(19) TO SECTION 27P19 'PARK RULES--GENERALLY" PROHIBITING THE POSSESSION OF ALCOHOL AT CERTAIN BASEBALL FIELDS PROVIDING FOR THE POSTING OF SIGNS PROVIDING THAT THE ORDINANCE WILL BE CUMULATIVE PROVIDITG A SEVERABILITY CLAUSE PROVIDING A PENALTY PRO- VIDING FOR PUBLICATION AND PROVIDITG ATJ EFFEC- TIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS ECTIO I That Chapte 27 o th Code of the City of Fort Worth Texas (1964) "Offenses -Misce aneous" be amended by adding subsection (19) to Sectio 27-19 "Park Rules--Generally" such subsection ad as follows "( 9) It CODE F THE CITY OF FORT WORTH PERSOIIS IN VIO- LAT N MAY BE FINED UP TO $200 00 " SECTION II That this ordinance shall be cumulative of all provi- lions of ordinances and of the Code of the City of Fort Worth Texas (1964) as amended except where the provisions of this ordinance are in direct conflict with the provisions of such ordinance and such Code in which event conflicting provisions of such ordinances and such Code are hereby repealed SECTIOI'1 III It is hereby declared to be the intention of the City Council tn.at the sections paragraphs sentences clauses and phrases of this ordinance are severable and if any phrase ' clause sentence paragraph or section of this ordinance shall ~~ ., ... ~, be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction such unconstitutionality shall not affect any of the remaining phrases clauses sentences paragraphs and sections of this ordinance since the same would have been enacted by the City Council without the incorporation of this ordinance of any such unconstitutional phrase clause sentence paragraph or section SECTION IV That any person firm or corporation who violates dis- obeys omits neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Hundred and No/100 Dollars ($200 00) for each offense Each day that a violation is permitted to exist shall constitute a separate offense SECTION V The City Secretary of the City of Fort Worth Texas is hereby directed to publish the caption and penalty clause and effective date of this ordinance for five (5) days in the official newspaper of the City of Fort Worth Texas as authorized by the TEX REV CIV STATS art 1176b-1 SECTION VI This the Park and Recreation Department has noticed an increasing use of .alcohol by spectators in the grandstands of ballfields in City parks most frequently at major fields that are enclosed by a fence Coincidentally there have been several incidents of rowdiness and fighting (sometimes with knives and guns) at these softball and baseball fields These occurrences have t;hx.eate.ned the safety of the ball players officials and spectators The Park sand +T~ecreation Department staff is of the opinion that the consumption of '.alcohol is a contributing factor to this type of conduct Attempts to control this type of behavior have proven unsuccessful since no legal basis exists for prohibiting the consumption of alcohol at athletic fields At the request of the Park and Recreation Department staff the Department of Law has prepared the attached ordinance which would prohibit the possession of alcohol at enclosed softball and baseball fields As required by the ordinance the following sign will be conspicuously posted at each entrance to the ballfields POSSESSION OF ALCOHOL WITHIN THESE PREMISES IS PROHIBITED UNDER SECTION 27-19 (i9) OF THE CODE OF THE CITY OF FORT WORTH PERSONS IN VIOLATION MAY' BE FINED UP TO $200 00 The Park and Recreation Department staff feels that the. adoption of this ordinance will enable the Police and Park Patrol to e.ffective.ly eliminate this problem at enclosed ballfields Recommendation It is recommended that the City Council approve the amendment to Section.{2'7-19 of the Fort Worth City Code. to make unlawful the. possession of alcohol within
