the new sewer alignment and provide soundings for the new lake crossing. This amendment request also includes additional scope for securing more temporary and permanent easements for Location 1. RJN developed a new alignment for the replacement of M-503 Station 146+77 to Station 164+39 which resulted in additional 1,762 if of large diameter pipeline design services. This design allows for the construction of the new pipeline while leaving the existing interceptor in service to minimize any required bypass pumping costs. This plan also allows for a complete parallel relief structure to be implemented prior to the eventual decommission of the old M-503 line and removal of the existing 54-inch aerial crossing (in a 66-inch steel casing pipe) pipeline. This location design include the design of 3 large concrete junction structures and possible modification and rehabilitation of an existing structure. Also note that there is over$65,000 of additional non-certified subcontractor expenses that will be incurred on this project for geotechnical services which is nearly 19% of the total amendment value. Contract Amendment No. 2 represents slightly more than an eighty-two percent (82.24%) increase in the total contract value of this project. Therefore,we are requesting Contract Amendment No. 2 to the Village Creek Parallel Interceptor Improvements Agreement in the amount of$365,000.00. DISCUSSION: On October 16, 2012 (Mayor and Council Communication (M&C) C-25924), the City Council authorized the execution of a contract with RJN Group, Inc., in the amount of$349,740.00, for Village Creek Drainage Basin Parallel Interceptor Improvements at various locations. The Agreement was subsequently revised by Amendment No. 1 (M&C C-27283) on May 5, 2016 in the amount of $94,095.35. Amendment No. 2 will provide for the design of three concrete junction structures and piping modifications, the design of a parallel pipe M-503 and an aerial crossing of Lake Arlington. RJN Group, Inc., proposes to perform the necessary additional work for a lump sum fee of $365,000.00. Staff considers this fee to be fair and reasonable for the scope of services proposed. In addition to the amendment amount, $125,000.00 is required for project management, real property acquisitions, utility coordination and material testing. M/WBE OFFICE: RJN Group, Inc., is in compliance with the City's M/WBE Ordinance by committing to an additional 26 percent M/WBE participation on this Amendment No. 2. The City's M/WBE goal on this Amendment is 13 percent. Engineering for the Village Creek Drainage Basin Parallel Interceptor Improvements project, is one component of the overall project that includes project management, easement, acquisition, utility coordination, material testing, inspection, construction and contingencies. The overall project budget is $15,833,139.00. This project is part of the Water Department's Sanitary Sewer Over Flow Initiative Program. Design is expected to continue in September 2016 and be completed by March 2017. Construction is anticipated to commence in August 2017 and be completed by December 2019.
