ORDINANCE NO. ~ ~ a- ~ -
AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE-
MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE
CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING
THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE
CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILING
THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE
CITY AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the
hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im-
proved by raising grading and filling same and by constructing thereon the following to-wit
JOHN T WHITE ROAD From 200' west of Cook's Lane to Randol Mill Parkway,
known and designated as Project No 029-023-153
Unit II a seven-inch thick reinforced concrete
pavement on a six-inch thick lime sir~bilized subgrade
~~ with seven-inch high superimposed concrete curb on
{~, two twenty-six foot traffic lanes Six-inch thick
concrete driveways will be constructed where specified
COOK'S LANE From 235 north of John T White Road to 147' south
of John T White Road known and designated as Pro-
ject No 029-023-153 Unit IIA a seven-inch thick
reinforced concrete pavement on a six-inch thick lime
stabilized subgrade with seven-inch high superimposed
concrete curb on two twenty-six foot traffic lanes

together with concrete curbs, gutters driveways and incidentals to such improvements
on proper grade and line where same are not already so constructed together with storm
sewers and drains and other necessary incidentals and appurtenances all of said im-
provements to be constructed as and where shown on the Plans and in strict accoxdance
with the Plans and Specifications therefor contract therefore has been made acd
entered into with Austin Paving ComnanX, ;
and
WHEREAS, the City Council of the City of Fort Worth Texas, has caused the Public
Works Director to prepare and file estimates of the cost of such improvements and
estimates of the amount per front foot proposed to be assessed against abutting property
and the owners thereof and such estimates have been examined NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT

Such estimates be and- they are hereby adopted and approved
II
It is hereby found and determined that the cost of improvements on each portion of
streets avenues and' public places hereinafter described with the amount or amounts
per front foot proposed to be assessed for sueh improvements against abutting pro-
perty and the owners thereof, are as follows to-wit
JOHN T WHITE ROAD From 200' west of Cook`s Lane to Randol

COOK'S LANE From 235' north of John 7 White Road to
147' south of John T White Road, known
and designated as Project No 029-023-153
Unit IIA
The estimated cost of improvements is $ 1, R_621_~0 the estimated amount
per front foot to be assessed against abutting property and the owners thereof for Superim-
posed concrete curb ~}~~#~~~~~~' is $ 1.01 the estimated amount per front foot to
be assessed against abutting property and the owners thereof for pavement is $ 42.39
the estimated amount per front foot to be assessed against abutting property and the
owners thereof for -p- wide concrete sidewalk is $ -Q- the estimated
amount per square foot to be assessed against abutting property and the owners thereof for
six-inch thick concrete driveway is $ ~_1(l per square foot the total
estimated amount per front foot to be assessed against abutting property and the owners
thereof is $ 43 40 plus the cost incurred for concrete driveway construction
where specified

