No error or mistake in naming any owner or in describing any property or in any other matter or thing, shall invalidate any assessment or any certificate issued in evidence thereof, and the omission of improvements on any particular unit or in front of any property exempt by law from the lien of special assessment for street improvements shall not invalidate any assessment levied. The certificates referred to need not contain recitals in exactly the words above provided for, but the substance thereof shall suffice, and they may contain other and additional recitals pertinent thereto. PASSED AND APPROVED THIS DAY OF_ APPROVED AS TO FORM AND LEGALITY Ce A;407 City Attorney Attachment "A" Page 1 of 2 CITY OF FORT WORTH PUBLIC WORKS DEPARTMENT ENGINEERING DIVISION ASSESSMENT PAVING OF 13 LOCATIONS SOUTHEAST SIDE PROJECT NO. 097-24000-127 RESUME OF THE PROJECT A Neighborhood Hearing was conducted on September 21, 1964, at Forest Oak Junior High School regarding the assessment paving of streets at 13 locations on the Southeast Side. Information pertaining to the construction of the street improvements and the computation of assessments was presented to 58 persons in attendance. UNITS 1 AND 2 - TRUELAND DRIVE: Mansfield Highway to Pecos Street No objections to the paving were made at the Neighborhood Hearing. UNITS 3 AND 4 - TRUELAND DRIVE: Pecos Street to Rodeo Street. Mr. W. M. Clark, 3086 Rodeo, Lot 1, Block 2, Tarrant Addition, requested that a storm drain be installed at the intersection of Trueland Drive and Rodeo Street. Subsequent study of the request indicates that storm drain inlets, located at Trueland and Pecos, will provide adequate drainage. Mr. C. E. Counts, 3036 Pioneer, Lot 1, Block 3, Tarrant Addition, commented that he was in favor of the paving only if Txueland Drive were also paved between Pioneer Street and Rodeo Street. This portion of Txueland is included in the project as Unit 4. Mrs. Carl McKelvey, 3039 Pioneer, Lot 18A, Block 2, Tarrant Addition, stated that she thought the assessment of $945 against Lot 18A and 18B, with a combined footage of 200 feet should be equal to the assessment of $540 for Lot 10, Block 1, Tarrant Addition, which is also 200 feet but not subdivided. It was explained that the assess- ments are based upon the configuration of the lots fronting onto or adjacent to the street improvements. The subdivision of I,ot 18 created one side lot with 120 feet frontage and one front lot with 75 feet frontage. Lot 10, Block 1, is undivided with 200 feet side lot frontage. Standard assessment policies provide that the City pays for 100 feet of side lot paving in excess of the initial 100 feet of a lot adjacent to the project. UNIT 5 - TRUELAND DRIVE: Gardinia Street to Timberline Drive No objections to the paving were made at the Neighborhood Hearing. UNIT 6 AND 7 - ALCANNON STREET: Mansfield Highway to 550 feet east of Trualand Drive Mr. C. E. Bergman, 3035 Alcannon, Lots 12 through 15, Block 1 and Lots 3 and 4, Block 3, Vickery Acres Addition, objected that he was not contacted when the paving petition was circulated. It was explained that a post card survey would be conducted by the City in conjunction with the paving project and that his desires concerning the paving would be made available to the City Council at the Benefit Hearing. Mr. Bergman also mentioned that the property in his block is being served by a 1k-inch water line which Page 2 of 2 limits fire protection. In connection within the paving improvements, the Water Depart- ment will install a 6-inch water main on Alcannon Street within the limits of the project and place fire hydrants within 500 feet of any structure or dwelling on Alcannon Street, Mr. C. M. McMillin, 3101 Alcannon, Lot 8, Block 1, Vickery Heights ,Addition, stated that deed restrictions prevented him from subdividing his property and for that reason he felt the assessment of $594.00 for the paving of Alcannon and $1,141.20 for the paving of Trueland should be reduced. A research of the deed records did not reveal such a res- triction and Mr. McMillin was advised of the findings by letter dated September 24, 1964. Mr. McMillin also requested that the existing pecan trees located on the parkway on Alcannon Street be preserved. It was explained that every effort would be made to preserve as many trees as possible; however, trees which interfere with the curb alignment would be removed. UNITS8AAN.D 9 - BATH STREET: Howard Street to Wilbarger Street Mr. H. T. Dearing, 4444 Erath, Lot 8, Block 13, Cobbs Orchard Addition, stated that water ponds at the intersection. of Wilbarger and Erath. Subsequent review of the request indicates that the situation will be alleviated by the paving of Erath Street. UNIT 10 - OAKJILL SZEET: Trentman Street to Miller Avenue No objections to the paving were made at the Neighborhood Hearing. UNITS 11, 12 AND 13 - UTAN STREET: Howard Street to Wilbarger Street Mr. William A. Crews, 4412 Rutan, Lot 12A, Block 12, Homewood Addition, asked if a sanitary sewer would be installed in advance of the paving. The property is now served by a septic tank. The Wafter Department will extend the sanitary sewer main from Collins Street provided Mr. Crews agrees to pay the cost of extension in excess of 100 feet for a single customer or 100 feet for each single customer served, in accordance with standard policies for the installation of sanitary sewer services in built-up areas. Mr. Charles Rogers, 3612 Collins, Lot 12, Block 11, and Lot 1, Block 10, Homewood Addition, inquired about action to be taken regarding the drainage ditch which crosses Rutan between Chickasaw Avenue and Collins Street. It was explained that a concrete valley would be installed on Rutan Street until such time as a major storm drain system is installed, ;involving a total cost of approximately $150,000, requiring future bond funds not now available, and financial participation of two developers of vacant tracts in the area lying in the drainage area between Rutan Street and the Nell Street Storm Drain System. The future installation of a closed storm drain system on the Rutan will affect about 30 lineal feet of paving, which would be brought to grade at no cost to adjacent property owners. •" f3A@DEN N FIR Ru 'RNS R ::• -•.::::•..' CN i;Kt rMT Nan ,.n. ®rill, fAFT! - t G , SEN'°RON' WILBARGER T = y W D:' A .
