AN ORDINANCE INCREASING APPROPRIATIONS IN THE ENVIRONMENTAL
MANAGEMENT FUND (R103) IN THE AMOUNT OF $26,312.00 AND
DECREASING THE UNRESERVED RETAINED EARNINGS BY THE SAME
AMOUNT, FOR THE PURPOSE TRANSFERRING SAID FUNDS TO THE
ENVIRONMENTAL PROJECT FUND (R101) FOR THE VILLA DEL RIO/OAK
HOLLOW APARTMENTS ABATEMENT AND DEMOLITION PROJECT;
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2007-
2008 in the Budget of the City Manager, there shall also be increased appropriations in the
Environmental Management Fund (R103) in the amount of $26,312.00 and decreasing the
unreserved retained earnings by the same amount, for the purpose transferring said funds to the
Environmental Project Fund (R101) for the Villa Del Rio/Oak Hollow Apartments Abatement and
Demolition Project.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize Execution of Amendment No. 1 to City Secretary Contract No. 36478 with Intercon
Environmental, Inc., for Asbestos Abatement and Demolition at the Villa Del Rio and Oak Hollow
Apartment Complexes in the Amount of $26,312, thereby Increasing the Contract Amount to
$1,518,471.79; Approve Transfer of Funds and Adopt Appropriation Ordinances
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the City Manager to execute Amendment No. 1 to City Secretary Contract No. 36478 with
Intercon Environmental, Inc., for asbestos abatement and demolition at the Villa Del Rio and Oak Hallow
Apartment Complexes, in the amount,. of $26,312.00, thereby increasing the contract amount to
$1,518,471.79;
2. Adopt the attached supplemental appropriation ordinance increasing estimated receipts and
appropriations in the Environmental Management Fund (R103) by $26,312.00 and decreasing the
unreserved retained earnings by the same amount;
3. Approve the transfer of $26,312.00 from undesignated funds in the Environmental Management Fund
(R103) to the Villa Del Rio/Oak Hollow Apartments Abatement and Demolition Project in the Environmental
Project Fund (R101); and
4. Adopt the appropriation ordinance increasing estimated receipts and appropriations in the Environmental
Management Project Fund (R101) by $26,312.00.
DISCUSSION:
On June 5, 2007, the City Council authorized the Execution of Agreements for the Purchase of the Villa Del
Rio and Oak Hollow Apartment Complexes located at 5817 Boca Raton and 5901 Boca Raton, Fort Worth,
Texas, and $750,000.00 for the fencing and demolition (M&C Reference No. L-14332; Ordinance No.
17588-06-2007).
On December 4, 2007, (M&C C-22560) the City Council authorized the City Manager to execute a contract
with Intercon Environmental, Inc., for $1,492,159.79. The contract was for the removal and disposal of
asbestos containing materials and demolition of the Villa Del Rio and Oak Hollow Apartments located at
5817 and 5901 Boca Raton Boulevard, respectively.
Amendment No. 1 to City Secretary Contract No. 36478 with Intercon Environmental, Inc., in the amount of
$26,312.00, provides for the removal and disposal of concrete slab and debris associated with the Oak
Hollow office building; removal and disposal asbestos containing outdoor surfacing and pest and rodent
control throughout both apartment complexes.

Staff considers the proposed fee of $26,312.00 to be fair and reasonable for the additional services to be
provided by Intercon Environmental, Inc. The completion date of this project is May 2008.
The Villa Del Rio and Oak Hollow Apartments are located in COUNCIL DISTRICT 4.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached supplemental appropriation ordinance, funds will be available in the current operating budget as
appropriated of the Environmental Management Project Fund. Upon approval the projected unreserved,
undesignated fund balance of the Environmental Management Fund will be $4,405,298.34.
