HomeMy WebLinkAboutOrdinance 8288~~"` ORDINANCE NO ~~ ~~ AN ORDINANCE AMENDING CHAPTER 26 MOTOR VEHICLES AND TRAFFIC OF THE CODE OF THE CITY OF FORT WORTH (1964) AS AMENDED BY ADllING SECTION 26-131 PROHIBITING HEAD-IN PARKING BY ADDING SECTION 26-132 REGARDING THE PERMITTING OF CURB CUTS AND BY ADDING SECTION 26-133 REGARDING LOADING AND UNLOADING FACILITIES PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE PROVIDING A 5EVERABILITY CLAUSE PROVIDING A PENALTY PROVIDING FOR PUBLICATION AND PROVIDING FOR AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That Chapter 26 of the Code of the City of Fort Worth Texas (1964) as amended Motor Vehicles and Traffic be hereby amended by adding new Sections 26-131 26-132 and 26-133 and such sections shall hereafter read as follows Sec 26-131 Head-In Parking Prohibited All new head-in parking which requires a parked vehicle to use the public right-of-way for maneuvering in and out of a parking space is prohibited Existing head-in parking shall be removed except on minor streets as permitted by this section and stand-up curb shall be constructed at such time that the property ad- ` ~: i jacent to the laid-down curb changes usage the build- ing on the adjacent property is substantially remodeled "`~ or when the street is reconstructed A minor street is defined as one that is not more than 3 000 feet long has a speed not exceeding 30 m p h carries no more than 1 200 vehicles per day and its traffic load is not expected to increase Head-in parking may remain on a minor street if the following conditions are met 1 The City Traffic Engineer determines that such parking will not create a traffic or pedestrian hazard 2 A recessed parking area is constructed in such a manner that no part of a vehicle (approximately 18 feet long) parked perpendicular to the street eX- tends into the street as defined by the curb line 3 A paved pedestrian walkway not less than 6 feet wide shall be constructed parallel to the curb line across the front of the parking area The 6-foot walkway shall be connected on both ends to the normal walk line with a paved walk not less than 4 feet wide constructed perpendicular to the curb line If the parking area and 6-foot walkway extend beyond the normal property line, the adja- cent property owner requesting the parking shall ~~ provide a dedicated easement for public use In the event that the existing head-in parking is located in such a manner that a parked vehicle clears the normal property line (approximately 10 feet behind the curb) the requirement of the walkway in front of the parking area will be elim- inated 4 The construction of laid-down curb pedestrian walks and paved head-in parking area shall be in accordance with standard City of Fort Worth speci- fications for driveways and sidewalks The decision of the City Traffic Engineer may be appealed to the City Council Sec 26-132 Curb Cuts and Laid Down Curb Permit Procedures The location of ingress and egress driveways shall be subject to approval of the City Traffic Engineer under curb cut or laid down curb permit pro- cedures Driveways shall not exceed 65°s of the property frontage There shall be a minimum of twenty (20) feet of curb along the street between driveways where there is more than one driveway on property under unified ownership or control and used as one premise The deci- sion of the City Traffic Engineer may be appealed to the City Council Sec 26-133 Loading and Unloading Facilities When off-street loading dock facilities are re- quired the minimum width of the dock shall be 10 feet and the minimum depth shall be 60 feet The loading dock facilities shall be constructed in such a manner that any vehicle anticipated to use the dock will clear the public right-of-way when properly parked at the dock Under unusual circumstances the 60-foot minimum distance may be reduced by the approval of the City Traffic Engineer The decision of the City Traffic Engineer may be appealed to the City Council SECTION 3 It is hereby declared to be the the intention of the City Council that the sections paragraphs sentences clauses and phrases of this ordinance are severable and if any phrase clause sentence paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any Court of competent jurisdiction such unconstitutionality shall not affect any of the remaining phrases clauses sentences :~ s ~, paragraphs and sections of this ordinance since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase clause sentence paragraph or section SECTION 4 That any person who violates disobeys omits neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Hundred and No/100 Dollars ($200 00) for each offense SECTION 5 The City Secretary of the City of Fort Worth Texas is hereby directed to publish the caption and penalty clause and effective date of this ordinance for five (5) days in the offi- cial newspaper of the City of Fort Worth Texas as authorized by the TEX REV CIV STATS Art 1176b-1 SECTION 6 This ordinance shall be in full force and effect from and after the date of passage and publication as above transmitted Informal Report No 3565, to the City Councilo This report included a copy of a proposed amendment to the Zoning Ordinance, and a copy of an amendment to Chapter 26 of the City of Fort Worth ~.~a °Motor Vehicles and Traffic ~~"'4;~au3~lic hearing on the proposed changes to the Zoning Ordinance was held in conjunction with the regular Zoning Coimnission monthly meeting on February 11, 1981, and the proposed Zoning Ordinance changes are being submitted concurrently with this item.
