1� INTERLOCAL COOPERATION AGREEMENT
FOR DESIGN SERVICES OF
�n FUTURE THOMPSON ROAD AT NORTH RIVERSIDE DRIVE
WHEREAS, KELLER INDEPENDENT SCHOOL DISTRICT, a Texas
independent school district, ("District") and the City of Fort Worth, a Texas municipal
corporation ("City"), entered into City Secretary Contract No. 47490, an Interlocal
Cooperation Agreement for design services ("Agreement"), regarding roadway and street
improvements to future Thompson Road at North Riverside Drive in the City of Fort
Worth, Tarrant County, Texas, (the"Project"); and
WHEREAS, District and City (collectively, the "Parties") desire to amend the
Agreement in order to accomplish the construction goals of the Parties ("Amendment");
and
WHEREAS, the construction of future Thompson Road by the District requires a
connection not only to North Riverside Drive but also to the northbound frontage road of
Interstate Highway 35W ("Revised Project"), currently under construction by the Texas
Department of Transportation("TXDOT"); and
WHEREAS, District agrees to fund its portion of the costs for the intersection
improvements with future Thompson Road at both the IH-35 frontage and at North
Riverside Drive; and
WHEREAS, District has reviewed the scope, costs, and schedule for the
construction of the Revised Project and finds them to be fair and reasonable; and
WHEREAS, City has agreed to enter into an Advanced Funding Agreement with
TXDOT for construction of the deceleration and turn lane from the new IH-35W frontage
road onto future Thompson Road; and
WHEREAS, the intersection improvement at future Thompson Road at North
Riverside Drive include a connection to and portion of a roundabout ("NRD
Intersection"), estimated to cost $330,720 as further detailed on Attachment"A"; and
WHEREAS, the intersection improvement at future Thompson Road and IH-35W
frontage road include a deceleration lane turn lane from the northbound frontage road
and other improvements ("IH-35 Intersection"), estimated to cost $60,056 as further
p detailed on Attachment"B";
`� C9 NOW, THEREFORE, for and in consideration of the above recitals and the
rn � covenants and conditions contained herein, City and District do hereby agree as follows:

General
® A. The Revised Project will generally consist of improvements related to the

construction of Thompson Road where it intersects with North Riverside
Drive and where it intersects with the northbound frontage road of Interstate
35W as further described herein.
B. 1. District agrees to pay to City $330,720 for estimated construction costs
on a reimbursement basis for construction services performed for or to be
performed by City to construct the NRD Intersection. Final costs will be
determined by actual constructed quantities. District will supply additional
funding should the final amount exceed the estimated costs.
2. District agrees to pay to City $60,056 for estimated construction costs on
an upfront basis for construction services perfonned for or to be performed
by City to construct the IH-35 Intersection. Final costs will be detennined by
actual constructed quantities. District will supply additional funding should
the final amount exceed the estimated costs.
C. City will publicly seek bidders to construct improvements to North Riverside
Drive, including the NRD Intersection.
D. City and TXDOT will enter into an Advance Funding Agreement for the
construction of the IH-35 Intersection.
E. All payments, if any, required to be made by City or District shall be payable
from such party's current revenues or other funds lawfully available for such
purpose.
F. The Parties agree that City and District have not waived their respective
sovereign or governmental immunity by entering into and performing their
respective obligations under this Amendment.
G. All other terns and conditions, general or specific, not amended hereby
remain unaffected and in force.

