AN ORDINANCE ESTABLISHING A PAY RATE ADJUSTMENT FOR MUNICIPAL COURT
JUDGES CHARLES T. ATKINSON, ANDREW T. BRADSHAW, RAQUEL D. BROWN, ANN Y.
COLLINS, SIMON C. GONZALEZ, BENITA FALLS HARPER, CLAUDIA A. MARTINEZ, ROBERT
NEEL MCDONALD, JO ANN REYES, PATRICIA L. SUMMERS, DEPUTY CHIEF JUDGE JAMES
D. RODGERS, AND CHIEF JUDGE NINFA L. MARES; PROVIDING THAT THIS ORDINANCE
SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS
CLAUSE; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, Section 30.00006 (h) of the Texas Government Code provides that the governing body of
the municipality shall determine the salary of the municipal judges;
WHEREAS, Section 10-2 of the City Code states that the Ad Hoc Municipal Court Advisory Committee
shall make recommendations to the city council on all matters relating to the municipal court judges; and
WHEREAS, the Ad Hoc Municipal Court Advisory Committee recommended that the municipal court
judges listed below, Deputy Chief Judge and Chief Judge receive a 3% pay rate adjustment as provided in the
adopted budget for Fiscal Year 2016-2017.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS,AS FOLLOWS:
SECTION 1.
That Municipal Court Judges Charles T. Atkinson, Andrew T. Bradshaw, Raquel D. Brown, Ann Y.
Collins, Simon C. Gonzalez, Benita Falls Harper, Claudia A. Martinez, Robert Neel McDonald, Jo Ann Reyes,
Patricia L. Summers, Deputy Chief Judge James D. Rodgers, and Chief Judge Ninfa L. Mares receive a 3%pay
rate adjustment, with a new pay rate set at: $49.73 per hour for Municipal Judges Charles T. Atkinson, Raquel
D. Brown, Ann Y. Collins and Patricia L. Summers; a new pay rate set at $51.86 per hour for Municipal Judges
Andrew T. Bradshaw, Simon C. Gonzalez, Benita Falls Harper, Claudia A. Martinez, Robert Neel McDonald
and Jo Ann Reyes; a new pay rate set at $53.74 per hour for Deputy Chief Judge James D. Rodgers; and a new
pay rate set at$64.36 per hour for Chief Judge Ninfa L. Mares, effective December 24, 2016.

SECTION 2.
This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort
Worth, Texas (1986), as amended, except where provisions of this ordinance are in direct conflict with the
provisions of such ordinances and Code, in which event such conflicting provisions of such ordinances and
Code are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences,
clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or final decree of a
court of competent jurisdiction, such ineffectiveness or unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase,
clause, sentence, paragraph or section.
SECTION 4.
The pay adjustment provided under this ordinance shall take effect December 24, 2016.

Adopt Ordinance Establishing a Pay Rate Adjustment for Ten Municipal Court Judges, Deputy Chief Judge
and Chief Judge Effective December 24, 2016 (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance establishing a three percent pay
rate adjustment for ten Municipal Court Judges, Deputy Chief Judge and Chief Judge to be effective on
December 24, 2016.
DISCUSSION:
Section 30.00006(h) of the Government Code requires the City Council to set the salary for the Municipal
Judges. The City Council adopted a pay plan for general employees as part of the Fiscal Year 2016-2017
budget. The adopted budget provides funds for pay raises for the Municipal Judges. However, as Council
appointees, the Municipal Judges, Deputy Chief Judge and Chief Judge were not included in the pay plan
adopted by the City Council.
On September 27, 2016, the Ad Hoc Municipal Court Advisory Committee considered a pay rate
adjustment for the Municipal Court Judges, Deputy Chief Judge and Chief Judge. After discussion, the
Committee voted unanimously to recommend a three percent pay rate adjustment, setting the new hourly
pay rate for the Deputy Chief Judge, Chief Judge and 10 Municipal Court Judges as follows:
1. An hourly rate of$49.73 for Municipal Judges Charles Tyler Atkinson, Raquel D. Brown, Ann Y.
Collins and Patricia L. Summers;
2. An hourly rate of$51.86 for Municipal Judges Andrew T. Bradshaw, Simon C. Gonzalez, Benita Falls
Harper, Claudia A. Martinez, Robert Neel McDonald, and Jo Ann Reyes;
3. An hourly rate of$53.74 for Deputy Chief Judge James D. Rodgers; and
4. An hourly rate of$64.36 for Chief Judge Ninfa L. Mares.
The pay rate adjustments is to be effective December 24, 2016. Total estimated salary cost for 10
associate Municipal Court Judges for the remainder of the Fiscal Year 2016-2017 is $23,770.56, total
estimated salary cost for the Deputy Chief Judge position for the remainder of the Fiscal Year 2016-2017
is $2,504.16, and total estimated salary cost for the Chief Judge position for the remainder of Fiscal Year
2016-2017 is $2,999.52, for a total estimated amount of$29,274.24.
This M&C does not request approval of a contract with a business entity.
