AMENDMENT NO. 1
STATE OF TEXAS CITY SECRETARY CONTRACT NO. 28559
COUNTY OF TARRANT
WHEREAS, the City of Fort Worth (City) and Chiang, Patel & Yerby, Inc. (Engineer)
made and entered into City Secretary Contract No. 28559 (the Contract), which was authorized
by the City Council by M&C C-19523 on the 25th day of March, 2003; and
WHEREAS, the Contract involves engineering services for the following Project:
Construction Management of West Side IV Pump Station and
North Side III Pump Station
Project No.: PW77-539120-06077016021
WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to
include an increased scope of work and revised maximum fee;
NOW, THEREFORE, City and Engineer, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the Contract:
1.
Article 1 of the Contract is amended to include the additional engineering services
specified in a proposal letter dated July 29, 2004, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional services to be performed by Engineer
total is $24,500.
2.
Article 11 of the Contract is amended to provide for an increase in the maximum fee to be
paid to Engineer for all work and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not exceed the sum of$198,949.
3.
All other provisions of the Contract, which are not expressly amended herein, shall
remain in full force and effect.

Additional Construction Management Services

Dear Mr. Mir:
The purpose of this letter is to request an increase in our scope of services and related fee for
the construction management services on this project. We respectfully submit the following
items for your consideration.
Item 1. Additional Site Trips
Task 2 of Attachment A to our Agreement for Engineering Services contains our scope of
services related to observations of construction progress. Our services are part-time and are
based on a pre-determined number of site trips. The site trips and observations occur during
specific construction phases, or after specific portions of the work are completed.
As discussed previously, we have conducted a number of additional trips due to conditions
beyond our control. These conditions include, but are not limited to, incomplete work by
Contractor, unacceptable work by Contractor, and re-inspection of corrective work by
Contractor. These conditions resulted in 9 additional trips. Please refer to the attached site trip
log. We request an increase of$4,500 for this additional effort.
Item 2. Project Schedule
Our routine monthly duties include corresponding with the contractor, project meetings,
reviewing pay requests, reviewing change order requests, and general project administration.
Task 5 in Attachment A to our Agreement limits our scope to eight months from Notice to
Proceed to Final Inspection. The Notice to Proceed date was February 10, 2003. The eight -
month time period ended on October 10, 2003. The construction contractor experienced delays
and the project schedule extended beyond the original completion date.
We processed the last operation and maintenance manual on June 22, 2004. As a result, we
extended our services by about 8.5 months. We request an increase of $20,000 for this
additional effort.
A table indicating the major services provided during this period is attached„ In addition to the
listed items, we continued to maintain routine correspondence with the Contractor and City) u
during this period, and to complete our administrative tasks on the project.
