HomeMy WebLinkAboutOrdinance 8043ORDINANCE NO ,Q O T AN ORDINANCE DECLARING CERTAIN FINDINGS, PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF 76 626 ACRES (0 119 SQUARE MILES) OF LAND, MORE OR LESS, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF FORT WORTH, TEXAS, PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES, PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS, PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT, PROVIDING FOR SEVERABI.LITY AND NAMING AN EFFECTIVE DATE WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chambers in the Municipal Office Building of Fort Worth, Texas, on the 22nd day of January, 1980, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings, and WHEREAS, notice of thereto in a newspaper Fort Worth, Texas, and the 10th day of January (20) nor less than ten hearing, and such public hearing was published prior having general circulation in the City of in the hereinafter described territory on 1980, which date was not more than twenty (10 ) days prior to the date of the public WHEREAS, the population of the City of Fort Worth, Texas was in excess of 367,000 inhabitants on January 1, 1963 and in excess of X00,000 inhabitants on January 1, 1980, and WHEREAS, the corporate area of the City of Fort Worth, Texas was 152 580 square miles on January 1, 1963 and was 2~+5 582 square miles on January 1, 1980, and WHEREAS, the hereinafter described territory lies within the exclusive extraterritorial jurisdiction of the City of Fort Worth, Texas, and WHEREASS., the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas, and WHEREAS, the hereinafter described territory contains 76 626 acres (0 0119 square miles) of land, more or less, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That the following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the present boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to-wit BEING a 76 626 acre tract of land situated in the D E Norton Survey, Abstract Number 1167, and the J C Bradford Survey, Abstract Number 140, in the north part of Tarrant County, Texas, said 76 626 acre tract of land being a portion of that certain tract of land described by deed to Weldon G Carden, et ux and recorded in Volume 4305, Page 493, and also a portion of that certain tract of land described by deed to J R Burford and recorded in Volume 1353, Page 41, Tarrant County Deed Records, said 76 626 acre tract. of land being more particularly described by metes and bounds as follows COMMENCING at a 5/8 inch iron in a fence, said iron being in the north line of Watauga-Smithfield Road and being in the west line of said Carden Tract and the east line of a tract of land described by deed to Cambridge Realty Development Corporation and recorded in Volume 6114, Page 783, said deed records, THENCE N O1° 23' 04" E, along the common line of said Carden and Cambridge Corporation Tracts, 50 0 feet to the POINT OF BEGIN- NING of the tract herein described, THENCE continuing N O1° 23' 04" E, along said common line, 1,239 19 feet to a 5/8 inch iron at the northwest corner of said Carden Tract and a re-entrant corner of said Cambridge Corporation Tract, THENCE s 89° 36' 09" E, along the north line of said Carden Tract and the southeasterly line of said Cambridge Corporation Tract, 1650 56 feet to a 3/4 inch iron found at the northeast corner of said Carden Tract and the southeast corner of said Cambridge Corporation Tract , said iron also being in the west line of a tract of land described by deed to Georgia Laverne Duncan and Mary Ruth Ellis and recorded in Volume 4893, Page 597, of said deed records, said iron also being in the common line of the aforementioned Norton and Bradford Surveys, -2-~ THENCE S 00~° 36' 27" W, along the common line of said Carden and Duncan-Ellis Tract and along said common survey line, 100 92 feet to a 5/8 inch iron at the northwest corner of the aforemen- tioned Burford Tract and the southwest corner of said Duncan-Ellis Tract, THENCE S 89° 57' E, leaving said survey line and along the common line of said Burford and Duncan-Ellis Tract, 1062 37 feet to a 1/4 inch iron at the northeast corner of said Burford Tract and the southeast corner of said Duncan-Ellis Tract, said iron also being the northwest corner of a tract of land described by deed to Matt. Markum, Sr , and recorded in Volume 6319, Page 814, said