AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE-
MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE
CITY OF FORT WORTH, TEXAS FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING
THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE
CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCI~ BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY~FI .~'NG'-
f~E COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE
CITY AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the
hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im-
proved by raising grading and filling same and by constructing thereon the following to-wit
Unit I Altamesa Boulevard From Old Granbury Road to east property line of Lot
10', Block 510 Wedgwood X-II Addition, known and de-
signated as Project No 021-036543-00, Unit I, a
six-inch thick hot-mix asphaltic concrete pavement
on a four-inch thick hot-mix asphaltic concrete base
with seven-inch high concrete curb and eighteen-inch
wide concrete gutter so that the finished roadway
will consist of two thirty-six foot traffic lanes
Left-turn lanes and median openings will be con-
structed where specified
Unit II Old Granbury Road east lane) From south property line of Lot 3, Block 500,
Wedgwood X-II Additions to Danciger Drive, known.
and designated as Project No 021-036-'543-00,
Unit II, a seven-inch thick reinforced concrete
pavement on a six-inch thick lime stabilized sub-
grade with seven-inch high superimposed concrete
curb on a thirty-six foot traffic lane
Unit III Old Granbury Road(west lane) From Altamesa Boulevard to Danciger Drive, known
and designated as Project P!o 021-036=543-00, Unit
III, a~seven-inch thick reinforced concrete pavement
on a six-inch thick lime stabilized subgrade with
seven-inch high superimposed concrete curb on a
thirty-six foot traffic lane
Unit IV Danciger Drive From Old Granbury Road to north property line of
Lot 30, Block 522`; Wedgwood X-II Addition, known
and designated as Project No 021-036`=543-00, Unit
IV, a seven-inch thick hot-mix asphaltic concrete
pavement on a five-inch thick base course and a two-
inch surface course with seven-inch high concrete
curb and eighteen-inch wide concrete gutter on a
forty-four foot roadway
Unit V Hastings Drive from Danciger Drive to west property line of Lot
30, Block 522, Wedgwood X-II Addition, known and
designated as Project Ho 021-036`=543-00, Unit V,
a five-inch thick hot-mix asphaltic concrete pave-
ment on a six-inch thick lime stabilized subgrade
with seven-inch high concrete curb and eighteen-
inch wide concrete gutter on a twenty-eight foot
roadway
together with concrete curbs, gutters driveways and incidentals to such improvements
on proper grade and line where same are not already so constructed together with storm
sewers and drains and other necessary incidentals and appurtenances all of said im-
provements to be constructed as .and where shown on the Plans and in strict accordance
with the Plans and Specifications therefor contract therefore has been made acd
entered into with Metro Asnhalt.Companv ,
and
WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public
Works Director to prepare and file estimates of the cost of such improvements and
estimates of the amount per front foot proposed to be assessed against abutting property
and the owners thereof and such estimates have been examined NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT

It is hereby found and determined that the cost of improvements on each portion of
streets avenues and' public places hereinafter described with the amount or amounts
per front foot proposed to be assessed for such improvements against abutting pro-
perty and the owners thereof, are as follows to-wit

The estimated cost of improvements is $ 473',;998.87 the estimated amount

six inch thick concrete driveway is $ -0- per square foot the total
estimated amount per front foot to be assessed against abutting property and the owners
thereof is $.'5.81 , plus the cost incurred for concrete driveway construction
where specified

