HomeMy WebLinkAboutOrdinance 8254..t -~ ORDINANCE NO AN ORDINANCE AMENDING ORDINANCE NO 8140 WHICH ADOPTED THE 1979 UNIFORM PLUMBING CODE, AS AMENDED, BY AMENDING SECTION 1206(c2) AND SECTION 1212(a), AS AMENDED, RE- GARDING THE REGULATION OF GAS SERVICE PIPING, PROVIDING FOR THIS ORDINANCE TO BE CUMULATIVE, PROVIDING FOR A SEVERABILITY CLAUSE, PROVIDING FOR A SAVINGS CLAUSE, PROVIDING FOR A PENALTY CLAUSE, PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That the Plumbing Code of the City of Fort Worth (1979 Uniform Plumbing Code of the International Association of Plumbing and Mechanical Officers), is hereby amended so that the '~ second paragraph of Section 1206 (c2) and Section 1212 (a) will hereinafter read as follows "Sec 1206(c2) (Second Paragraph) All gas service piping (yard line to gas meter) shall be tested for a pressure not less than ninety (90) pounds per square inch for a fifteen-minute dura- tion The local gas supplier or the permit holder may perform the test " "Sec 1212(a) All gas service piping (yard lines to gas meter) 2" and smaller >shall be of ~n approved polyethelene or other approved plastic pipe, with approved anodeless prebent risers and connectors Gas service pipe larger than 2" shall be factory coated steel welded, pipe and fittings or approved polyethelene or other approved plastic pipe, and such steel pipe and risers for poly- ethelene or other approved plastic pipe shall be cath- odically protected Field wrapping shall be limited to joints and fittings with polyethelene tape Stops used in conjunction with service piping shall be approved 175~k tamper-proof type " e~rm-rnrT ~ That this ordinance shall be cumulative of all ordinances, except where the provisions of this ordinance are in direct con- fliet with the provisions of such ordinances, in which event con- flicting provisions of such ordinances are hereby repealed .~1 ~~ -a, SECTION 3 That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section nr.~nmTri wt 3i That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of Ordinance No 7626 of the City of Fort Worth, Texas, and as to any other ordinance .affecting plumbing which have occurred at the time of the effective date of this ordinance, and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prose- cuted until final disposition by the courts SECTION 5 That any person violating any of the provisions of this ord- inance shall be deemed guilty of a misdemeanor, and each such person shall be guilty of a separate offense for each day or por- tion thereof during which any violation of any provision of this ordinance is committed, continued, or permitted, and each viola- tion shall be punishable by a fine not exceeding Two Hundred Dollars ($200 00) 2 That the City Secretary of the City of Fort Worth Texas is hereby directed to publish the caption penalty clause and effective date of this ordinance for five (5) days in the offi- cial newspaper of the City of Fort Worth as authorized by TEX REV CIV STATS Art 11766-1 SECTION 7 That this ordinance shall be in full force and effect 45 days from and after the date of passage and publication as above specified APPROVED AS TO FORM AND LEGALITY Ji'~~~---~--- City Attorney ADOPTED ~ 98~ EFFECTIVE City of Fort Worth., ~'exccs JO~cayor and Cou~aczl Communa.cat~,on DATE REFERENCE SUBJECT Proposed Plumbing Code Amendment .
