31 through casing and for a sufficient distance each side of casing.
32 c. No thrust restraint contribution shall be allowed for the restrained length of
33 pipe within the casing.
34 d. Restrained joints,when required,shall be used for a sufficient distance from
35 each side of the bend,tee,plug,valve or other fitting to resist thrust which will
36 be developed at the design pressure of the pipe. For the purpose of thrust,the

1 15. Ductile Iron Pipe Interior Lining
2 a. Cement Mortar Lining
3 1) Ductile Iron Pipe for potable water shall have a cement mortar lining in
4 accordance with AWWA/ANSI CI04/A21.04 and be acceptable according
5 to NSF 61.
6 b. Ceramic Epoxy or Epoxy Linings
7 1) Ductile Iron Pipe for use in wastewater applications shall be lined with a
8 Ceramic Epoxy or Epoxy lining as designated in the City's Standard
9 Products List as shown in Section 0160 00.
10 2) Apply lining at a minimum of 40 mils DFT.
11 3) Due to the tolerances involved,the gasket area and spigot end up to 6
12 inches back from the end of the spigot end must be coated with 6 mils
13 nominal, 10 mils maximum using a Joint Compound as supplied by the
14 manufacturer.
15 a) Apply the joint compound by brush to ensure coverage.
16 b) Care should betaken that the joint compound is smooth without excess
17 buildup in the gasket seat or on the spigot ends.
18 c) Coat the gasket seat and spigot ends after the application of the lining.
19 4) Surface preparation shall be in accordance with the manufacturer's
20 recommendations.
21 5) Check thickness using a magnetic film thickness gauge in accordance with
22 the method outlined in SSPC PA 2.
23 6) Test the interior lining of all pipe barrels for pinholes with a non-
24 destructive 2,500 volt test.
25 a) Repair any defects prior to shipment.
26 7) Mark each fitting with the date of application of the lining system along
27 with its numerical sequence of application on that date and records

9 B. Pipe Handling

14 b. Do not handle the pipe in such a way that will damage the interior lining.
15 c. Use only nylon ropes,slings or other lifting devices that will not damage the
16 surface of the pipe for handling the pipe.
17 3. At the close of each operating day:
18 a. Keep the pipe clean and free of debris, dirt, animals and trash—during and after
19 the laying operation.
20 b. Effectively seal the open end of the pipe using a gasketed night cap.
21 C. Joint Making
22 1. Mechanical Joints
23 a. Bolt the follower ring into compression against the gasket with the bolts
24 tightened down evenly then cross torqued in accordance with AWWA C600.
25 b. Overstressing of bolts to compensate for poor installation practice will not be
26 permitted.
27 2. Push-on Joints
28 a. Install Push-on joints as defined in AWWA/ANSI C111/A21.11.
29 b. Wipe clean the gasket seat inside the bell of all extraneous matter.
30 c. Place the gasket in the bell in the position prescribed by the manufacturer.
31 d. Apply a thin film of non-toxic vegetable soap lubricant to the inside of the
32 gasket and the outside of the spigot prior to entering the spigot into the bell.
33 e. When using a field cut plain end piece of pipe,refinish the field cut and scarf to
34 conform to AWWA C600.
35 3. Flanged Joints
36 a. Use erection bolts and drift pins to make flanged connections.
37 1) Do not use undue force or restraint on the ends of the fittings.
38 2) Apply even and uniform pressure to the gasket.
39 b. The fitting must be free to move in any direction while bolting.
40 1) Install flange bolts with all bolt heads faced in one direction.
41 4. Joint Deflection
42 a. Deflect the pipe only when necessary to avoid obstructions or to meet the lines
43 and grades and shown in the Drawings.
44 b. The deflection of each joint must be in accordance with AWWA C600 Table 3.

