HomeMy WebLinkAboutOrdinance 8372:~ ORDINANCE NO -~,~--~ AN ORDINANCE AMENDING ORDINANCE NO 8331 _ , BY AMENDING PARAGRAPH III THEREOF, PERTAINING TO THE AMOUNT OF CERTAIN ASSESSMENTS, PROVIDING THAT ALL OTHER PROVISIONS OF SAID ORDINANCE NO 8331 SHALL REMAIN IN FULL FORCE AND EFFECT, AND PROUIDING AN EFFECTIVE DATE WHEREAS, the City of Fort Worth Texas has heretofore ordered that each of the hereinafter-described parti4n of streets, avenues and public places in-the City of Fort Worth, Texas, be im- proved by raising, grading, or filling same and by constructing thereon to-wit1: OAKHILL STREET From Miller Avenue to 380' east of Nell Street, known and designated as Project No 029-36586-00, Unit I, a seven-inch thick hot-mix asphaltic concrete pavement on a sib-inch thick lime stabilized subgrade with seven- inch high concrete curb and eighteen- inch wide concrete gutter on a thirty- six foot roadway Six-inch thick con- crete driveways will be constructed where specified; and WIiEREA;, the City Council has directed that the property to be assessed as a part of the above-referenced projects be appraised by an independent appraiser, and WHEREAS, it appearing that the assessments levied against such,rproperty by Ordinance No 8331 ,previously adopted by the City Council, should be lowered pursuant to such appraisals, NOW, THEREFORE BE iT ORQAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT Paragraph III of Ordinance No 8331 previously adopted by the City Council on April 28, 1981, be amended and as so amended shall hereafter read "There shall be and is hereby, levied and assessed against the parcels of property herein below men- tioned,. and against the real and true owners there- of (whether such owners be~correctly named herein or not) the sums of money itemized below opposite the description of the respective parcels of pro- perty and the several amounts assessed against the same, and the owners thereof, as far as such owners are known, being as follows" II All other provisions of Ordinance No 8331 shall remain in full force and effect III The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas; and by filing the complete Ordinance in the appropriate Ordinance Records of said City IV This ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained b~ PASSED AND APPROVED this ~ day of 1981 ~. G-5037 Street, Unit I I i °f -2- On April 28 1981 (M&C G-4977) the City Council conducted the benefit hearing for the assessment paving of Oakhill Street Unit I from Miller Avenue to 380' east of Nell Street, Project Nos 021-036-586-00 and 029-036-586-00 Four of the eleven adjacent property owners appeared before the City Council and indicate that the proposed assessments would not enhance their property in an equal amount and that the street was being improved for the benefit of The Village Addition development The Village Addition development is a 'Unified Residential' complex consisting of cluster duplexes The City Council after considering the staff report and the property owners comments closed the benefit hearing and levied the assessments as proposed in accordance with standard City policy by adopting Ordinance No 8331 In addit the staff was directed to obtain an independent land appraisal on one of the adjacent lots to determine if the street improvements will in fact enhance the land (lot) by as much or more than the proposed assessments and report the findings of the appraisal for probable adjustments to the assessments levied in Ordinance No 8331 The staff retained the firm of Daniels Highfield and Associates to appraise Lot 1 Block 17 J T Couch Addition 5301 Flamingo Road an average lot adjacent to the project to determine the enhancement to the land (only) as a result of the street improvements The appraiser has submitted his report indicating that the lot would enhance in value by $1 000 plus the cost of the driveway approach of $282 15 The appraiser's estimated enhancement~is $550 less than the proposed assessment based on standard City policy The staff agrees with the appraiser's report and a revised assessment roll has been prepared indicating the assessment in accordance with standard policy and the proposed revised (reduced) assessment based on the appraiser's report All of the adjacent property owners were notified by certified mail on June 19 1981 that the City Council will consider the possible reduction of assessments on Oakhill Street Unit I on July 7 1981 Recommendations It is recommended that 1 The City Council adopt an ordinance revising Ordinance No 8331, reducing the assessments based on the appraiser's report 2 Authorize the City Manager to pay Daniels Highfield and Associates $500 for the appraisal indicated above and T .=-~.
