HomeMy WebLinkAboutOrdinance 22507-12-2016 ORDINANCE NO.22507-12-2016 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $25,000.00 SUBJECT TO RECEIPT OF THE GRANT FROM THE DEPARTMENT OF HOMELAND SECURITY, FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA), FOR FIRE PREVENTION AND SAFETY; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $25,000.00 subject to receipt of the grant from the Department of Homeland Security, Federal Emergency Management Agency(FEMA)for fire prevention and safety. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 22393-09-2016 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Ratify the application for and authorize acceptance of a Fire Prevention and Safety Grant from the Department of Homeland Security-Federal Emergency Management Agency under the Fiscal Year 2015 Assistance to Firefighters Grant Program, in the amount up to $23,810.00 to be used to further develop the Fort Worth Fire Department's capabilities in the area of economic arson and insurance fraud; 2. Authorize transfer of funds from the Fiscal Year 2017 Adopted Budget for the Fort Worth Fire Department Arson and Bomb Investigations section in the amount of$1,190.00, as required, for the City's five percent grant match from the General Fund to the Grants Operating Federal Fund; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Operating Federal Fund in the amount of$25,000.00, subject to receipt of a grant from the Department of Homeland Security, Federal Emergency Management Agency. DISCUSSION: The Department of Homeland Security (DHS) - Federal Emergency Management Agency provides Fire Prevention and Safety (FP&S) Grants as part of the Assistance to Firefighters Grant (AFG) Program. The FP&S grants are intended to support projects that enhance the safety of the public and firefighters from fire and related hazards. The DHS recently notified the Fort Worth Fire Department (FWFD) that its application for financial assistance submitted under the Fiscal Year 2015 AFG Program - FP&S had been approved in the amount of$23,810.00. As a condition of this award, the City is required to contribute a five percent cost match in the amount of$1,190.00 for a total amount of$25,000.00. Economic arson involves fires set deliberately in order to defraud insurance companies and it is emerging as one of the nation's fastest growing and costliest crimes. Commonly referred to as arson-for-profit, these practices combine the incendiary act of arson with other collateral crimes such as making false applications prior to the fire or submitting falsified claim forms to insurance companies. Unfortunately, arson fraud is one of the most difficult crimes to investigate and requires investigators to use every tool available to combat economic arson. The FP&S grant will be used to help form an internal task force, train an arson investigator as a polygraph examiner and send two individuals to specialized arson training Logname: 36DHS2015 ASSISTANCE TO FIREFIGHTERS GRANT Page I of 2 in an effort to enhance the FWFD's ability to solve arson cases and convict criminals. The estimated cost to accomplish this endeavor is $25,000.00. Additionally, approval will also authorize acceptance of this award and transfer of the City's match in the amount of$1,190.00 from the General Fund Budget to the Grants Operating Federal Fund. This amount was not included in the Fiscal Year 2017 Budget because the award was unplanned. Therefore, the department will use funds designated for investigations and arson-related training to meet the City's portion of the match. This is a reimbursement grant. This contract will be with a governmental entity, state agency or public institution of higher education: U.S. Department of Homeland Security - Federal Emergency Management Agency. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations, award and receipt of the grant and adoption of the attached appropriation ordinance, funds will be available in the Fiscal Year 2016 -2017 Operating Budget, as appropriated, of the General Fund and Grants Operating Federal Fund. The Fort Worth Fire Department's Arson and Bomb Investigations Fiscal Year 2017 Adopted Budget included appropriations of$6,400.00 for training/workshops in the General Fund for this purpose. To date, $0.00 of the appropriations have been expended.