5 D. Polyethylene Encasement Installation
6 1. Preparation
7 a. Remove all lumps of clay,mud,cinders,etc., on pipe surface prior to
8 installation of polyethylene encasement.
9 1) Prevent soil or embedment material from becoming trapped between pipe
10 and polyethylene.
11 b. Fit polyethylene film to contour of pipe to affect a snug,but not tight encase
12 with minimum space between polyethylene and pipe.
13 1) Provide sufficient slack in contouring to prevent stretching polyethylene
14 where it bridges irregular surfaces such as bell-spigot interfaces,bolted
15 joints or fittings and to prevent damage to polyethylene due to backfilling
16 operations.
17 2) Secure overlaps and ends with adhesive tape and hold.
18 c. For installations below water table and/or in areas subject to tidal actions,seal
19 both ends of polyethylene tube with adhesive tape at joint overlap.
20 2. Tubular Type(Method A)
21 a. Cut polyethylene tube to length approximately 2 feet longer than pipe section.
22 b. Slip tube around pipe,centering it to provide 1-foot overlap on each adjacent
23 pipe section and bunching it accordion-fashion lengthwise until it clears pipe
24 ends.
25 c. Lower pipe into trench and make up pipe joint with preceding section of pipe.
26 d. Make shallow bell hole at joints to facilitate installation of polyethylene tube.
27 e. After assembling pipe joint,make overlap of polyethylene tube,pull bunched
28 polyethylene from preceding length of pipe,slip it over end of the new length
29 of pipe and wrap until it overlaps joint at end of preceding length of pipe.
30 f. Secure overlap in place.
31 g. Take up slack width at top of pipe to make a snug,but not tight,fit along barrel
32 of pipe,securing fold at quarter points.
33 h. Repair cuts,tears,punctures or other damage to polyethylene.
34 i. Proceed with installation of next pipe in same manner.
35 3. Tubular Type(Method B)
36 a. Cut polyethylene tube to length approximately 1 foot shorter than pipe section.
37 b. Slip tube around pipe, centering it to provide 6 inches of bare pipe at each end.
38 c. Take up slack width at top of pipe to make a snug,but not tight,fit along barrel
39 of pipe,securing fold at quarter points; secure ends.
40 d. Before making up joint,slip 3-foot length of polyethylene tube over end of
41 proceeding pipe section,bunching it accordion-fashion lengthwise.
42 e. After completing joint,pull 3-foot length of polyethylene over joint,
43 overlapping polyethylene previously installed on each adjacent section of pipe
44 by at least 1 foot;make each end snug and secure.
45 4. Sheet Type
46 a. Cut polyethylene sheet to a length approximately 2 feet longer than piece
47 section.

12 5. Pipe-Shaped Appurtenances
13 a. Cover bends,reducers,offsets and other pipe-shaped appurtenances with
14 polyethylene in same manner as pipe and fittings.
15 6. Odd-Shaped Appurtenances
16 a. When it is not practical to wrap valves,tees,crosses,and other odd-shaped
17 pieces in tube,wrap with flat sheet or split length polyethylene tube by passing
18 sheet under appurtenances and bringing it up around body.
19 b. Make seams by bringing edges together,folding over twice and taping down.
20 c. Tape polyethylene securely in place at the valve stem and at any other
21 penetrations.
22 7. Repairs
23 a. Repair any cuts,tears,punctures or damage to polyethylene with adhesive tape
24 or with short length of polyethylene sheet or cut open tube,wrapped around
25 fitting to cover damaged area and secured in place.
26 8. Openings in Encasement
27 a. Provide openings for branches, service taps,blow-offs, air valves and similar
28 appurtenances by making an X-shaped cut in polyethylene and temporarily
29 folding back film.
30 b. After appurtenance is installed,tape slack securely to appurtenance and repair
31 cut,as well as other damaged area in polyethylene with tape.
32 c. Service taps may also be made directly through polyethylene,with any
33 resulting damaged areas being repaired as described above.
34 9. Junctions between Wrapped and Unwrapped Pipe:
35 a. Where polyethylene-wrapped pipe joins an adjacent pipe that is not wrapped,
36 extend polyethylene wrap to cover adjacent pipe for distance of at least 3 feet.
37 b. Secure end with circumferential turns of tape.
38 c. Wrap service lines of dissimilar metals with polyethylene or suitable dielectric
39 tape for minimum clear distance of 3 feet away from Cast or Ductile Iron Pipe.