A hearing be given and held by and before the City Council of the City
of Fort Worth, Texas, to all owning or claiming any property abutting upon said
portions of highways, streets, avenues and public places, as well as to all
owning or claiming any interest in any such property Such hearing shall be
given and held on the 9th day of September 19,g~, at A ~~ A M~
in the Council .Chamber in 'the City Hall fn the City of Fort Worth Texas, and
the City Secretary is hexeby directed to give or cause to be given notice ,of the
time and place of such hearing and of other matters and facts in accordance with
the terms and provisions of an Act passed at the First Called Session of the
Fortieth Legislature of the State of Texas, and known ,as Chapter 106 of the Acts
of said Session, now being known as Article 1105b of Ver'non's Texas Civil Statutes
as amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1,
emergency effective May-12, 1967 .Such 'notfc~ sha1T be by advertisement insexted
at least three (3) times in a newspaper published in the~-~ity of Fort Worth-,
Texas, the first publication to be made at least twenty-one (21) days before
the date of said hearing Said notice shall comply with and be in accordance witty
the terms and provisions of said Act as amended The City Secretary is furtt-er
directed to give or cause to be given personal notice of the time and place of
such hearing to all owning or claiming any property abutting on said portions-of
highways, streets, avenues and public plates as well as to all owning or claiming
any interest in any such property Such personal notice shall be in writing and
shall be given or caused to be given by the City Secretary by depositing such
written notice in the United. States Maid at least fourteen (14) days before the
date of the hearing postage prepaid in envelopes addressed to .all persons
owning or claiming any interest in the respective properties abutting the high-
ways streets, avenues and public places or portions thereof to be improved, as
the names ~ ~ such persons a.re shown on the current rendered tax rolls of the Cfty
of Fort Worth and at the addresses so shown, or if the name of such respective
owners do not appear on such rendered tax rolls then address to such owners as
their names are -shown on the current unrendered tax rolls of the City of Fort Worth
at the addresses ,shown thereon In those cases in which an owner of property
abutting a highway street, avenue orpublic place or portion or portions there-
of which is to be improved is listed as "unknown" on the then current Cfty of
Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth
tax rolls but no address for such owner is. shown, no notice need be mailed In
those cases where the owner i$ shown to be an estate the mailed notice may be
addressed to such estate In this connection the City Secretary shall prepare
and file or cause to be prepared and fi-led with these proceedings a list of the
properties to be assessed, the names. of those persons owning or claiming any
interest in said properties to whom the notice was mailed together with the last
known addresses determined as aforesaid of the respective owners and those~per~,
sons owning or claiming any interest in said property
The City Secretary shall certify that each of the parties in said list whose
address is shown on the then current rendered or unrendered tax rolls of the City
o.f Fort Worth was mailed a copy of .the notice of hearing and shall further certify
the date. or dates on which said notice was mailed A copy~of each.. notice shall be
attached to such certificate The certificate of the City Secretary will. be con-
clusive evidence of the facts therein recited

The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council and by
filing the complete ordinance in the appropriate Ordinance Records of this City

This ordinance shall take effect and be in full force and effect from and
after the date of its passage

This project was initiated in conjunction with Community Facilities Contract
No 10753, Wedgewood X-II Addition, approved on September 11, 1979 (M&C ~=4718
Revised), as amended by Contract No x0873, approved on November 29, 1979
(M&C C-48$0) Altarnesa Boule~rard is an inferior street in the development,
however, a variance was granted to improve -the street on the assessment basis
due to the immediate tz~affic need of the roadway in the area Theā¢:remaining
streets bonder the decvelopment

Deferred Payments - Based on standard policy and special provisions of Community
Facilities Contract No 10753,. it is proposed that approximately $270 307 03 wl
be assessed againe:t properties adjacent t'.o.Altamesa Boulevard on a deferred
payment basis which provides that .repayment of assessments will be paid to the
City in installments of 1%'S of the principal amount plus accrued interest
annually The first annual payment shall become due and payable one year after
completion of construction and.gcc.eptance of the project by the City Included
in the assessment is t:he cost of pavement .and curb and gutter; the developer's
share of storm drain cost and the deve].nper cost of 4 left turn lanes and two
median apenir~gs leading t;o private property
Standard Assessment - Based on standard policy and the low bill, approximat:=ely
$lb9 165 45 is proposed to be assessed against properties adjacent to Old
Gxanbury load, Damc~.gar Drive at~d Hastings Drive, to be repaid in accordance
with standard pc~li.cy (49 months) consisting of five .annual payments with 6%
Interest per annum on the unpaid balance, the first payment being due 30 days
after the project has been completed and accepted by the City
Financing - Total proposed.assessments will be approximately $439,472 48, which
will be provided by a bond fund transfEr from the Revolving Fund Unspecified,
less $20 340 presently in the project account Cost to the City for street and
storm drain construction is approximately $521 612 77 plus $54,401 05 for

consultant design engineering costs to the City were $53 700 under separate
