HomeMy WebLinkAboutOrdinance 22514-12-2016 ORDINANCE NO.22514-12-2016 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AMOUNT OF $124,000.00, IN THE WATER CAPITAL PROJECTS FUND, FOR THE PURPOSE OF FUNDING THE LAKE WORTH DAM REHABILITATION AND IMPROVEMENTS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the amount of$124,000.00, in the Water Capital Projects Fund,for the purpose of funding the Lake Worth Dam Rehabilitation and Improvements. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 22394-09-2016 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of$124,00.00 from available funds; and 2. Authorize execution of an Engineering Agreement with Freese and Nichols, Inc. for the Lake Worth Dam Rehabilitation and Improvements in the amount of$124,000.00 (City Project No. 100543). DISCUSSION: The Lake Worth Dam is owned by the City of Fort Worth (City) and regulated by the Texas Commission on Environmental Quality's (TCEQ) dam classification system. City and TCEQ staff have conducted regularly scheduled inspections of this dam. Recommendations from these inspections may include changes to standard operating and monitoring procedures, updates or modifications to maintenance practices, or recommended rehabilitation work to preserve the life of the dam structure. As part of this Engineering Agreement, Freese & Nichols, Inc. will perform a field survey of the conditions downstream of the spillway to check for any erosion from the recent rain events, perform an updated stability analysis and prepare plans and specifications for minor structural rehabilitation and repairs of the dam. Freese and Nichols, Inc. will also provide bidding assistance as well as construction phase services. Freese and Nichols, Inc. proposes to perform this work for a fee not to exceed the amount of$124,000.00. City staff considers this fee to be fair and reasonable for the scope of services proposed. The overall project budget is estimated to be $424,000.00. Design is expected to start in January 2017 and be completed by June 2017. Construction is anticipated to commence in October 2017 and be completed by August 2018. This project will have no impact on the Water Department's operating budget when completed. M/WBE OFFICE: A waiver of the goal for MBE/SBE subcontracting requirements was requested by the department and approved by the M/WBE Office, in accordance with the M/WBE or BDE Ordinance, because the purchase of goods or services from source(s) where subcontracting or supplier opportunities are negligible. The Fiscal Year 2017 Water Operating Budget includes appropriations of$21,060,000.00 for the purpose of providing Pay-As-You-Go Funding for Water Capital Projects. After this transfer for Fiscal Year 2017, the balance will be $19,845,257.00.
