An ordinance creating the office of and providing for the appcL_} ment of a milk inspector of the City of Fort Worth, in corf ormity with Section 42 of Chapter 39 of the Acts of the Thirtieth Legislature .of the State of Texas, and conferring upon him the p Owers and imposing upon him the duties prescribed in said act, said act being entitled. "The Pure Food Law. " BE IT ORDAINED BY THE BOARD OF COMMISSIONERS SSIONERS OF THE CiTY OF FORT WORTH: - Section 1. That pursuant to Section 42 of Chapter 39 of the Acts of the Thirtieth Legislature of the State of Texas, the office of Milk Inspector of said City is hereby created. Said officer shall be selected by the Board of CommisA oners ofthe City of Fort 77orth,and he shall be an adult vale person above the age of twenty-one years and a resident of'T p� ; nd his compensation shall be determined t. by resolution of the Board of Commissioners . Section 2. Said Inspector, befcr e exercising the duties of said office, shall 'execute a bond in the sure of Five Hundred Dollars parable to the City of Fort North with two or more persons as sure- ties thereon or with some surety company thereon authorized to do business in the State of Texas,conditioned that said Inspector. will faithfully perform and discharge all of the duties of said office . Said bond shall be subject to the approval of the Bca rd of Commissioners, and said Inspector shall also make oath before some person authorized to administer oaths, that he faithfully observe the laws of the State of Texas and the charter and ordinances of the Citi* of Fort worth in relation to the duties he is called upon to perform. Section 3 . Said inspector s:ta ll hold office for and during the term of two years from and after the date of his appointment; provided, however, the power is expressly, retained by the Board of Commissioners to abolish said office or terminate ',"'ie period of employment of said inspector at any time the said Board may ;gee fit. Section 4. It shall be th.- duty of the said Inspector to in- quire carefully into the qualit-,- of the dai"ry,food,and drink products and the several articles which are food or the necessary constituents of food or drink,which are sold or exposed or offered for sale or manufactured within said city,and to that end it shall be la7iful for hien to take and procure amra1 o t� ame d make due and careful exami_�at i on thereof an s�`a ani a�fal Ay—_ c food and drink products ,and all dkrtigs as well,sold or offered or exposed for sale or manufactt?red within the said City of Fort Torth,to discover if the same are adulterated, impure or unwholesomei n contravention of the laws of the State of Texas,and in the event a violation of the law is discovered it shall be the duty of said inspector to make due report thereof to the Board of Commissioners of the City of Fort Torth and to institute complaint concerning said violation to the proper authorities ,and to furnish and supply to the same the evidence concerning said violation and to assist said authorities in obtaining a conviction of the person or persons,firm or corporation guilt-,= of the offense . Section 5. It shall be the further dut.77- of the said inspector, or any deputy, or any police officer of the City of Fort Torth, to make cDmplaint to the proper authorities and cause proceedings 'to be com- menced against any person,assoeiation of persons,firm or corporation, of the violation of the laws of the State of Texas relative to adulter- ated,xa misbranded or impure or unwholesome food or drink or drugs, and in such case he or they shall not be obliged to furnish secu rite- for costs . He or the-T7. shall have power, in the performance of his or their duties, to ent. r into any creamery,fac tory, store,salesroom,drug- store, laboratory, butcher-shop,hotal,boarding-house,or restaurant, or other place where there is reason to believe that food or drink is made,prepared,sald or offered for sale or exchange,and to open any cask, tub,jar,bottle or package containing or supposed to contain any article of food or drink or any artidle or drug and examine or cause to be examined the contents thereof,and take therefrom samples for analysiG . Should said sample be found to be of any character of adul- terated or misbranded food,drink or drug, it shall be return to and retained by the prober magistrate for the purposescontemplated in said act of the Legislature;but if any sample be found not adulterated or misbranded, it shall be returned to the owner, or the value of the same shah_ be paid b:7 said inspector as a part of the expenses of his office , to the person or persons ,firm or corporation from whom it was taken: Section 6. The inspector, or his deputy,wheii to ing a sampl_, shall. take same in the presence of at .least -one witness,and he shall, in the presence of such witness, mark or seal such sample and shall ten- der,at the time of taking same, to the owner thereof or hil s agent or to the p rscn having custody of the same,the value thereof and a state- ment in writing of the reason for taking such sample. Section 7. Said inspector and his deputy or deputies, if any, shall do and perform such other duties and service as may be directed frora time to time by the said Board of Commissioners .or by rules and reg�t on r �a1g ted by said Board t � e tion 8. Ail ordinances and parts of ordinances in conflict herewith be and the same are hereby repealed,and this ordinance shall,' take effect and be in force from and after its passage .
