~. f: ~, ~~~ ORDINANCE NO O ~ t~ ~~~7 AN ORDINANCE AMENDING A PORTION OF SECTIONS 37-25 AND 37-26 OF CHAPTER 37 OF THE FORT WORTH CITY CODE (196'4) AS AMENDED BY REVISING CERTAIN RATES AND CHARGES MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH PROVIDING A SAVINGS CLAUSE PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That a portion of Section 37-25 of Chapter 37 of the Fort Worth City Code (1964), as amended pertaining only to the rates for monthly volume charge for water service, be and the same is hereby amended and after having been amended such rates shall be as follows 'Cubic Feet Rate First 2 000 or less cubic feet of water used per month per 100 cubic feet $0 62 For the next 48 000 cubic feet of water used per month per 100 cubic feet ~0~44 For the next 75 000 cubic feet of water used per month per 100 cubic feet 0 41 For the next 125 000 cubic feet of water used per month per 100 cubic feet 0 37 For all in excess of 250 000 cubic feet of water used per month, per 100'cubic feet 0 33 ~ SECTION 2 That a portion of Section 37-26 (a) of Chapter 37 of the Fort Worth City Code (1964) as amended pertaining only to minimum connection charges for SCHEDULE A - Water Service Only be and the same is hereby amended and after having been amended such minimum connection charges for "SCHEDULE A - Water Service Only shall be as follows Meter Size (Inches) T "SCHEDULE A Water Service Only Cubic Feet Allowed Monthly Minimum Charge 5/8 x 3/4 100 1 85 1 250 3 55 1-1/2 500 6 35 2 800 9 45 3 1 525 19 45 4 2 415 30 75 6 4 855 57 45 g 10 100 96 05 10 12 900 123 85 12 2T 075 169 35 SECTION 3 That this ordinance shall repeal every prior ordinance and provision of the Fort Worth only insofar as any portion of ; shall be in conflict and as to of tYie Fort Worth City Code not ordinances and provisions shall and this ordinance shall be and City Code such prior all other in direct remain in is hereby :SECT ION 4 in conflict herewith by ordinance or provision ordinances or provisions conflict herewith such full force and effect made cumulative That all rights or remedies of the City of Fort Worth Texas are expressly saved as to any and all violations of Chapter 37 or of any amendments thereto of the Fort Worth City Code (1964), as amended, which have accrued at the time of the effective date of this ordinance and as to such accrued violations the Court shall have all of the powers that existed prior to the effective date of this ordinance SECTION 5 It is hereby declared to be the intention of the City Council that the sections paragraphs sentences clauses and phrases of this ordinance are severable and if any phrases,, clause sentence paragraph or section of this ordinance shall be declared unconstitu- tional by the valid judgment or decree of any court of competent -2- :~. jurisdiction such unconstitutionality shall not affect any of the remaining phrases, clauses sentences paragraphs and sections of ry this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase clause sentence, paragraph or section SECTION 6 That this ordinance shall become effective and be in full t force and effect from and after its passage provided however, that the increased rates specified herein shall apply to customer utility statements sent by the City of Fort Worth on or after April 1 1981 and it is so ordained APPROVED AS TO FORM AND LE GALITY G City Attorney Adopted by the City Council ~ U -3- ~zt o Fort V~orth ~l'exa~ ?~ ,f J~ayor aaacl Coun.cal ~ona~-sa.unicc~taon DATE NUMBER CE SUBJECT Water Rate Increase Due to PAGE 2/10/81 G-4857 Increase Cost of Raw Water lof 2 City Secretary Contract No 10631 with the Tarrant County Water Control and Improvement District No 1 authorizes the District to adjust raw water charges based on the cost of providing Cedar Creek water to the City The City has been advised by letter from the District that the charge for raw water from Cedar Creek will advance from $0 1507 per 1000 gallons to $0 2260 per 1000 gallons effective March 1 1981 which is the beginning of the District's fiscal year for the Cedar Creek system The increase i.n price is caused by pumping larger volumes because of the drought and the increase in the cost of energy Additionally, the annual charge for West Fork water will advance from $343 188 to an estimated $550 000 annually Texas Water Rights Commission Rate Hearing The City of Arlington has protested the rates set by the District and a hearing was held by the Texas Water Rights Commission to establish an interim rate for Arlington The ruling is expected soon Once that rate has been established the City of Fort Worth TRA and Mansfield will receive invoices from the District to reflect any difference between the cost to be recovered and the $0 1507, per 1000 gallons the contracting parties have paid during the 12-month period'begnning March 1980 The contracting parties will be required to make any additional payment in proportion to the amount of Cedar Creek water purchased by each party Proposed Rate Adjustment The water rate adjustment ordinance adopted by the City Council on August 18 1980 (M&C G-4665) which became effective with the October 1 1980, billing did not provide for the increase in cost from. $0 1507 to $0 2260 per 1000 gallons for raw water from Cedar Creek or the additional $206 812 for West Fork water because these costs were. not known During the City's rate hearing the staff advised the City Council that a rate adjustment would be required should the District adjust its rate The blended raw water cost for Fort Worth customers was $0 0727 per 100 cubic feet and the blended cost under the new rates will be $0 0986 per 10.0. cubie feet The proposed new rate structure is shown below ,.. -~,.