"3.5 SPECIAL PREQUALIFICATION FOR "GRINDER PUMP INSTALLATION" required for this
project includes the following: Bidder shall provide prequalification submittal for grinder pump
installation. If the Contractor intends for the Grinder Pump installation to be performed by a
subcontractor, the subcontractor shall be prequalified for this work. Prequalification submittal
shall satisfy all requirements set forth in this section and section 00 45 11. In addition,
prequalification submittal shall include items listed below:
1) References a minimum of three and up to ten similar low pressure sewer projects that
included more than 20 grinder pump installations for each project, in the State of Texas in
the last 10 years.
2) The Bidder shall include the following information for each project:
a. Name of Utility or Owner
b. Utility or Owner's address and phone number
C. Project Name
d. Project start date and end date
e. Project Bid Amount
f. Name of Field Inspectors phone number
g. Utility Engineer's name and phone number
h. Contractor's project manager's name and phone number
i. Project Change Order History.
j. Project history with the City of Fort Worth.
Prequalification submittal shall be submitted to the City no later than Tuesday
August 16, 2016. Any bids not satisfying these requirements shall be rejected as non-
responsive. The City will provide a list of prequalified Grinder Pump installers no later
than Friday August 19,2016."

29 PREQUALIFICATION
30 The improvements included in this project must be performed by a contractor who is pre-
31 qualified by the City at the time of bid opening and/or a subcontractor who is pre-qualified by the
32 City at the time of bid opening.All Bidders must submit pre-qualification documents to the City
33 of Fort Worth Water Department a minimum of seven(7)days prior to the bid opening.The
34 Contractor and/or the subcontractor who will be responsible for installation of the grinder pumps
35 shall provide pre-qualification documents to the City. The procedures for qualification and pre-
36 qualification are outlined in the Section 00 21 13 —INSTRUCTIONS TO BIDDERS.

1 c. In the event that a water valve on an existing live system be turned off and on
2 to accommodate the construction of the project is required, coordinate this
3 activity through the appropriate City representative.
4 1) Do not operate water line valves of existing water system.
5 a) Failure to comply will render the Contractor in violation of Texas Penal
6 Code Title 7,Chapter 28.03 (Criminal Mischief)and the Contractor
7 will be prosecuted to the full extent of the law.
8 b) In addition,the Contractor will assume all liabilities and
9 responsibilities as a result of these actions.
10 H. Public Notification Prior to Beginning Construction
11 1. Prior to beginning construction on any block in the project, on a block by block
12 basis,prepare and deliver a notice or flyer of the pending construction to the front
13 door of each residence or business that will be impacted by construction.The notice
14 shall be prepared as follows:
15 a. Post notice or flyer 7 days prior to beginning any construction activity on each
16 block in the project area.
17 1) Prepare flyer on the Contractor's letterhead and include the following

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize an amendment to the Fiscal Year 2017 Water Capital Improvement Plan to increase
appropriations in the amount of$1,105,195.00 from available funds;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in
the Love Circle Water and Sewer Program in the amount of$1,105,195.00 for the Casino Beach-
Watercress Water Project for Love Circle and Casino Beach Park Water and Sanitary Sewer
Extension Improvements in the Lake Worth Gas Lease Capital Project Fund; and
3. Authorize execution of a contract with William J. Schultz Inc. d/b/a Circle C Construction Company
in the amount of$3,933,495.00 for Love Circle and Casino Beach Park Water and Sanitary Sewer
extensions.
DISCUSSION:
In January 2007, the City Council adopted the Lake Worth Capital Improvements Implementation
Plan. The plan included a number of water and sewer projects designed to provide Fort Worth Water
Department services to areas around Lake Worth previously served by wells and septic systems. To
date, projects have been completed to provide water/sewer service to the Landmark/Quebec and
Woodvale areas and water service has been provided along Watercress Drive.
This project includes the installation of a eight-inch sewer force main within Casino Beach Park to
connect to portions of previously installed sewer force main, the installation of 54 residential grinder
pumps along Love Circle and various 16-inch and 24-inch water main installation on Surfside Drive
and eight-inch water main installation on Casino Beach Park and Love Circle. The project will also
provide water and sewer services to 54 residential lots along Love Circle and water and sewer
services to three lots on Surfside Drive.
The project was advertised in the Fort Worth Star-Telegram on July 28, 2016 and August 4,
2016. On August 25, 2016, the following bids were received:

