s ORDINANCE NO ~ o~S AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE RESIDENT QUALIFIED ELECTORS OF THE CITY OF FORT WORTH TEXAS OF A PROPOSITION FOR THE ISSUANCE OF NEGOTIABLE COUPON BONDS OF SAID CITY IN THE AGGREGATE SUM OF FORTY-SEVEN MILLION EIGHT HUNDRED AND THIRTEEN THOUSAND DOLLARS ($47 813 000) FOR THE PURPOSE OF MAKING PERMANENT CITY IMPROVE- MENTS BY CONSTRUCTING IMPROVING AND EXTENDING THE STREETS THOROUGHFARES AND STORM DRAINS OF SAID CITY AND ACQUIRING THE NECESSARY LANDS THEREFOR PROVIDING THAT SAID ELECTION BE HELD IN CERTAIN PLACES AND APPOINTING PRESIDING JUDGES FOR EACH PRECINCT PROVIDING FOR THE USE OF VOTING MACHINES AND PRESCRIBING OFFICIAL BALLOTS THEREFOR PROVIDING FOR ABSENTEE VOTING PROVIDING FOR NOTICE OF SAID ELECTION TO BE GIVEN PROVIDING THE CITY COUNCIL MAY ISSUE ANY AUTHORIZED TAX- SUPPORTED BONDS IN SUCH DENOMINATIONS AS IT MAY DETERMINE AND REQUIRING THAT THE SAME MATURE WITHIN FORTY (40) YEARS FROM THE DATE THEREOF AT RATES NOT TO EXCEED THE MAXIMUM PRESCRIBED BY LAW AT THE TIME OF THE ISSUANCE THEREOF PAYABLE SEMI-ANNUALLY AND TO LEVY A SUFFICIENT TAX TO PAY THE INTEREST AND ESTABLISH A SINKING FUND TO DISCHARGE THE OBLIGATION INCURRED BY THE ISSUANCE OF SAID GENERAL OBLIGATION BONDS AS THE SAME BECOME DUE CALLING SAID ELECTION ON THE QUESTION OF THE ISSUANCE OF SAID BONDS AND THE LEVYING OF A TAX IN PAYMENT OF SAME FOR SATURDAY THE 5TH OF APRIL 1980 AND SPECIFYING AN EFFECTIVE DATE WHEREAS the City Council of said City deems it advis- able to issue the bonds of said City for the purpose here- inafter stated NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That an election shall be held in said City on Saturday the 5th day of April 1980 between the hours of 7 00 A M and 7 00 P M in the several regular Election Precincts of said City at the polling places and with the Presiding Judges as set forth on Exhibit A' attached hereto and made a part hereof SECTION 2 That each Presiding Judge shall appoint not less than two qualified election clerks to serve and assist in conducting said election r SECTION 3 That by approving and signing this Ordinance the Mayor of said City officially confirms his appointment of said election officers to serve at said election and by passing this Ordinance the governing body of said City approves and concurs in the appointment of said election officers SECTION 4 That at said election the following Proposition shall be submitted in accordance with law PROPOSITION Shall the City of Fort Worth Texas through its City Council, issue its negotiable coupon bonds in the principal sum of $47 813 000 00 for the purpose of making permanent City improvements by constructing improving and extending the streets thoroughfares and storm drains of said City including in such permanent public improvements the straight- ening widening paving grade separation and drainage of said streets and thoroughfares and acquiring the necessary land therefor said bonds being payable serially as may be determined by the City Council so that the last maturing bonds shall become payable within 40 years from the date thereof bearing interest at a rate not to exceed the maxi- mum prescribed by law at the time of the issuance thereof payable semiannually and levying a sufficient tax to pay the interest on said bonds and create a sinking fund suffi- cient to redeem said bonds at the maturity thereof? SECTION 5 That all resident qualified electors of the City shall be entitled to vote at said election SECTION 6 That the official ballots for said election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote 'FOR" or 'AGAINST" the afore- said Proposition which shall be set forth in the English and Spanish languages in substantially the following form f SECTION 7 That voting machines shall be used for voting at the regular polling places at said election SECTION 8 That the City Secretary of the City of Fort Worth shall be the clerk for absentee voting at said election and the office of said City Secretary in the City Hall is hereby designated as the place at which absentee voting shall be conducted for said election during the regular office hours of said City Secretary Paper ballots shall be used for absentee voting and a Special Canvassing Board as set forth in Exhibit A' is hereby appointed as provided by law to count and canvas's all absentee votes and ballots cast at said election SECTION 9 That notice of said election shall be given by posting a substantial copy of this Ordinance at three public places in said City and also at the City Hall not less than 15 days prior to the date set for said election and a substantial copy of this Ordinance also shall be published on the same day in each of two successive weeks in a newspaper of general circulation published in said City the date of the first publication to be not less than 14 days prior to the date set for said election SECTION 10 That in the event the tax-supported bonds are authorized at the election hereby ordered the City Council of the City of Fort Worth Texas may issue for sale any part or portion of said amount at such time and times as in the judgment of the City Council it determines that a lawful interest and sinking fund may be provided for to take care of and discharge any part or portion of the bonds so issued for sale it being the purpose of this section to make clear that the City Council of the City of Fort Worth Texas may not be required to issue the full amount of the series of the bonds as herein submitted but may issue for sale any portion of the same at such time and times as it determines advisable under the authority hereby conferred after said election SECTION 11 That all of the bonds that the electorate may authorize to be issued at the election hereby ordered shall be in such denominations as may be determined by the City Council and shall mature serially in the regular order in which they are numbered making the last bonds mature within forty (40) years from the date thereof unless the City Council in the exercise of its discretion shall otherwise provide for such maturity and said bonds shall be sold at not less than par and shall bear interest at rates per annum not to exceed the rates prescribed by law at the time of their issuance and shall be payable semi-annually SECTION 12 That it is hereby officially found and determined that the meeting at which this Ordinance was adopted and said election was called was open to the public and public notice of the time place and purpose of said meeting was given all as required by Vernon's Annotated Civil Statutes Article 6252-17 as amended SECTION 13 That this Ordinance and election order shall take effect and be in full force and effect from and after the date of its passage and it is so ordained Woodie Woods Mayor City of Fort Worth ,= ~ -?,;