HEARING:
SUBJECT: Authorize Execution of Amendment No. 1 to City Secretary Contract No. 47490, an
Interlocal Cooperation Agreement, with Keller Independent School District in the Amount
of$390,776.00 for the Construction of the Thompson Road Intersection with North
Riverside Drive and a Deceleration Lane from the Northbound Frontage Road of
Interstate Highway 35W for Future Thompson Road, Thereby Increasing Keller
Independent School District's Total Contribution to $405,776.00, Adopt Resolution
Authorizing Execution of an Advanced Funding Agreement with the Texas Department of
Transportation in an Amount Up to $70,000.00 to Construct a Frontage Road Right-Turn
Deceleration Lane to the Future Thompson Road and Adopt Appropriation Ordinance
(COUNCIL DISTRICT 4)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in
the North Riverside Drive Project— North Tarrant Parkway to Old Denton Road of the Developer
Contribution Fund in the amount of$405,776.00;
2. Authorize the execution of Amendment No.1 to City Secretary Contract No. 47490, an Interlocal
Cooperation Agreement, with Keller Independent School District in the amount of$390,776.00 for the
construction of the future Thompson Road intersection at North Riverside Drive and the Northbound
Interstate Highway 35W Frontage Road right-turn deceleration lane to the future Thompson Road,
thereby increasing Keller Independent School District's total contribution to $405,776.00;
3. Adopt the attached resolution authorizing execution of an Advanced Funding Agreement with the
Texas Department of Transportation in an amount up to $70,000.00 to construct a Northbound
Interstate Highway 35W frontage road right-turn deceleration lane to the future Thompson Road; and
4. Authorize a payment to the Texas Department of Transportation in an amount up to $70,000.00.
DISCUSSION:
The 2014 Bond Program includes funding for roadway capacity improvements along North Riverside
Drive from North Tarrant Parkway to Old Denton Road. This project includes widening the roadway
from two lanes to four lanes, left and right turn lanes, roundabouts at Summerfields Boulevard and
Thompson Road, storm drainage improvements, shared use paths, streetlights and traffic signal
modifications at North Tarrant Parkway.
On February 9, 2016, the City administratively authorized an Interlocal Cooperation Agreement with
Keller Independent School District (KISD) for the design of proposed Thompson Road at North
Riverside Drive in the amount of$15,000.00. Under this amendment, KISD will provide an additional
$390,776.00 for the construction of the intersection of Thompson Road with North Riverside Drive by
the City and the Northbound Interstate Highway 35W Frontage Road deceleration lane to Thompson

Road by the Texas Department of Transportation.
The Advanced Funding Agreement with the Texas Department of Transportation (TxDOT) will
provide for the State to construct the deceleration lane on the northbound frontage road of Interstate
Highway 35W at Thompson Road.
Construction of the Thompson Road intersection at North Riverside Drive has components of the
overall project that include design, construction, project management, easements and right-of-way
acquisition, construction administration, material testing, inspection and contingencies. The City
project budget for the full improvements described above is $13,365,776.00. Additionally,
construction of the northbound frontage road of Interstate Highway 35W is a component of a KISD
development project involving a Community Facilities Agreement with the City of Fort Worth.
A portion of this project will include 2014 Bond Funds. Available resources within the General Fund
will be used to provide interim financing for these expenses until debt is issued. Once debt associated
with this project is sold, bond proceeds will reimburse the General Fund, in accordance with the
statement expressing official Intent to Reimburse, that was adopted as part of the ordinance
canvassing the bond election (Ordinance No. 21241--05-2014) and the subsequent ordinance
authorizing debt in 2016 (Ordinance No. 22216-05-2016).
Construction of North Riverside Drive is anticipated to begin in Spring 2017 and end in Spring 2019.
The Project is located in COUNCIL DISTRICT 4, Mapsco 35G.
This contract will be with a governmental entity, state agency or public institution of higher education:
Keller Independent School District and the Texas Department of Transportation.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of
the attached appropriation ordinance, funds will be available in the 2014 Bond Program and the
Developer Contribution Fund.

WHEREAS, the Keller Independent School District will provide up to $70,000 to the City of
Fort Worth for the construction of a Northbound Interstate Highway 35W frontage road right-turn
deceleration lane to the future Thompson Road; and
WHEREAS, the City of Fort Worth intends to enter into an Advance Funding Agreement with
the Texas Department of Transportation in the amount of$77,966, with City participation in the amount

The City Manager is hereby authorized to execute an Advance Funding Agreement with the
Texas Department of Transportation in the amount of$77,966, with City participation in the amount up
to $70,000, plus any cost overruns, for construction of a Northbound Interstate Highway 35W frontage
road right-turn deceleration lane to the future Thompson Road.

CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
amount of $405,776.00, in the Developer Contribution Fund, for the purpose of constructing the future
Thompson road intersection at the North Riverside drive and a deceleration lane from the northbound
frontage road of Interstate highway 35W.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 22394-09-2016 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.
