CORRECTION TO OIL, GAS, AND MINERAL LEASE Reference is hereby made to that certain Oil, Gas and Mineral Lease (hereinafter referred to as "Subject Lease") dated the 27th day of May, 2010, by and between City of Fort Worth, as Lessor, and Dale Property Services, L.L.C., as Lessee, whose address is 2100 Ross Avenue, Suite 1870, LB-9, Dallas, TX 75201, which lease is recorded in Document No. D210153289 of the Public Records of Tarrant County, Texas. WHEREAS, the Leased Premises described in the "Exhibit A" of the Oil, Gas and Mineral Lease reads as follows: 1.9143 acres of land, more or less, being Lot 1R, Block 22, M.G. Ellis Addition, City of Fort Worth, Tarrant County, Texas, and being the same land conveyed by H.L. Davis to The City of Fort Worth in Deed dated February 12, 1985 and recorded in Volume 8137, Page 1540, deed Records, Tarrant County, Texas.; Whereas it is the desire of said Lessor and Lessee to amend the description of the Subject Lease. NOW THEREFORE, the undersigned do hereby delete the description in the "Exhibit A" of said lease as described above and in its place insert the following: 3.26 acres of land, more or less, now known as Block 22 Lot JR, M.G. Ellis Addition, City of Fort Worth, Tarrant County, Texas. 0.93 acres, Lots 3 and 4 and the west 50 feet of lots 1 and 2, Block 22, M.G. Ellis Addition to the City of Fort Worth, Tarrant County, Texas, and being the same land conveyed by H.L Davis to the City of Fort Worth in Deed dated February 12, 1985 and recorded in Volume 8137, Page 1540, Deed Records, Tarrant County, Texas. 1.4 acres, Lots 5, 6, 7, 17, 18, 19, and 20, Block 22, M.G. Ellis Addition to the City of Fort Worth, Tarrant County, Texas, and being the same land conveyed by R. F. Buck Thomason to the City of Fort Worth in deed dated February 29, 1985 and recorded in Volume 6897, Page 2130, Deed Records, Tarrant County, Texas. 0.397 acres, Being Lots 21 and 22, Block 22, M.G. Ellis Addition to the City of Fort Worth, Tarrant County, Texas, and being the same land conveyed by K. C. Price and wife, Carol Jean Price to the City of Fort Worth in Deed dated March 3, 1980 and recorded in Volume 6900, Page 1297, Deed Records, Tarrant County, Texas. 0.003 acres, Tract or Parcel of land of Lot 22, Block 22, M. G. Ellis Addition to the City of Fort Worth, Tarrant County, Texas, and being the same land conveyed by Enserch Corporation to the City of Fort Worth in Deed dated December 9, 1980 and recorded in Volume 7095, Page 1775, Deed Records, Tarrant County, Texas. 0.53 acres, an undivided two-thirds interest in and to Lots 23 and 24, Block 22, M.G. Ellis Addition to the City of Fort Worth, Tarrant County, Texas, and being the same land conveyed by Ona Faye Abercrombie Herndon and husband, J. B. Herndon to the City of Fort Worth in Deed dated April 2, 1980 and recorded in Volume 6920, Page 280, Deed Records, Tarrant County, Texas. 0.53 acres, an undivided one-third interest in and to Lots 23 and 24, Block 22, M.G. Ellis Addition to the City of Fort Worth, Tarrant County, Texas, and being the same land conveyed by Mabel Pickett to the City of Fort Worth in Deed dated AD R o 1 N April 2, 1980 and recorded in Volume 6920, Page 280, Deed Records, Tarrant County, Texas. Furthermore the undersigned do hereby ratify, adopt and confirm said Lease as hereby amended, as a valid and subsisting Lease and the undersigned Lessor does hereby grant, demise, lease and let unto Lessee, the present owner of the Subject Lease, the premises described above, subject to and in accordance with all of the terms and provisions of the Subject Lease as hereby amended. This agreement shall be binding upon and inure to the benefit of the parties hereto, their respective heirs, legal representatives, successors and assigns.
