RATIFICATION AND AMENDMENT OF DESCRIPTION OF OIL AND GAS LEASE

WHEREAS, CITY OF FORT WORTH, a home rule municipal corporation of the
State of Texas, as Lessor, did on the date of September 17, 2009 execute unto XTO ENERGY
INC., as Lessee, a certain unrecorded Oil and Gas Lease as recorded by Memorandum of Oil and
Gas Lease at Clerk Document D209262309, Official Public Records of Tarrant County, Texas,
covering certain lands situated in Tarrant County, Texas, as described in Exhibit "A" of the
Lease to wit:
0.046 ohan acre, more or less, being a called 0.007 of an acre, situated in the J. N.
Ellis Survey, A-463, Tarrant County, Texas, being a parcel of land out of Lot 9,
Block 22, Emory College Subdivision of Patillo's Addition, an Addition to the
City o1 Fort Worth, Tarrant County, Texas, according to the Plat thereof recorded
in Volume 106, Page 48, Plat Records, Tarrant County, Texas, and being more
particularly described in that certain General Warranty Deed, dated December 14,
1989, from David D. Locker, to the City of Fort Worth, a municipal corporation,
as recorded in Volume 9816, Page 394, Official Public Records, Tarrant County,
Texas.

AND WHEREAS, said description in the Lease is incomplete and indefinite and the
lands intended to be covered are more accurately described as follows:
0.1 S0 of an acre, more or less, being a called 0.008 of an acre, situated in the
Joshua N. Ellis Survey, A-463, Tarrant County, Texas, being a parcel of land out
of Lot 9, Block 22, Emory College Subdivision of Patillo's Addition, an Addition
to the City of Fort Worth, Tarrant County, Texas, according to the Plat thereof
recorded in Volume 106, Page 48, Plat Records, Tarrant County, Texas, and being
more particularly described in that certain General Warranty Deed, dated
December 14, 1989, from David D. Locher- to the City of Fort Worth, a municipal
corporation, as recorded in Volume 9816, Page 394, Official Public Records,
Tarrant County, Texas.
Containing 0.150 gross acres lying in Tarrant County, _hexas.
NOW, THEREFORE, in consideration of the premises, and for the purposes of making
the said lease definite and certain in respect to the identity of the lands to be covered thereby, the
undersigned does hereby declare that it was and is its intention to lease for oil and gas purposes
the identical tract of land last above described; and does hereby amend said lease in respect to
the description of the lands included therein, as aforesaid, and ratify and adopt the same as so
amended.
EXCEPT as otherwise amended the above described lease is and shall remain in full
force and effect as written in accordance with its terms and conditions, and the undersigned
Lessor recognizes said lease as a valid and sustaining Oil and Gas Lease.

IN WFFNESS WHEREOF, this instrument is executed by the undersigned Lessor on
the respective date of acknowledgment below, but shall be effective as of the date of September
