HomeMy WebLinkAboutOrdinance 8053 ,~ :~ r ORDINANCE NO 8 ~ S 3 AN ORDINANCE AMENDING CHAPTER 4 AIRCRAFT ARTICLE V REGULATIONS GOVERNING CITY- OWNED LANDING FIELDS PART B GROUND OPERATIONS DIVISION 3 REGULATION OF AIRCRAFT CODE OF THE CITY OF FORT WORTH (1964) AS AMENDED BY ADDING THERETO A NEW SECTION DESIGNATED SECTION 4-37 307 RELATING TO THE RESTRICTING OF SERVICING OF AIRCRAFT ON THE MAIN TERMINAL RAMP PROVIDING PENALTIES FOR THE VIOLATION THEREOF PROVIDING A SAVINGS CLAUSE PROVIDING A SEVERABILITY CLAUSE AUTHORIZING INCORPORATION IN THE AUTHORIZED PAMPHLET PUBLICATION OF THE 'FORT WORTH AIRFIELD RULES AND REGULATIONSu' DIRECTING PUBLICATION OF THE CAPTION PENALTY CLAUSE AND EFFECTIVE DATE DIRECTING ENGROSSMENT AND ENROLLMENT OF THE CAPTION AND PENALTY CLAUSE AND THE FILING OF THE ORDINANCE AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That Chapter 4 - Aircraft Article V Regulations governing City-owned Landing Fields Part B Ground Operations Division 3 Regulation of Aircraft Code of the City of Fort Worth (.1964) as amended be and the same is hereby amended by adding thereto a new Section designated as Section 4-37 307 which shall be and hereafter read as follows 'Section 4-37 307 Servicing of Aircraft on Main Terminal Ramp Restricted 'On and after May 1 1980 only certificated air carriers' aircraft may be serviced on the Main Terminal Ramp and all non-certificated air carrier aircraft will be required to move or be moved from the Main Terminal Ramp to the service areas of the selected transient feeler or k~x~c?x Base Operator for fueling or other services SECTION 2 That any person firm or corporation violating any provision of this O.~.dinance shall be guilty of a misdemeanor and upon conviction shall be subject to a fine not to exceed Two Hundred Dollars ($200 00) SECTION 3 That Chapter 4 of the Code of the City of Fort Worth (1964) as amended shall remain in full force and effect save and except as amended hereby ~~ ~. rte= C~rTTr"1TT i, That it is hereby declared to be the intention of the City Council that the sections paragraphs sentences clauses and phrases of this ordinance are severable and if any phrase clause sentence paragraph or section of this ordinance shall be declared void ineffective or unconstitutional by the valid judgment or final decree of a court of competent jursidiction such voidness ineffectiveness or unconstitutionality shall not affect any of the remaining phrases clauses sentences paragraphs and sections of this ordinance since the same would have been enacted by the City Council without the incorporation herein of any such void ineffective or unconstitutional phrase clause sentence paragraph or section SECTION 5 That the City Secretary of the City of Fort Worth is hereby authorized to publish that portion of this ordinance setting forth the addition to the Code in the heretofore published pamphlet setting forth the "Fort Worth Airfield Rules and Regulations" for general distribution among the interested public and such provisions of this ordinance as so published shall be admissible in evidence in all courts without further proof than the production of said pamphlet as provided in Section 3 Chapter XXVI of the Charter of the City of Fort Worth SECTION 6 That the City Secretary of the City of Fort Worth is hereby directed to publish the caption penalty clause and effective date of this ordinance for five (5) days in the official newspaper of the City of Fort Worth. as authorized by Article 1176b-1 Revised Civil Statutes of Texas SECTION 7 That the City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and penalty clause of same in the minutes of the City Council of Fort Worth and by filing the ordinance in the ordinance records of said City -2- xb-.. ,~ ~` a•- SECTI"ON 8 That this ordinance shall be in full force and e~;sect from and after the date of its passage and pulili.cat~on as above specified APPROVED AS TO FORM AND LEGALITY i ity Attorney ADOPTED ,~,~,,~ ~ L ~ ~ ~ ~ o EFFECTIVE -3- ~. ~~~ • DATE REFERENCE SUBJECT Termination of Fuel Sales and PAGE NUMBER Transient Parking on Terminal 2/19/80 G-4450 Ramp--Meacham Field lof 2 Since 1972 two Fixed Base Operators (FBO`s) Meacham Aero and Butler Aviation '(or its predecessor