AN ORDINANCE VACATING ABANDONING CLOSING AND
EXTINGUISHING THE OLD CLEBURNE ROAD USE-EASE-
MENT THE 20 BY 20 FOOT PUBLIC OPEN SPACE
EASEMENT LOCATED ON THE :NORTHWEST- CORNER OF
INTERSECTION OF THE OLD CLEBURNE ROAD USE
EASEMENT AND MCCART STREET A TEN FOOT WIDE
UTILITY EASEMENT AND A PORTION OF CLEBURNE
ROAD RIGHT -OF -WAY ADJACENT TO BLOCK 45— INCLUDING
LOT 18 OF BLOCK 45 CANDLERIDGE ADDITION PRO-
VIDING FOR THE REVERSION OF FEE IN SAID LAND
.REPEALING ALL ORDINANCES IN CONFLICT HEREWITH
AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS
SECTION 1
That the below described road use easement open space
easement utility easement and a portion of Cleburne Road 90
right -of -way be and the same are hereby vacated abandoned
permanently closed and extinguished for easement and right -of -way
purposes
A The Old Cleburne Road Use Easement more particularly
described as follows
BEGINNING at the intersection- ofathe
North Right -of -Way line of Cleburne Road
and the West Right -of -Way line of McCart
Street as shown and recorded in the
platting of Southridge Addition Volume
388 -111 Pages 54 and 55 Deed Records
Tarrant County Texas
THENCE South 52° 13' 25" West 153 41 feet
to a point in the North Right -of -Way line
of Cleburne Road said point being an
intermediate point on a curve to the left
in the North line of Cleburne Road said
curve having a radius of 790 0 feet and
an arc length to the East PC of 131 25 feet
THENCE along said curve to the left whose
radius is 790 0 feet and long chord which
bears South 66° 35' 07" West 197 03 feet
an arc distance of 197 54 feet to a point
THENCE North 260 24' 44 West 6 25 feet to
a point
THENCE North 520 13' 25 East 379 06 feet to
a point in the West line of McCart Street
said point being an intermediate point on a
curve to the left said curve having a radius

SECTION 2
That the fee to the land in the above described right -of-
way and easements is hereby released and shall revert to the
abutting owners as provided by law SAVE AND EXCEPT that easements
are retained for any and all presently existing or prospective
utilities
SECTION 3
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed
SECTION 4
That this ordinance shall take effect and be in full force
and effect from and after the date of its passage and it is so
ordained

CandleRidge Shopping Center Associates with the consent of all abutting property
owners has requested that the City vacate the Old Cleburne Road use easement
the 20' x 20' public open space easement located on the northwest corner of the
intersection of the Old Cleburne Road use easement and McCart Street a 10' wide
utility easement_ nd a portion of the Cleburne Road (C R X61035) right -of -way
adjacent to Block. 45 including Lot 18 of Block 45 CandleRidge Addition as
shown on the attached map and more fully described in the attached metes and
bounds description.
The subject street rights -of -way acquired by dedication are paved segments of
Cleburne Road, which have been physically closed in accordance with realignment
of Cleburne Road in order to provide a T" intersection with McCart Street
There a --e no utility facilities contained within the subject rights -of -way The
subject utility and public open space easements acquired by dedication are not
in use and contain no public utility facilities
Reviewing City Departments and private utility companies have reviewed this
request and have offered no objections provided the vacated street rights -of -way
and easement are replatted with abutting property A satisfactory replat has
been submitted
The City Plan Commission has reviewed this request and recommends that the sub-
ject street ?eights -of -way and easements be vacated as requested
Recommendation
It is recommended that an Ordinance be adopted vacating the subject street
rights -of-way and easements as recommended by the City Plan Commission
