SJR AN ORDINANCE PROVIDING THAT THE EAST-WEST ALLEY IN BLOCK 53, CHAMBERLIN ARLINGTON ADDITION, AND BLOCK 169, ARLINGTON HEIGHTS FIRST ADDITION, BE ABANDONED, VACATED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the east-west alley in Block 53, Chamberlin Arlington Addition, and Block 169, Arlington Heights First Addition, be and the same is hereby vacated, closed and permanently abandoned as an alley or public thoroughfare of any kind or character whatever. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said portion of the alley is hereby released and shall revert to the adjacent owners of the fee as provided by law, save and except that easements are reserved for any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. NUMBER the Chamberlin Arlington and Arlington 9/18/67 pz_25. 1 of Heights First Additions Mr. Haydn Cutler, representing all the adjoining property owners, has requested that the City vacate the east-west alley in Block 539 Chamberlin Arlington Addi- tion and Block 169, Arlington Heights First Addition, as shown on the attached map. Closing of the alley will permit it to be replatted with the adjoining property for future retail development. City- departments and private utility companies have reviewed the request and do not object to the proposed vacation, provided an easement is retained for the existing utilities. The City Plan Commission has reviewed the subject request and recommends the adoption of an ordinance vacating the alley as requested, subject to retaining the alley as an easement for existing utilities and replatm ting the alley with the adjoining properties. The applicant has submitted a repl.at of the alley and the adjoining properties as requested. City Council action on the Plan Commission recommendation is re- quested. HDM:1p Cas(!
