HomeMy WebLinkAboutOrdinance 8269.l a }'''cam'` `. ~ ~" r ORDINANCE NO ~~ AN ORDINANCE AMENDING CHAPTER 2 ADMINISTRATION OF THE FORT WORTH CITY CODE (1964) AS AMENDED BY AMENDING SECTION 2-9 BY PROVIDING FOR CERTAIN CHARGES FOR COPYING MATERALS MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES REPEALING ALL CONFLICTING ORDINANCES PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED OR ENACTED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That Section 2-9 0£ the Code of the City of Fort Worth (1964) as amended be and the same is hereby amended to read as follows Sec 2-9 Fees for Copying Materials When the City Secretary shall make any copy of any of the records of papers in his office he may charge the person for whom such copy is made the sum of fifty-five cents ($0 55) for the first page copied and fifteen cents ($0 15) for each additional page copied In addition the following fees may be charged for the typing of any papers Type/Size Fee 82 x 11 $2 00 per sheet 11 x 14 $2 50 per sheet Transcripts $5 00 per sheet If any of the above papers are to be mailed by the City Secretary a one dollar ($1 00) handl- ing fee and a fee for postage will be charged No charge shall be required of any City official for copies to be used by him in connec- tion with his duties as such official SECTION 2 That this ordinance shall be cumulative of all provisions of the Code of the City of Fort Worth (1964) as amended and all other ordinances of the City of Fort Worth except in those instances where the provisions of this ordinance are in direct conflict with the provisions of such Code or other ordinances in which instances said conflicting provisions of such Code or other ordinances are hereby repealed SECTION 3 It is hereby declared to be the intention of the City ;v .~, .. . Council that the sections paragraphs sentences clauses and phrases of this ordinance are severable and if any phrase clause sentence paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction such unconstitutionality shall not affect any of the remaining phrases clauses sentences paragraphs and sections of this ordinance since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase clause sentence paragraph or section SECTION 4 That this ordinance shall become effective and be in full force and effect from and after the date of its passage and publication as required by law and it is so ordained APPROVED AS TO FORM AND LEGALITY ~Z~~i ~ ~G'~y~/ City Attorney ADOPTED EFFECTIVE -2- a ~i~ ® J~®rt ~U®r~~ texas ~ _ ~ .f' HERCHERT DATE RES'ERENCE SUBJECT PAGE NUMBER WALKER Proposed Fees For Copying Materials 2 2/~7f31 *~0-4864 ~ of. . ~/ Bac'leground i le 14 07CN) of the Texas Election Code. states that no charge greater than that authorized by the State Board of Control can be charged for copies of State election financial records The State Board of Control s maximum fees that can be charged for photographic reproduction of election records are $0 55 per request (includes 1st page) plus $0 15 per page thereafter Section 2-9 of The Code of the City of Fort Worth Texas (1964) as amended authorized the City Secretary to charge the sum of $0 25 for one hundred words per copy provided to citizens and to charge the sum of $0 50 for certification and seal of the City Secretary Subsequently two regulations were issued regarding the charge of fees for City services in general Management Information Letter 56 dated December 21 1976 and Administrative Regulation No 3-11 dated December 21 1976 In compliance with these two regulations a cost study was perfox•med and- the results prompted a proposal by the City Secretary s office to change the method of fee calculation from $0 25 per hundred words for reproduction copies to $0 25 per page Later the proposal was verbally approved by a former City Manager A recent cost study and review of the above policies was conducted by the Office of the City Secretary and showed that the City Secretary s charge of $0 25 per page for the reproduction of election recox•ds has been in violation of Article 14 07(N) Also it was found that the calculation method for fee charges as specified in Section 2-9 of The Code of the City of. Fort Worth ($0 25 per one hundred words) has not been utilized or updated by the City Secretaryes Office in the past fifteen years In an effort to eliminate the discrepancies regarding the assessment of fee charges for reproduction copies the Office of. the City Secretary is proposing a uniform fee for the reproduction of both City and state election records .Since the Office of the city Secretary is bound by the State Board of Control s fees when reproducing election financial records they have proposed to adopt the fee allowed by the State Board of Control as the fee schedule for the Office of the City Secretary Specifically the City Secretary s Office is recommending that an ordinance be adopted amending Section 2-9. of Chapter 2 of The Code -of the City of Fort Worth Texas (1964) (see attachment) providing for copying materials T'he recommended fees for all reproduction as set by the State Board of Control and hereby proposed by the City Secretary s Office are $0 55 per• request (including 1st page) plus $0 15 per page thereafter ApPROV~.D B~ CITY CC~~ICI FEB 1`7 1981 Ci ecxetary of .the C oY Fort Woxth, Texa6 {~+ "± ~~• DATE REFERENCE SUBJECT PAGE NUMBER 2J17~81 **G-4864 Proposed Fees For Copying Materials ~or~_ In a fee comparison study of the current fee and the proposed fees it was found that the City can anticipate a $0 10 to $0 20 average increase per request by charging the proposed fees These projected increases are based upon the average number of copies made per request by citizens which is 2-3 pages. In addition to the proposed copying fee charge the Office of the City Secretary would like to incorporate the following typing charges into Section 2-9: of Chapter 2 of The Code of the.
