SECOND RENEWAL OF CITY SECRETARY CONTRACT NO. 46819
A PARK MANAGEMENT SERVICE AGREEMENT FOR BURNETT PARK
THIS SECOND RENEWAL TO CITY SECRETARY CONTRACT NUMBER 46819
("Second Renewal") is made and entered into by and between THE CITY OF FORT WORTH
("City"), a home-rule municipal corporation of the State of Texas, acting by and through its duly
authorized Assistant City Manager, and DOWNTOWN FORT WORTH INITIATIVES, INC.
("DFWII"), a Texas nonprofit corporation, acting by and through Andrew Taft, its duly authorized
President.
WHEREAS, the City and DFWII entered into an agreement for park management services at
Burnett Park,the same being Fort Worth City Secretary Contract("CSC")Number 46819;
WHEREAS, the Agreement provides for a primary term of one year, with ten (10) subsequent
one-year renewal options;
WHEREAS,the parties exercised the first one-year renewal term,the same being CSC 46819-R1
(CSC Numbers 46819 and 46819-R1 are collectively referred to herein as the"Agreement");
WHEREAS, the parties wish to continue this relationship and renew and extend the Agreement
for the second renewal period of one year,
WHEREAS, funding for each renewal term is based on an amount up to the equivalent of the
annual City budget adopted by the Fort Worth City Coimcil for basic grounds maintenance and
landscaping and other services in the Park as would ordinarily be conducted by the City's Park and
Recreation Department;
WHEREAS, the parties desire to set forth the funding allocation for the second renewal term;
and
NOW, THEREFORE, the City and DFWII agree to renew and extend the Agreement for the
second renewal term as follows:
I.
1. The City and DFWII agree to renew and extend the Agreement for a second renewal term
of one (1) year, effective beginning on October 1, 2016 and ending on September 30, 2017 ("Second
Renewal Term").
2. The funding provided by the City pursuant to Section 3.1.2 of the Agreement for the
Second Renewal Term shall be Thirty-Eight Thousand Five Hundred Eighty-Seven Dollars and No Cents
($38,587.00). All reimbursements and payments associated with the funding shall be in accordance with
the terms and conditions set forth in the Agreement.
H.
1. Effective October 1,2015,the Fort Worth City Council revised the name of the Parks and
Community Services Department to the Park and Recreation Department. Any reference to the Parks and
Community Services Department in the Agreement shall hereinafter mean and include the new Park and
Recreation Department.

2. All other terms and conditions of the Agreement shall remain in full force and effect
except as specifically set forth in this Second Renewal.
3. All terms of this Second Renewal that are capitalized but not defined shall have the
meanings assigned to them in the Agreement.
IN WITNESS WHEREOF, the parties hereto have executed this Second Renewal to be
effective as of October 1,2016.
