HomeMy WebLinkAboutOrdinance 22561-12-2016 ORDINANCE NO.22561-12-2016 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE BONDS RANCH ROAD AT US 287 PROJECT OF THE TRANSPORTATION IMPACT FEE CAPITAL FUND IN THE AMOUNT OF $2,400,000.00 AND REDUCE THE FUND BALANCE IN THE UNSPECIFIED CENTER OF SERVICE AREA C BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Bonds Ranch Road at US 287 project of the Transportation Impact Fee capital fund in the amount of$2,400,000.00 and reduce the fund balance in the Unspecified Center of Service Area C by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 22394-09-2016 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Bonds Ranch Road Intersection Improvements Project in the 2007 Critical Capital Projects Fund in the amount of$114,224.31 and reduce the balance in reserves by the same amount for the construction of the Intersection and Drainage Improvements at Bonds Ranch Road and US 287; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the in Bonds Ranch Road Intersection Improvements Project in the Street Improvements 2008 Fund in the amount of$212,552.78 and reduce the balance in the fund reserves by the same amount for the construction of the Intersection and Drainage Improvements at Bonds Ranch Road and US 287; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the in Bonds Ranch Road Intersection Improvements Project In the Street Improvements Supplemental Fund in the amount of$73,558.80 and reduce the balance in the fund reserves by the same amount for the construction of the Intersection and Drainage Improvements at Bonds Ranch Road and US 287; and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Bonds Ranch Road at US 287 Project of the Transportation Impact Fee Capital Fund in the amount of $2,400,000.00 and reduce the fund balance in the Unspecified Center of Service Area C by the same amount. DISCUSSION: On June 28, 2016 (M&C C-27802) the City Council authorized execution of an Engineering Design Agreement with Kimley Horn and Associates in for design services of drainage and paving improvements along Bonds Ranch Road from the Burlington Northern Santa Fe Railroad crossing to FM 156 and an appropriation ordinance in the amount of$500,000.00 to initially fund the project. The first phase of the project which provides interim single lane roundabouts on Bonds Ranch Road at US 287 was scheduled to begin construction this summer with the provision that the Texas Department of Transportation (TxDOT) was providing all materials for the project. It became apparent in July, during discussions with TxDOT, that due to their procurement process and fiscal commitments, they could not deliver materials for this project to move forward as scheduled. At that point, the City made the decision to appropriate the necessary funds to furnish the materials and utilize a combination of street services personnel and a task order contractor (The Fain Group, City Secretary Contract No. 48262) to assist in the timely construction of Phase 1 improvements, which began November Logname: 20BONDS RANCH IMPROVEMENTS Page I of 3 1, 2016. Additional funding for the project is required and has been identified from several sources: completed Intersection Improvement projects from the 2007 Critical Capital Program, the 2008 Bond Program and Supplemental CO Funds, 2014 Bond Program Intersection Improvement Funds and funds from the Transportation Impact Fee Capital Fund. This project will improve safety and traffic operations along this corridor in advance of an anticipated 200,000 square feet of commercial development. This construction is one component of the overall project that includes design, project management and contingencies. The overall project budget is $4,130,388.61. This project is in COUNCIL DISTRICT 7. This M&C does not request approval of a contract with a business entity.
