HomeMy WebLinkAboutOrdinance 8036 ORDINANCE N0 dS ~ 3 ORDINANCE ACCEPTING IMPROVEMENTS oN ~ PORTION of MORRISON DRIVE AND PORTIONS OF SUNDRY OTHE~t STREETS s AVEN~PES AND PD~LIC PLACES, IN TIDE CITY OE FORT WORTHa TEXASg DECLARING TH'E CONTRACT WITH AUSTIN ROAD COMPANY FoR THE coNSTRUCTION o~° SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMEDg DIRECTING TIDE ISSUANCES EXECUTION AI~'D DELIVERY OP CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER ~YVING EFFECT TO SUNDRY CREDITS HEREIN AUTFIORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINI1°PE EOOK OF TIC CITY COUNCIL OF FORT WORTH, TEXASS AND RY FILING THE COMPLETE_ORDINANCE IN APPROPRIA2°E ORDINANCE RECORDS OF SAID CITY AND PROVIDING AN EFFECTIVE DATE WHEREASS the City of Fort Worths Texans has heretofore entered into a contract with Austin Road Company S for the maleing dead construction of certain street improvearents on tkde hereinafter described portions of streets, avenues and public places in said City, tom~iit MORRISOR DRIVE From John T White Road to 1,435' south, known and de- signated as Project No 104-36000-470, a seven-inch thick hot-mix asphaltic concrete pavement on a six-inch thick lime stabilized subgrade with seven-inch high concrete curb and eighteen-inch wide concrete gutter on a forty- foot roadway Six-inch thick concrete driveways will be ~` constructed where specified ~~ 6vHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No 7815 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, uvHE~AS, the City council of the pity of Fort ~~orth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No 7815 , and WHEfi1;Aa, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOLu, TtH;tt~+:FOR~:, BE INS ORDAINED BY THE CITY COUNCIL OF' TFiE CITY OF FORT WORTH, TEXAS, 'THAT I The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed ZI The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance Frith the proceedings relating to such improvements and assessments The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the;
