HomeMy WebLinkAboutOrdinance 18127-06-2008Ordinance No. 18127-06-2008 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $841,008.00 AND IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $290,334.80 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF EXECUTING A CONTRACT WITH MCCLENDON CONSTRUCTION COMPANY, INC. FOR PAVEMENT RECONSTRUCTION AND WATER AND SANITARY SEWER MAIN REPLACEMENT ON PORTIONS OF FORBES STREET, GRIGGS STREET, EASTOVER AVENUE AND MILLET AVENUE (PROJECT NO. 00449); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2007-2008 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $841,008.00 and in the Sewer Capital Projects Fund in the amount of $290,334.80 from available funds, for the purpose of executing a contract with McClendon Construction Company, Inc. for pavement reconstruction and water and sewer main replacement on portions of Forbes Street, Griggs Street, Eastover Avenue, and Millet Avenue (Project 00449). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the transfer of funds in the amount of $1,131,342.80, which includes the Water and Sewer Operating Fund to Water Capital Project Fund in the amount of $841,008.00 and the Sewer Capital Project Fund in the amount of $290,334.80; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Project Fund in the amount of $841,008.00 and the Sewer Capital Project Fund in the amount of $290,334.80, from the available funds; and 3. Authorize the City Manager to execute a contract with McClendon Construction Company, Inc., in the amount of $2,115,582.39 for pavement reconstruction and water and sanitary sewer main replacement on Forbes Street (Miller Avenue to Hatcher Street), Griggs Street (East Berry Avenue to Forbes Street), Eastover Avenue (Ramey Avenue to Avenue N), Millet Avenue (Bishop Street to Campbell Street), and Millet Avenue (Wallace Street to Dillow Street). DISCUSSION: The 2004 Capital Improvement Program (CIP) includes funds for pavement reconstruction on all streets mentioned above. Street improvements include pavement reconstruction, construction of integral curb and gutter, driveway approaches and sidewalks as indicated on the plans. The Water Department has determined that severely deteriorated water and sanitary sewer lines should be replaced prior to street reconstruction. The project was advertised for bid on February 21, 2008 and February 28, 2008 in the Fort Worth Star- Telegram. On March 27, 2008, the following bids were received: Bidders McClendon Construction Company, Inc. Stabile & Winn, Inc. Burnsco Construction, Inc. JLB Contracting, LP Amount Bid Time of Completion $ 2,115,582.39 260 Working Days $ 2,172, 025.70 $ 2,176,538.60 $ 2,180,300.87 Lognaine: 30CIP YR4 CON47 Page 1 of 3 Conatser Construction TX, LP $ 2,208,050.25 Jackson Construction LTD $ 2,275,987.50 The new pavement will consist of 6-inch concrete over 6-inch lime stabilized subgrade with 7-inch integral concrete curb. Funding in the amount of $97,569.80 is included for associated water and sewer construction surrey, project management, pre-construction, material testing, inspection, and project closeout. (water $75,123.00 and sewer $22,446.80). The contingency funds to cover change orders total $37,757.00(water $25,000.00 and sewer $12,757.00). Funding in the amount of $117,169.04 is required for associated paving and drainage construction survey, project management, pre-construction, material testing, inspection and project close out. Contingency funds for pavement reconstruction is $33,587.00. M/WBE -McClendon Construction Company, Inc. is in compliance with the City's M/WBE Ordinance by committing to 13 percent M/WBE participation and documenting good faith effort. McClendon Construction Company, Inc. identified several subcontracting and supplier opportunities. However, the M/WBEs contacted in the areas identified did not submit the lowest bids. The City's goal on this project is 21 percent. This project is located in COUNCIL DISTRICT 5 MAPSCO 78Q, R and V. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations, and adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, in the Water Capital Projects Fund, the Sewer Capital Projects Fund and the Street Improvements Fund.
