RENEWAL NO. 1 TO CITY SECRETARY CONTRACT NO. 47047 JOB ORDER CONTRACT (JOC) SERVICES CONTRACT LEAD-SAFE PROGRAM This Agreement is entered into by and between the City of Fort Worth (hereafter "City"), a home rule municipal corporation situated in portions of Tarrant, Denton and Wise Counties, Texas, with its principal place of business at 1000 Throckmorton Street, Fort Worth, Texas, and Javier Villagomez d/b/a G.T.O Construction, a sole proprietorship authorized to do business in the State of Texas (hereafter "Contractor"). City and Contractor may be referred to herein individually as a"Party" and collectives as the "Parties." WHEREAS, the parties have previously entered into City of Fort Worth City Secretary Contract No. 47047 (the "Contract"), which was executed on or about September 25, 2015; and WHEREAS, the original term of the Contract expired upon the earlier of the expenditure of$852,250.00 or one (1)year from the Effective Date; and WHEREAS, Article 5 of the Contract provides that the Contract shall be renewable at the City's option, and upon Contractor's written acceptance for up to four(4) additional one-year terms; and WHEREAS, the City and Javier Villagomez d/b/a G.T.O Construction now wish to extend the term for an additional one (1) year period from September 25, 2016 to October 31, 2017, pursuant to the terms of the original Contract; and WHEREAS,the City will authorize an additional $852,250.00 in funds for the Contract. NOW, THEREFORE, City and Contractor, acting herein by the through their duly authorized representatives, enter into the following agreement to amend the Contract: 1. ARTICLE 1. DEFINITIONS of the Contract is amended to add the following definition: "Lead Safe Program" or "program" means the City's lead hazard reduction program for eligible homeowners adopted by the City Council in M&C C-27398. TERM OF CONTRACT is hereby amended to add the following provision: This Contract is extended for an additional one (1) year period and shall expire upon the earlier of the expenditure of an additional $852,250.00 in funds appropriated for the Contract or October 31, 2017, unless terminated sooner or extended as provided by the terms of this Contract. 3. All other provisions of the Contract which are not expressly amended herein shall remain unchanged and in full force and effect. Executed on this the �� day of :L'�j'y✓ , 2016.