In addition to the contract amount$277,700.00 (water: $146,000.00; sewer: $131,700.00) is
required for project management, material testing and inspection. This project requires additional
funding in the amount of$1,105,195.00 as the construction bids came in higher than estimated for
the Love Circle and Casino Beach Park Water and Sanitary Sewer Extension Improvements Project
as well as related easements, inspection, contingency and project management costs. Staff
recommends these additional funds come from the Gas Well Revenues in Lake Worth Gas LSE CAP
Fund 33001.
M/WBE OFFICE: William J. Schultz, Inc. d/b/a Circle " C" Construction Company is in compliance
with the City's BIDE Ordinance by committing to zero percent MBE participation and documenting
good faith effort. William J. Schultz, Inc. d/b/a Circle "C" Construction Company identified several
subcontracting and supplier opportunities. However, the MBE's contacted in the areas identified did
not submit the lowest bids. The City's MBE goal on this project is eight percent.
The project is located in COUNCIL DISTRICT 7, Mapsco 45Q, 45R, 45U and 45V.
FISCAL INFORMATION/CERTIFICATION:
_ The Director of Finance certifies that upon approval of the above recommendation and adoption of
the attached appropriation ordinance, funds will be available in the current capital budget, as
appropriated, of the Lake Worth Gas Lease Capital Project fund and that, prior to expenditures being
made, the participating department has the responsibility to validate the availability of funds depicted
in the table below:

29 PREQUALIFICATION
30 The improvements included in this project must be performed by a contractor who is pre-
31 qualified by the City at the time of bid opening and/or a subcontractor who is pre-qualified by the
32 City at the time of bid opening.All Bidders must submit pre-qualification documents to the City
33 of Fort Worth Water Department a minimum of seven(7) days prior to the bid opening.The
34 Contractor and/or the subcontractor who will be responsible for installation of the grinder pumps
35 shall provide pre-qualification documents to the City. The procedures for qualification and pre-
36 qualification are outlined in the Section 00 21 13—INSTRUCTIONS TO BIDDERS.

1 3.3. The City reserves the right to require any pre-qualified contractor who is the apparent
2 low bidder(s) for a project to submit such additional information as the City,in its sole
3 discretion may require,including but not limited to manpower and equipment records,
4 information about key personnel to be assigned to the project,and construction
5 schedule,to assist the City in evaluating and assessing the ability of the apparent low
6 bidder(s)to deliver a quality product and successfully complete projects for the amount
7 bid within the stipulated time frame.Based upon the City's assessment of the submitted
8 information,a recommendation regarding the award of a contract will be made to the
9 City Council. Failure to submit the additional information,if requested,may be
10 grounds for rejecting the apparent low bidder as non-responsive.Affected contractors

1 4.1.5. Be advised that the Contract Documents on file with the City shall constitute
2 all of the information which the City will furnish.All additional information
3 and data which the City will supply after promulgation of the formal Contract
4 Documents shall be issued in the form of written addenda and shall become
5 part of the Contract Documents just as though such addenda were actually
6 written into the original Contract Documents.No information given by the City
7 other than that contained in the Contract Documents and officially promulgated
8 addenda thereto,shall be binding upon the City.

10 4.1.6. Perform independent research,investigations,tests,borings,and such other
11 means as may be necessary to gain a complete knowledge of the conditions
12 which will be encountered during the construction of the project.On request,
13 City may provide each Bidder access to the site to conduct such examinations,
14 investigations,explorations,tests and studies as each Bidder deems necessary
15 for submission of a Bid. Bidder must fill all holes and clean up and restore the
16 site to its former conditions upon completion of such explorations,
17 investigations,tests and studies.

19 4.1.7. Determine the difficulties of the Work and all attending circumstances
20 affecting the cost of doing the Work,time required for its completion, and
21 obtain all information required to make a proposal.Bidders shall rely
22 exclusively and solely upon their own estimates,investigation,research,tests,
23 explorations,and other data which are necessary for full and complete
24 information upon which the proposal is to be based.It is understood that the
25 submission of a proposal is prima-facie evidence that the Bidder has made the
26 investigation,examinations and tests herein required. Claims for additional
27 compensation due to variations between conditions actually encountered in
28 construction and as indicated in the Contract Documents will not be allowed.

30 4.1.8. Promptly notify City of all conflicts,errors,ambiguities or discrepancies in or
31 between the Contract Documents and such other related documents.The
32 Contractor shall not take advantage of any gross error or omission in the
33 Contract Documents, and the City shall be permitted to make such corrections
34 or interpretations as may be deemed necessary for fulfillment of the intent of
35 the Contract Documents.

