AN ORDINANCE VACATING ABANDONING CLOSING
AND EXTINGUISHING A 78 FOOT WIDE DRAINAGE AND
UTILITY EASEMENT WHICH EXTENDS FROM THE WEST
PROPERTY LINE OF MARK IV BUSINESS PARK PHASE
'A TO THE EAST PROPERTY LINE OF MARK IV
BUSINESS PARK PHASE A AND THE 5 FOOT WIDE
UTILITY EASEMENT ADJACENT TO THE 78 FOOT DRAINAGE
AND UTILITY EASEMENT SAID UTILITY EASEMENT EXTENDING
FROM THE WEST PROPERTY LINE OF MARK IV BUSINESS
PARK PHASE A TO THE EAST PROPERTY LINE OF MARK
IV BUSINESS PARK PHASE A'' PROVIDING FOR REVERSION
OF FEE IN SAID LAND' REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS
SECTION 1
That the 78 foot wide drainage and utility easement which
extends from the west property line of Mark IV Business Park Phase
'A' and the 5 foot wide utility easement adjacent to the 78 foot
drainage and utility easement said easement extending from the
west property line of Mark IV Business Park Phase "A' to the east
property line of Mark IV Business Park Phase "A' be and the same
are vacated abandoned permanently closed and extinguished as
easements for drainage and utility purposes
SECTION 2
That the fee to the lands in the above described vacated
drainage and utility easements is hereby released and shall revert
to the adjacent owner as provided by law
SECTION 3
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed
SECTION 4
That this ordinance shall take effect and be in full force
and effect from and after the date of its passage and it is so
ordained

Carteer`& Burgess Inc on behalf of Trans = Canada 820 Joint Venture owner of
all. abutting property has.requested that the City vacate a 5' wide utility
easement and a 78' wide drainage.and'utility easement in Mark IV Business Park,
Phase A as. recorded in.Vol.ume 388/137 page 40 -41 P R T C T and shown
on the attached map
The subject easements acquired by dedication contain utility facilities
(wat.er and sewer lines in the 78' wide drainage and utility easement) and
are in use
Approval of the subject easement..vacations as described above will permit
more appropriate development of the - abutting property after the vacated .
easements have been replotted with such abutting property
Reviewing City departments and private utility .companies have raised no
objections to this request provided the-vacated easements are replatted with
adjoining property and the required..replat dedicates utility easements for the
existing utility facilities located within the vacated easements A satis-
factory replat has been submitted
Recommendation
It is recommended that an ordinance be adopted vacating the subject easements
in Mar=k IV Business Park, Phase "A "