A hearing be given and held by and before the City Council of the City
of Fort-Worth Tekas to all owning or claiming any property abutting upon said
portions of highways streets avenues and public places as well as to all /d ~ ~
owning or claiming any interest in any such property Such hearing shall be`+
given and held on the ~~rrl day of f)PrpmhPr 19~_, at .~~~(l°~A_M,
in the Council Chamber in the City Hall in the City of Fort Worth Texas and
the City Secretary is hereby directed to give or cause to be given notice ,of the
time and place of such hearing and of other matters and facts in accordance with
the terms and provisions of an Act passed at the First Called Session of the
Fortieth Legislature of the State of Texas and known as Chapter 106 of the Acts
of said Session now being known as Article 1105b of vernon's Texas Civil Statutes
as amended by Acts 1967 60th Legislature Page 365 Chapter 176 Section 1,
emergency effective May 12 1967 Such notice shall be by advertisement inserted
at least three (3) times in a newspaper published in the pity of Fort Worth
Texas the first publication to be made at least twenty-one (21) days before
the date of said hearing Said notice shall comply with and be in accordance with
the terms and provisions of said Act as amended The City Secretary is further
directed to give or cause to be given personal notice of the time and place of
such hearing to all owning or claiming any property abutting on said portions of
highways streets avenues and public places as well as to all owning or claiming
any interest in any such property Such personal notice shall be in writing and
shall be given or caused to be given by the City Secretary by depositing such
written notice in the United States Mail at least fourteen (14) days before the
date of the hearing postage prepaid, i~ envelopes addressed to all persons
owning or claiming any interest in the respective properties abutting the high
ways streets, avenues and public places or portions thereof to be improved as
the names bf such persons are shown on the current rendered tax rolls of the City
of Fort Worth and at the addresses so shown, or if the name of such respective
owners do not appear on such rendered ta•x rolls then address to such owners as
their names are shown on the current unrendered tax rolls of the City of Fort Worth
at the addresses shown thereon In those cases in which an owner of property
abutting a highway street avenue or public place or portion or portions there-
of which is to be improved is listed as "unknownB1 on the then current city of
Fort Worth tax rolls or the name of an owner is shown on the City of Fort Worth
tax rolls but no address for such owner is shown no notice need be mailed In
those cases where the owner is shown to be an estate the mailed notice may be
addressed to such estate In this connection the City Secretary shall prepare
and file or cause to be prepared and filed with these proceedings a list of the
properties to be assessed, the names of those persons awning or claiming any
interest in said properties to whom the notice was mailed together with the last
known addresses determined as aforesaid of the respective owners and those per=
sons owning or claiming any interest in said property
The City Secretary shall certify that each of the parties in said list whose
address is shown on the then current rendered or unrendered tax rolls of the City
o.f Fort Worth was mailed a copy of the notice of hearing and shall further certify
the date or dates on which said notice was mailed A copy of each notice shall be
attached to such certificate The certificate of the City Secretary will be con-
elusive evidence of the facts therein recited

The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council and by
filing the complete ordinance in the appropriate Ordinance Records of this City

This ordinance shall take effect and be in full force and effect from and
after the date of its passage

Origirx of Project
The 1976-78 Capital Improvement Program (CIP) Page=B~1 authorized engineering
and purchase of right-of-way for the construction of John T White Road from
I-820 to RarYdol Mill Parkway a distance of 2 6 miles The CIP provided for the
acquisition of right-of-way for a double 36' roadway and the construction of one
of the 36' roadways to arterial grade pavement Due to the length of the project
the City Council authorized the design engineering in two segments, the first
segment being from I-820 to 200' west of Cooks Lane and the second being from
200' west of Cooks Lane to Randol Mill Parkway On May 3,1977(M&CC-3774) a contract
for engineering services was awarded to Gordon Swift, Consulting Engineers, for
the design of s~ibject segment of John T White Road
Due to controversy surrounding this project the City Council on April 3 199
(CP-52), instructed the staff to redesign John T White Road to include a
double 26' roadway on a 120' right-of-way, and on April 24 1979, amended the
contract for engineering services with Gordon Swift, Consulting Engineers
Improvements
,John T White Road will be improved as a double 2b' wide arterial roadway
Construction shall consist of •1" thick concrete pavement and 7" high concrete
curb Included are left turn Lanes and cross-overs at three future north-south
streets and complete intersection improvements at Cooks Lane The intersection
improvements consist of the construction of 7" concrete pavement and curb on
double 36' roadway from 235' north of john T White Road to 147' south of John
`P White Road to include right and left turn lanes Storm drainage improvements
will consist of 3 498 linear feet of pipe and appurtenances and a box culvert
Should future widening of the roadway occur, the additional lanes would be added
to the 26' lanes in this contract
Receipt of Bids
The project was advertised for bids on October 9 and 16, 1980 and the following
bids were received on November 6, :1980, with 180 working days allotted to complet

Based on the low bid and standa:rd,;,,policy, approximately $323,457 67 is proposed
to be assessed against the adjacent properties Funding for the property
owners' share of construction cost will be provided for by a bond fund transfer
from the "Revolving Fund Unspecified" Cost to the City for street and
storm drain construction is approximately $865 163 53, including inspection
engineering survey and administration Sufficient funds are available in
Project A punt No 029-023-129-00 for the City's construction costs A bond
fund transfer from the "Engineering Unspecified Account" in the amount of
$9 000 is required to supplement the engineering funds in Project Account No
031-023-129-00