37 4.2. Reference is made to Section 00 73 00—Supplementary Conditions for identification
38 of.

40 4.2.1. Those reports of explorations and tests of subsurface conditions at or
41 contiguous to the site which have been utilized by City in preparation of the
42 Contract Documents.The logs of Soil Borings,if any,on the plans are for
43 general information only.Neither the City nor the Engineer guarantee that the
44 data shown is representative of conditions which actually exist.

46 4.2.2. Those drawings of physical conditions in or relating to existing surface and
47 subsurface structures(except Underground Facilities)which are at or
48 contiguous to the site that have been utilized by City in preparation of the
49 Contract Documents.

1 4.2.3. Copies of such reports and drawings will be made available by City to any
2 Bidder on request. Those reports and drawings may not be part of the Contract
3 Documents,but the"technical data" contained therein upon which Bidder is
4 entitled to rely as provided in Paragraph 4.02. of the General Conditions has
5 been identified and established in Paragraph SC 4.02 of the Supplementary
6 Conditions. Bidder is responsible for any interpretation or conclusion drawn
7 from any"technical data" or any other data,interpretations,opinions or
8 information.

10 4.3. The submission of a Bid will constitute an incontrovertible representation by Bidder(i)
11 that Bidder has complied with every requirement of this Paragraph 4,(ii)that without
12 exception the Bid is premised upon performing and furnishing the Work required by
13 the Contract Documents and applying the specific means,methods,techniques,
14 sequences or procedures of construction(if any)that may be shown or indicated or
15 expressly required by the Contract Documents,(iii)that Bidder has given City written
16 notice of all conflicts,errors,ambiguities and discrepancies in the Contract Documents
17 and the written resolutions thereof by City are acceptable to Bidder,and when said
18 conflicts,etc.,have not been resolved through the interpretations by City as described
19 in Paragraph 6.,and(iv)that the Contract Documents are generally sufficient to
20 indicate and convey understanding of all terms and conditions for performing and
21 furnishing the Work.

23 4.4. The provisions of this Paragraph 4,inclusive,do not apply to Asbestos,Polychlorinated
24 biphenyls (PCBs),Petroleum,Hazardous Waste or Radioactive Material covered by
25 Paragraph 4.06. of the General Conditions,unless specifically identified in the Contract
26 Documents.

28 5. Availability of Lands for Work,Etc.
29
30 5.1. The lands upon which the Work is to be performed,rights-of-way and easements for
31 access thereto and other lands designated for use by Contractor in performing the Work
32 are identified in the Contract Documents. All additional lands and access thereto
33 required for temporary construction facilities,construction equipment or storage of
34 materials and equipment to be incorporated in the Work are to be obtained and paid for
35 by Contractor. Easements for permanent structures or permanent changes in existing
36 facilities are to be obtained and paid for by City unless otherwise provided in the
37 Contract Documents.

39 5.2. Outstanding right-of-way,easements,and/or permits to be acquired by the City are
40 listed in Paragraph SC 4.01 of the Supplementary Conditions. In the event the
41 necessary right-of-way,easements, and/or permits are not obtained,the City reserves
42 the right to cancel the award of contract at any time before the Bidder begins any
43 construction work on the project.

45 5.3. The Bidder shall be prepared to commence construction without all executed right-of-
46 way,easements, and/or permits, and shall submit a schedule to the City of how
47 construction will proceed in the other areas of the project that do not require permits
48 and/or easements.

1 6. Interpretations and Addenda

3 6.1. All questions about the meaning or intent of the Bidding Documents are to be directed
4 to City in writing on or before 2 p.m.,the Monday prior to the Bid opening. Questions
5 received after this day may not be responded to. Interpretations or clarifications
6 considered necessary by City in response to such questions will be issued by Addenda
7 delivered to all parties recorded by City as having received the Bidding Documents.
8 Only questions answered by formal written Addenda will be binding. Oral and other
9 interpretations or clarifications will be without legal effect.

22 6.2. Addenda may also be issued to modify the Bidding Documents as deemed advisable by

25 6.3. Addenda or clarifications may be posted via Buzzsaw.