deed records, THENCE S 04° 05' 32" E, along the common line of said Burford and Markum Tracts, 519 27 feet to a 3/4 inch iron found, THENCE S Ol° 54' 12" W, continuing along the common line of said Burford and Markum Tracts, 653 32 feet to a point, THENCE N 89° 04' 34" W, 1090 11 feet to a point in the common line of said Burford Tract and the aforementioned Carden Tract, THENCE N 89° 02' 42" W, 1667 38 feet to the POINT OF BEGINNING and containing 76 626 acres of land, more or less SECTION 2 That the above described territory is shown on Exhibit Map A which is attached hereto and expressly incorporated herein by reference for the purpose of illustrating and depicting the locations of the hereinabove described territory SECTION 3 That the above described territory and the area annexed shall be part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas SECTION 4 That thereafter the City Limit Line of Fort Worth shall be Located in the north part of Tarrant County, Texas, situated in the D E Norton Survey, Abstract No 1167 and the J C Bradford Survey, Abstract No 140, and being more particularly described by metes and bounds as follows BEGINNING at a point in a line 50 feet North from and parallel to the North right-of-way line of Watauga-Smithfield Road (County Road No 4022) which point is in the common line of a tract of land described by deed to J R Burford and recorded in Volume 1353, Page 41, Tarrant County Deed Records and a tract of land described by deed to Matt Markum, Sr , and recorded in Volume 6319, Page 814, Tarrant County Deed Records -3- T~TE~NCE N 1° 54' 12" E, along and' with the common line of sa%d Burford and Markum Tracts, 653 32-f~et to a 3/4 inch iron THENCE N 4° 5' 32" W, continuing along the common line of said Burford and Markum Tracts, 519 27 feet to a 1/4 inch iron THENCE N 89° 57' W, along and with the common line of said Burford Tract and a tract of land described by deed to Georgia Laverne Duncan and Mary Ruth Ellis and recorded in Volume 4893, Page 597, Tarrant County Deed Records, 1062 37 feet to a 5/8 inch iron THENCE N 00° 36' 27" E, along and with the common line of said Duncan-Ellis Tract and a tract of land described by deed to Weldon G Carden, et us and recorded in Volume 4305, Page 493, and the common Norton and Bradford Survey line, 100 92 feet to a 3/4 inch iron SECTION 5 That this ordinance shall and does amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict, this ordinance shall be, and the same is hereby made cumulative SECTION 6 That it is hereby declared to be the intent of the City Coun- cil that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sen- tence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not. affect, any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any unconstitutional phrase, clause, sentence, paragraph or section SECTION 7 That this ordinance shall be in full force and effect from and after the date of its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained APPROVED AS TO FORM AND LEGALITY .~ Arthur R Peters n, City Attorney ADOPTED ~- S f l~ ~ EFFECTIVE -4- AUGA - The only issue raised when this site was considered dealt with the maintenance of Watauga-Smithfield Road This road provides access to the subject site and is under the jurisdiction of Haltom City This is a consideration only in that an agreement should be. reached with Haltom City to determine who will maintain the road Public. Works - No immediate impact other than normal development participa- tion and probab3.e CIP projects Tax - Based on the present vacant status of the area the anticipated city of Fort Worth tax yield is estimated to be $1 100 per year Police - The annexation an an undeveloped state wall not affect the Police Department However when developed the cost would be Total Non-Recurring Costs - $ 38 413 Total Recurring Costs - 161,364 Total Costs for First Year - $199 777 Fire - Additional future fire protection may be needed with the develop- ment of phis property although. proposed Station 11 will be in -operation Water - The Water Department recommends favorable consideration of the proposed annexation ~;~ DATE _ REFERENCE SUBJECT Annexation Summerf fields PAGE NUMBER East Addition 2 2 1,/8/80 PZ-944 or Transportation - The anticipated service cost with full development is as follows Total Initial Cost - $21 500 Total Annum..