TexStar), have dispensed aircraft fuel and parked transient aircraft on the ramp directly west of the Meacham Field Terminal. Building On November 29 1979 the City Council authorized entering into additional fueling concession agreements with Staci's Jet Center and Texas Jet At the time the City Council approved the two new concessionaires there was the observation voiced that limiting fueling on the public main terminal ramp would obviate difficulties envisioned with f®ur competing fuel concessionaires seeking to make fuel sales to transient aircraft Tf the main terminal ramp were closed to aircraft servicing including fuel vending of all but certificated air carrier aircraft each of the four FBO's would then be required to service and park all<_itinerant aircraft on their individual ramp areas This would permit concessionaires to assign their per- sonnel to one central Location rather than staffing both the terminal ramp area and their individual hangar/ramp facilities (FBO's are not required to service aircraft at the terminal but each has determined in the past that it must do so to remain competitive ) ~- The staff has long been aware that when. a CAB certificated carrier begins opera- tions from Meacham Field required security measures will include the separation of such airline passenger service and the present transient procedure With the extension of the Terminal Building to accommodate passenger service the City has taken its first step toward developing the terminal and terminal ramp area to serve airline passengers It is believed that by restricting transient fueling to the FBO ramps the following will be accomplished 1 Each FBO can better and more economically serve the public by providing fueling and parking on their own ramps9 2 The elimination of transient fueling on the terminal ramp will make the ramp area safer for it will remove the congEStion of four fuel vendors operating in a confined area 3 The City of Fort Worth will be prepared to offer the required environment for certificated air carrier service when and if that opportunity presents itself Gates 2 and 3 on the terminal ramp would remain open for use by the commuter airlines After allowing sufficient maneuvering space the remainder of. the ramp can be used for monthly aircraft tie-downs until such time as the ePace is needed to accommodate larger commercial aircraft Meacham Aero Staci's Jet and Texas Jet all recommended -closing the terminal ramp to service including fuel vending Butler Av,ati.on :apposes such a move saying that their fueling concession contract allows them to service on ail public ramps Butler's contract does provide that it may i r c: • r ~ DATE REFERENCE SUBJECT Termination of Fuel Sales and PAGE NUMBER Transient Parking on Terminal 2 2 2 19 80 C'4450 Ram --Meacham Field of ***vend dispense and sell **aircraft fuels lubricants and propellants with others authorized to do s® on the public-use transient apron However it also provides that the right to vend sell and dispense ** shall be exercised in accordance with applicable fire codes and ordinances of the City of Fort Worth *** and, "** in accordance with *** all applicable rules regulations and ordinances of Lessor now in force or hereafter prescribed or promulgated The staff position is that should the City Council choose to close the ramp to service by ordinance it would no longer be a public service ramp and the fueling concession rights would have to be exercised in accordance with the terms of the ordinance At a meeting of the Aviation Advisory Board on Monday January 28 1980 the Board voted unanimously to close the Main Terminal Ramp to aircraft service including fuel vending to all but certificated air carriers on May 1 1980 Recommendation It is recommended that the City Council adopt an ordinance in form and wording as attached closing the terminal ramp to fuel servicing on May 1 1980 upon first reading thereof, February 19, 1980 MCM plg Attachment SUBMITTED FOR TH - CITY MANAGER'S ~ J ~ ~ DISPOSITION COUNCIL: P V PROCESSED BY OFFICE BY „ A PRO ED ORIGINATING ^ OTHER (DESCRIBE) /~^ 8 DEPARTMENT HEAD: Barr Ha11 ~ !"~"'~~"~F~ED ~,, dp°~~ ,.R Q~ CITY SECRETARY FOR ADDITIONAL INFORMATION CONTACT Arthur Petersen Ext 7EO DATE