27 6.4. A prebid conference may be held at the time and place indicated in the Advertisement
28 or INVITATION TO BIDDERS. Representatives of City will be present to discuss the
29 Project. Bidders are encouraged to attend and participate in the conference. City will
30 transmit to all prospective Bidders of record such Addenda as City considers necessary
31 in response to questions arising at the conference. Oral statements may not be relied
32 upon and will not be binding or legally effective.

34 7. Bid Security
35
36 7.1. Each Bid must be accompanied by Bid Bond made payable to City in an amount of
37 five(5)percent of Bidder's maximum Bid price on form attached, issued by a surety
38 meeting the requirements of Paragraphs 5.01 of the General Conditions.

40 7.2. The Bid Bond of all Bidders will be retained until the conditions of the Notice of
41 Award have been satisfied. If the Successful Bidder fails to execute and deliver the
42 complete Agreement within 10 days after the Notice of Award,City may consider
- 43 Bidder to be in default,rescind the Notice of Award,and the Bid Bond of that Bidder
44 will be forfeited. Such forfeiture shall be City's exclusive remedy if Bidder defaults.
45 The Bid Bond of all other Bidders whom City believes to have a reasonable chance of
46 receiving the award will be retained by City until final contract execution.

1 8. Contract Times
2 The number of days within which,or the dates by which,Milestones are to be achieved in
3 accordance with the General Requirements and the Work is to be completed and ready for
4 Final Acceptance is set forth in the Agreement or incorporated therein by reference to the
5 attached Bid Form.

7 9. Liquidated Damages
8 Provisions for liquidated damages are set forth in the Agreement.

10 10. Substitute and "Or-Equal"Items
11 The Contract,if awarded,will be on the basis of materials and equipment described in the
12 Bidding Documents without consideration of possible substitute or"or-equal" items.
13 Whenever it is indicated or specified in the Bidding Documents that a"substitute" or"or-
14 equal item of material or equipment may be furnished or used by Contractor if acceptable to
15 City,application for such acceptance will not be considered by City until after the Effective
16 Date of the Agreement. The procedure for submission of any such application by Contractor
17 and consideration by City is set forth in Paragraphs 6.05A.,6.05B. and 6.05C. of the General
18 Conditions and is supplemented in Section 0125 00 of the General Requirements.

20 11. Subcontractors,Suppliers and Others
21
22 11.1. In accordance with the City's Business Diversity Enterprise Ordinance No. 20020-
23 12-2011 (as amended),the City has goals for the participation of minority business
24 and/or small business enterprises in City contracts.A copy of the Ordinance can be
25 obtained from the Office of the City Secretary.The Bidder shall submit the MBE and
26 SBE Utilization Form, Subcontractor/Supplier Utilization Form,Prime Contractor
27 Waiver Form and/or Good Faith Effort Form with documentation and/or Joint
28 Venture Form as appropriate.The Forms including documentation must be received
29 by the City no later than 2:00 P.M. CST,on the second business days after the bid
30 opening date.The Bidder shall obtain a receipt from the City as evidence the
31 documentation was received. Failure to comply shall render the bid as non-
32 responsive.

34 11.2. No Contractor shall be required to employ any Subcontractor, Supplier,other person
35 or organization against whom Contractor has reasonable objection.

37 12. Bid Form

39 12.1. The Bid Form is included with the Bidding Documents; additional copies may be
40 obtained from the City.

42 12.2. All blanks on the Bid Form must be completed by printing in ink and the Bid Form
43 signed in ink. Erasures or alterations shall be initialed in ink by the person signing
44 the Bid Form. A Bid price shall be indicated for each Bid item,alternative,and unit
45 price item listed therein. In the case of optional alternatives,the words"No Bid,"
46 "No Change," or"Not Applicable"may be entered.Bidder shall state the prices,
47 written in ink in both words and numerals,for which the Bidder proposes to do the

1 work contemplated or furnish materials required.All prices shall be written legibly.
2 In case of discrepancy between price in written words and the price in written
3 numerals,the price in written words shall govern.

5 12.3. Bids by corporations shall be executed in the corporate name by the president or a
6 vice-president or other corporate officer accompanied by evidence of authority to
7 sign. The corporate seal shall be affixed. The corporate address and state of
8 incorporation shall be shown below the signature.

