ORDINANCE NO ~ ~
AN ORDINANCE VACATING ABANDONING AND CLOSING
THE ALLEY ABUTTING LOT 9 BLOCK 3 CLARY ADDITION
AND LOT 11 BLOCK 3 GARDEN TO RIVERSIDE ADDITION
PROVIDING FOR THE REVERSION OF SAID LAND SAVE AND
EXCEPT AN EASEMENT COINCIDENT WITH SAID RIGHT-OF-
WAY IS RETAINED FOR EXISTING AND PROSPECTIVE
UTILITIES REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH TEXAS
SECTION 1
That the east/west alley abutting Lot 9 Block 3 Clary
Addition and Lot 11 Block 3 Garden to Riverside Addition extend-
ing from the west property line of Lot 11 Block 3 Garden to
Riverside Addition eastward to the east line of Lot 9 Block 3
Clary Addition acquired by dedication be and the same is hereby
vacated abandoned and permanently closed as a right-of-way for
alley purposes
SECTION 2
That the fee to the land in the above described vacated
alley right-of-way is hereby released and shall revert to the
adjacent owners as provided by law SAVE AND EXCEPT an easement
coincident with said right-of-way is retained for any and all
existing and prospective utilities
SECTION 3
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed
SECTION 4
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage and it is
so ordained

Cleckler Street South of Clary Street
The Director of Public Works with the consent of all abutting property owners
has requested that the City vacate the eastern portion of the east/west alley
abutting Lot 9 Block 3 Clary Addition and Lo't 11 Block 3 Garden to River-
side Addition a width of 15 feet and extending from the west property line of
Lot 11 Block 3 Garden to Riverside Addition eastward to the east line of Lot
9 Block 3 Clary Addition as shown on the attached map
The subject alley right-of-way acquired by dedication is unimproved but open
on the ground and contains a 6 cast iron low pressure gas line and telephone
facilities
Reviewing City departments and private utility companies have raised on objec-
tion to this request provided the vacated alley right-of-way is replatted with
adjoining property and retained as a utility easement A satisfactory replat has
been submitted
The City Plan Commission has reviewed this request and recommends that the alley
right-of-way be vacated as requested
Recommendation
It is recommended that the City Council adopt an ordinance vacating the alley
right-of-way as. recommended by the City Plan Commission
