Home My WebLink AboutOrdinance 8641F ORDINANCE NO R ~ ~ I ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF CFVEfVAULT AVENUE AND PORTIONS OF SUNDRY OTHE#t STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS9 YDECLARING THE CONTRACT WITH GIBBONS ['.()N~TRTT('TTf1N rn FOR THE CONSTRUCTION Ol< SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMEDy DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOR OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAYD CITYa AND PROVYDING AN EFFECTIVE DATE WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with Gibbons CanGtY anti nn (',p _ certain street improvements on the public places in said City, to~~iit , for the malting and construction of inafter described portions of streets, avenues and CHENAULT AVENUE From Sylvania Avenue to Paradise Street, Known and designated.. as Project 029-040101, a six-inch thick hot-mix asphaltic concrete pavement on a six-inch thick cement stabilized subgrade with seven-inch high concrete curb and eighteen-inch wide concrete gutter on a thirty-six foot road- way Six-inch thick concrete driveways will be cpnstructed~~where specified titiHEREA3, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No 8535 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, wHEREA3, the City council of the pity of Fort ~'~orth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No 8535 , and TrdH~;I~;Aa, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOtiu, Tt~tdi~'ORE, ~3E IN ORDAINED I3Y THE CITY COUNCIL OF THE CITY OF FORT WORTH, 'P~.XA;i, THAT I The improvements on each of t ho portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and perfornned II The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same acid impress thereon the corporate seal of the City, all in accordance Frith the proceedings relating to such improvements and assessments The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after diving effect to such credit, if arty, are hereby enumerated and itemized as follows III When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price IV The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth,.