10 12.4. Bids by partnerships shall be executed in the partnership name and signed by a
11 partner,whose title must appear under the signature accompanied by evidence of
12 authority to sign. The official address of the partnership shall be shown below the
13 signature.

15 12.5. Bids by limited liability companies shall be executed in the name of the firm by a
16 member and accompanied by evidence of authority to sign. The state of formation of
17 the firm and the official address of the firm shall be shown.

19 12.6. Bids by individuals shall show the Bidder's name and official address.

21 12.7. Bids by joint ventures shall be executed by each joint venturer in the manner
22 indicated on the Bid Form. The official address of the joint venture shall be shown.

24 12.8. All names shall be typed or printed in ink below the signature.
25
26 12.9. The Bid shall contain an acknowledgement of receipt of all Addenda,the numbers of
27 which shall be filled in on the Bid Form.

29 12.10. Postal and e-mail addresses and telephone number for communications regarding the
30 Bid shall be shown.

32 12.11. Evidence of authority to conduct business as a Nonresident Bidder in the state of
33 Texas shall be provided in accordance with Section 00 43 37—Vendor Compliance
34 to State Law Non Resident Bidder.

36 13. Submission of Bids
37 Bids shall be submitted on the prescribed Bid Form,provided with the Bidding Documents,
38 at the time and place indicated in the Advertisement or INVITATION TO BIDDERS,
39 addressed to City Manager of the City,and shall be enclosed in an opaque sealed envelope,
40 marked with the City Project Number,Project title,the name and address of Bidder,and
41 accompanied by the Bid security and other required documents. If the Bid is sent through the
42 mail or other delivery system,the sealed envelope shall be enclosed in a separate envelope
43 with the notation"BID ENCLOSED" on the face of it.

1 14. Modification and Withdrawal of Bids

3 14.1. Bids addressed to the Purchasing Manager and filed with the Purchasing Office
4 cannot be withdrawn prior to the time set for bid opening. A request for withdrawal
5 must be made in writing by an appropriate document duly executed in the manner
6 that a Bid must be executed and delivered to the place where Bids are to be submitted
7 at any time prior to the opening of Bids. After all Bids not requested for withdrawal
8 are opened and publicly read aloud,the Bids for which a withdrawal request has been
9 properly filed may, at the option of the City,be returned unopened.
10
11 14.2. Bidders may modify their Bid by electronic communication at any time prior to the
12 time set for the closing of Bid receipt.

14 15. Opening of Bids
15 Bids will be opened and read aloud publicly at the place where Bids are to be submitted. An
16 abstract of the amounts of the base Bids and major alternates(if any)will be made available
17 to Bidders after the opening of Bids.

19 16. Bids to Remain Subject to Acceptance
20 All Bids will remain subject to acceptance for the time period specified for Notice of Award
21 and execution and delivery of a complete Agreement by Successful Bidder. City may, at
22 City's sole discretion,release any Bid and nullify the Bid security prior to that date.
23
24 17. Evaluation of Bids and Award of Contract
25
26 17.1. City reserves the right to reject any or all Bids,including without limitation the rights
27 to reject any or all nonconforming,nonresponsive,unbalanced or conditional Bids
28 and to reject the Bid of any Bidder if City believes that it would not be in the best
29 interest of the Project to make an award to that Bidder,whether because the Bid is
30 not responsive or the Bidder is unqualified or of doubtful financial ability or fails to
31 meet any other pertinent standard or criteria established by City. City also reserves
32 the right to waive informalities not involving price,contract time or changes in the
33 Work with the Successful Bidder. Discrepancies between the multiplication of units
34 of Work and unit prices will be resolved in favor of the unit prices. Discrepancies
35 between the indicated sum of any column of figures and the correct sum thereof will
36 be resolved in favor of the correct sum. Discrepancies between words and figures
37 will be resolved in favor of the words.

39 17.1.1. Any or all bids will be rejected if City has reason to believe that collusion
40 exists among the Bidders,Bidder is an interested party to any litigation
41 against City,City or Bidder may have a claim against the other or be
42 engaged in litigation,Bidder is in arrears on any existing contract or has
43 defaulted on a previous contract,Bidder has performed a prior contract in
44 an unsatisfactory manner,or Bidder has uncompleted work which in the
45 judgment of the City will prevent or hinder the prompt completion of
46 additional work if awarded.
