ORDINANCE NO ~/ AN ORDINANCE APPROPRIATING ADDITIONAL REVENUE OF THE CITY OF FORT WORTH IN THE AMOUNT OF $100 000 FROM THE WATER AND SEWER UNAPPROPRIATED RETAINED EARNINGS TO THE "GENERAL FUND WATER AND SEWER ACCOUNT NO 60-90-00 $50 000 OF SUCH AMOUNT TO BE AVAILABLE TO PAY VINSON AND ELKINS FOR WORK TO BE PERFORMED REGARDING THE ARLINGTON RATE CASE BEFORE THE TEXAS WATER COMMIS- SION AND $50 000 OF SUCH AMOUNT TO BE AVAILABLE TO PAY VINSON AND ELKINS FOR ADDITIONAL LEGAL ASSISTANCE AND "GUIDANCE WITH RESPECT TO OPERATION AND FUTURE EXPANSION OF THE CITY S SANITARY SEWAGE SYSTEM PROVIDING FOR A SEVERABILIT Y CLAUSE MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES REPEALING ALL ORDINANCES IN CON- FLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That the City Manager of the City of Fort Worth is hereby authorized to appropriate $100 000 from the Water and Sewer Unap- propriated Retained Earnings and transfer it to the "General Fund Water and Sewer Account No 60-90-00 $50 000 of such amount to be available to pay Vinson and Elkins for work to be performed regarding the Arlington Rate Case before the Texas Water Com- mission and $50 000 of such amount to be available to pay Vinson and Elkins for additional legal assistance and guidance with respect to operation and future expansion of the City s sanitary sewage system SECTION 2 Should any portion section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction such decision opinion or judgment shall in no way impair the remaining portions sections or parts of sections of this ordinance which said remaining provisions shall be and remain in full force and effect SECTION 3 That this ordinance shall be cumulative of Ordinance No 8157 and all other ordinances and appropriations amending the same except in those instances where the provisions of this 3 E a ~' i"~ ordinance are in direct conflict with such other ordinances and appropriations in which instances said conflicting provisions are hereby expressly repealed SECTION 4 That this Ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained APPROVED AS TO FORM AND LEGALIT Y Acting City Attorney ADOPTED ~ /~~~/ EFF ECT I V E~d~d~ ;~ ~Cit~ of .Fort worth, texas ~,~- • u .11~cayor and Coa.~nc~l ~ornr~,ua~,~,ccct~o~.
