HomeMy WebLinkAboutOrdinance 5455 ORDINANCE NO. ✓y�j,/' AN ORDINANCE CLOSING AND VACATING THE TEN FOOT UTILITY EASEMENT IN BLOCK 112, WEDGWOOD ADDITION TO THE CITY OF FORT WORTH,, TARRANT COUNTY$ TEXAS; AND PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,, TEXAS : SECTION 1. That the ten foot utility easement located along the rear lines of Lots 1 through 6, Block 112, Wedgwood Addition to the City of Fort Worth, Tarrant County, Texas, and extend- ing from Washer Avenue southwest to the Texas Electric Service Company right of way, be and the same is hereby extinguished, vacated, closed and permanently abandoned as an easement for public utilities, save and except that a temporary easement is retained by Texas Electric Service Company for an existing distribution line until said line is removed. SECTION 2 . That the interest of the City of Fort Worth in the fee to the land in said easement above described is hereby released and shall revert to the adjacent owner of the fee as provided. by law. SECTION 3 . That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. APPROVED AS TO FORM AND LEGALITY: City Attorney City of Fort Worth, Texas Mayr and Council Communication DATE REFERENCE SUBJECT: Utility Easement Abandonment PAGE NUMBER in Block 112, Wedgwood Addition 10/18/65 PZ-154 i of Church of the Nazarene, owner of Lots 1 - 6, Block 112, Wedgwood Addition, has requested the closing of the ten foot utility easement along the rear lines of Lots 1 - 6, Block 112, Wedgwood Addition, as shown on the attached map . Abandonment of the unneeded easement will permit the church to build on the land . The applicant also agreed to replat the property into one large lot to avoid the necessity of requiring Zoning Board of Adjustment hearings on future construction. Private utility companies , Public Works, Water, Traffic Engineering and Planning Departments have reviewed the request and do not object to the abandonment. Texas Electric Service Company has requested, however, that a temporary easement be retained for an existing distribution line until the line is relocated. The City Plan Commission has reviewed the request and recommends adoption of the ordinance that has been prepared abandoning the easement as requested but retaining the temporary easement for Texas Electric Service Company.
