TO CITY SECRETARY CONTRACT No. 47120 6 Sf` the City of Fort Worth (CITY) and Baird, Hampton & Brown, Inc . , (ENGINEER) made and entered into City Secretary Contract No. 47120, (the CONTRACT) which was authorized by M&C C-27480 on the 29th day of September, 2015 in the amount of $455, 716 . 00; and WHEREAS, the CONTRACT involves engineering services for the following project: Reconstruction of Kimbo Road, from North Sylvania Avenue to Mesquite Road, City Project No. c02661; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee . NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in the proposals dated November 28, 2016, a copy of which are attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $30, 480 . 00 . (See Attached Funding Breakdown Sheet, Page -3-) . 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $486, 196 . 00 . 3 . All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Specifically,the project provides for the reconstruction Kimbo Road,from N.Sylvania Avenue, east approximately 0.85 miles (4,500 LF)to Mesquite Road.This 25-ft wide asphaltic roadway with borrow ditches is to be reconstructed with concrete pavement and curbs, and a below grade storm drain system. As requested by SWM, part of the project's scope included the interception and diversion of a small drainage (3.9-acre) basin away from Kimbo Court,westward to the existing large(16'X 10')arch-pipe, at the Kimbo Road sag just east of N. Sylvania Avenue; refer to study prepared by others-City Project 01871. The requested storm water runoff(3.9-acre) diversion is a small (0.5%) percentage of the overall (1.11 sq. mi.)drainage basin;and is located at the downstream end of the overall basin. Because of these characteristics (size and location),we felt comfortable proceeding with the request, and relying on the previous study. Please note that said arch-pipe was constructed in the late 1960's and is believed to be undersized. Furthermore,the Dry Branch Creek Floodplain extends north,to and across the Kimbo Road sag.The proposed storm drain system would therefore extend and discharge into the floodplain. Roadway reconstruction projects are typically limited to drainage improvements within the right-of-way and often connect to inadequate downstream drainage infrastructure. Accordingly,we anticipated providing the usual and customary services required for these types of projects;a Drainage Area Map, Drainage Computations, and Storm Drain Plans and Profiles. 4550 SH 360,Ste 180,Grapevine,Texas 760511 Tel:817-251-85501 Fax:817-251-8810 TBPE Firm#44 1 TBPLS Firm#10011302 1 www.bhbinc.com Kimbo Road (N.Sylvania to Mesquite) Contract Amendment No 1 November 28,2016 Page 2 Unlike land development projects, roadway reconstruction projects do not appreciably increase the storm water runoff rates; and a pre-and post-project drainage analysis is not usual or customary. At our first SWM review meeting, concerns about the impacts of the diversion were raised. We explained that qualitatively,we believed the impact was negligible and could elaborate on this by including a narrative on the drainage analysis sheet.At that meeting,we believed the matter was addressed, and we could proceed with Preliminary Plans,and provide a narrative addressing the diversion. However,follow-up discussions revealed concern about potential liability(perceived or otherwise), and a need to provide adequate technical documentation in support of our qualitative assessment. Ultimately,to address these concerns,we developed hydrologic and hydraulic pre-project, post-project and post-project w/diversion models.These required a significant amount of effort;far beyond the usual and customary drainage area map and drainage computations. These analyses were performed utilizing the industry standard HEC-HMS and HEC-RAS analyses models. We are confident of our findings,and believe our efforts generated the requested technical documentation, and support a "no-impact"finding,to the interception and diversion of this small drainage basin. Per the enclosed task/hour breakdown,we request our not-to-exceed professional services fee be increased by Thirty Thousand Four Hundred and Eighty($30,480) Dollars.Also, please note that these additional efforts began in early March and ended in late July 2016; and the overall project design and review timeline has extended an additional 4.5-months. Sylvania to Mesquite) November 28,2016 HYROLOGIC AND HYDRAULIC STUDIES The following is a clarification of the tasks that the ENGINEER will perform,and includes engineering services for a storm water study,to support the interception and diversion of a small drainage basin, away from Kimbo Court,westward to the existing large arch-pipe. 1. Preliminary/Abbreviated Study Develop a preliminary hydrologic(HMS) model of the entire basin contributing runoff to the existing arch pipe and Kimbo Road sag,just east of the N.Sylvania.The study shall include larger sub-basin sizes and document the runoff rates with and without the diversion. Utilizing these runoff rates, estimate the flow conditions,southward from the Kimbo Road sag, into the commercial development and floodplain.The results should be reported in the form of depth of flow with and without the requested diversion. This abbreviated analysis was completed, and suggested that there was an increase in the depth of flow... 2. Shift the Roadway Sag(westward)to Align with the Drainage Easement Visit the site and photograph existing conditions, at the Kimbo Road sag and through the commercial development. Pay particular attention to doorway locations and relationship of the building finish floors to the adjacent paved parking and drive areas. Develop a preliminary hydraulic(RAS) model of the roadway sag and flood plain,through the commercial development,from Kimbo Road south to NE 28th Street.The model should consider the current and proposed roadway sag location. This analysis concluded that shifting the roadway sag westward,to align with the existing easement, does not provide a useful solution.The floodwaters will continue to flow through the commercial development, along the same route as before. 3. Investigate Roadway ROW Hydraulic Capacity The existing borrow ditches, along Kimbo Road, are shallow and appear to have little hydraulic capacity. If the runoff, entering the Kimbo road right-of-way from the north, is not intercepted by the borrow ditches and conveyed to the roadway sag,then it may flow over the roadway,southward and across private properties. 4550 SH 360,Ste 180,Grapevine,Texas 760511 Tel:817-251-85501 Fax:817-251-8810 TBPE Firm#44 1 TBPLS Firm#10011302 1 www.bhbinc.com Kimbo Road(N.Sylvania to Mesquite) Contract Amendment No 1 November 28,2016 Page 2 However, reconstruction of Kimbo Road, will intercept all runoff from the north and convey it to the existing roadway sag,just east of N. Sylvania. For this analysis, develop a hydraulic model of Kimbo Road right-of-way,from roadway sag, east to approximately Kimbo Court.The purpose of the analysis is to determine how much runoff currently flows out of the borrow ditches and across Kimbo Road, and is not taken to the Kimbo roadway sag The analysis concluded that all runoff is intercepted by the roadway, and does not overflow the roadway.Therefore,the pre-project and post-project drainage patterns remain unchanged. Furthermore,the only additional runoff that will be conveyed to the roadway sag is from the proposed 3.9-acre diversion. 4. Detailed Hydrologic Study Develop a more detailed hydrologic(HMS) model of the entire basin contributing runoff to the existing arch pipe and Kimbo Road sag.The study shall include more sub-basins and document the pre-project, post-project and post-project w/diversion runoff rates. Utilizing these runoff rates, model (RAS)the flow conditions,southward from the Kimbo Road sag, into the commercial development and floodplain.The results should be reported in the form of depth of flow with and without the requested diversion. This more detailed analysis was completed,and determined that there was no-increase in the depth of flow through the commercial development/floodplain. 5. Coordinate with SWM and Report on Findings Throughout these investigations, coordinate with city staff and attend several project review meetings with various representative of SWM.
