RENEWAL OF CITY SECRETARY CONTRACT NO.22338
A LICENSE AGREEMENT FOR KRAUSS BAKER PARK
THIS RENEWAL TO CITY SECRETARY CONTRACT NUMBER 22338 ("Renewal") is
made and entered into by and between THE CITY OF FORT WORTH("City"), a home-rule municipal
corporation of the State of Texas, acting by and through its duly authorized Assistant City Manager, and
LARRY GUMFORY("Licensee"),a natural person.
WHEREAS, the City and Licensee entered into a license agreement for Krauss Baker Park, the
same being Fort Worth City Secretary Contract("CSC")Number 22338 ("Agreement");
WHEREAS, the Agreement provides for a primary term of twenty years, with one twenty-year
renewal option;
WHEREAS,the primary term expires on December 12,2016;
WHEREAS, the parties desire to exercise the twenty-year renewal option,effective beginning on
December 13,2016 and ending on December 12,2036;
NOW, THEREFORE, the City and Licensee agree to renew and extend the Agreement for the
renewal term as follows:
I.
1. The City and Licensee agree to renew and extend the Agreement for a renewal term of
twenty (20) years, effective beginning on December 13, 2016 and ending on December 12, 2036
("Renewal Term").
II.
1. Effective October 1,2015,the Fort Worth City Council revised the name of the Parks and
Community Services Department to the Park and Recreation Department. Any reference to the Parks and
Community Services Department in the Agreement shall hereinafter mean and include the new Park and
Recreation Department.
2. All other terms and conditions of the Agreement shall remain in full force and effect
except as specifically set forth in this Renewal.
3. All terms of this Renewal that are capitalized but not defined shall have the meanings
assigned to them in the Agreement.
IN WITNESS WHEREOF, the parties hereto have executed this Renewal on 7Z day of

SUBJECT I DONATION OF PARKING LOT IMPROVEMENTS AND LICENSE AGREEMENT AT
KRAUSS BAKER PARK
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to:
1. Accept a donation of a constructed parking lot in Krauss Baker Park from Larry Gumfory,
D.V.M.; and
2. Execute a license agreement allowing clients and employees of Larry Gumfory, D.V.M., to
use the proposed parking lot during normal office hours.
DISCUSSION:
In June '1996, the Parks and Community Services Department(PACSD) was approached by Dr.
Larry Gumfory about the possibilities of constructing a parking lot in Krauss Baker Park. The
proposed parking lot would serve both park users and clients of the adjacent veterinarian clinic.
Presently no off road parking facilities exist in Krauss Baker Park.
The PACSD evaluated the proposal and found that a parking facility could complement the
existing recreational amenities. In particular, this facility could provide off road facilities, which
would allow a safer situation for users of the park. While Dr. Gumfory would be allowed,
through a license agreement, to utilize the parking lot during normal office hours, conflicts with
park users are not foreseen since traditional high park usage is during the evening hours and on
weekends.
As reo',ii-d by the PACSD, Dr. Gumfory met with representatives from the Wedgewood East
Neighbor',.jod Association (WENA) to gain their input. Mr. Harry C. Purser, President of the
WENA, endorses the proposed parking lot improvernents.
At the advice of the City's Department of Law, a license agreement would be the proper
instrument to permit Dr. Gumfory to utilize this facility. The license agreement would be
restricted to use by the veterinarian clinic's employees and clients. The agreement will be non-
transfer;Ible without the written consent of the PACSD. In addition, the license agreement will
require the licensee to construct the facility in accordance with City construction standards and
specihcaj; ,,)ns. Maintenance of the parking lot, including litter control, will be the responsibility
of the licensee.
On Septeniber 17, 1996 the Parks and Comrnunity Services Advisory Board reviewed this item
and past the motion:

The Board concurs with staff's recommendation to the City Council to 1) accept a donation of
a constructed parking lot in Krauss Baker Park from Larry Gumfory, D.V.M., 2) enter into a
license agreement with Larry Gumfory D.V.M. to use the proposed parking lot during normal
office hours and 3) that the Wedgewood East Neighborhood Association review and approve the
landscape plans of the proposed facility prior to construction.
The requirement of the Board to gain the neighborhood association's input to the landscape
improvement associated with this project will be conducted by the PACSD.
This project is located in COUNCIL DISTRICT 6.
FISCAL INFORMATION/CERTIFICATION:
The Director of Fiscal Services certifies that this action will have no material effect on City funds.
